  1. Hi!

    I went to my interview on may 27, 2015 and the CO asked for more evidences for reestablish domicile.

    We sent them on july 8, 2015 and arrived at the embassy on july 9, 2015.

    The status was stuck in ready since june 12, 2015 until july 15, 2015.

    And now:

    07/15 - ready

    07/16 - ready

    07/17 - ready

    07/20 - ready

    07/22 - ready

    Anyone experience the same situation?

    I'm aware of the problems that the embassy's had, but I already saw people that went to the interview on july 15 and already have the visa issued.

  2. Does he have US passport ? If yes, make him look at all the pages carefully - it's actually written there. And fact that others violated the law isn't quite an excuse for him...

    Anyway - he will use from 2555 (if I remember correctly) for a foreign tax exclusion, convert his euro salary in $ and report to IRS. If he make over the exclusion limit he'll have pay tax on it, if not - no problem (assuming he paid taxes on Portugal). I had to do same thing during the year I immigrated to US - had to report income from my home country which was for most of the year.

    For the most part it's not as bad as it sounds as in the most cases you don't pay anything - just have to file it.

  3. Same way millions of other people do, he doesn't need anything else. Filing taxes has little to do with establishing domicile and most likely won't be even close to it - it something he was supposed to be _doing_ by law, not because he is trying to establish domicile.

    He didn't know that he needs to fille taxes in the US. My parents in law never told him that he needs to do it.

    My parents in law and my sister in law are also USC and they never did it and all of them live in Portugal.

  4. As a US citizen he is required to file taxes. They tend to only look at the last few years for immigration. So he can go to the irs.gov site and file those taxes. He needs to be living in the US for you to get a visa. He may not owe any money on what he has earned unless he makes a lot of money.

    He just have SS number and passport. How can he file tax with this documents?

    He doesn´t need to live in the US, he just needs to prove that he will reestablish domicile.

    I'm filling for CR1 visa.

    At this moment we are filling our form I-864 and i have a question.

    My husband is an USC, he was born in the US but he came to Portugal when he was 1 or 2 years old. He never went to the US after that. He grew up in Portugal, studied in Portugal and worked in Portugal.

    So he never file taxes in the US, just in Portugal. How can we explain why he didn't file?

  6. We call to embassy in Lisbon and they said that the visa process its done in Paris.

    They said that there was a centralization of services.

    In Lisbon they also said that he must be at the interview.... ok.... now I'm confuse again... :ranting:

    Why would your embassy be in Paris when you live in Portugal?

    Also the petitioner in this case doesn't need to be present at the interview.

    You also have a ways to go before the interview.

    And yes he must show he is attempting to re-establish domicile to the satisfaction of the consular officer at interview.

    $60,000 USD is enough to not need a joint sponsor, however a consular officer can still ask for one.

    we already talked about him move to the US and file for me later, but our embassy is in Paris, doesn't he need to travel to France for the interview?

    Domicile and income or an additional sponsor. That is why he most likely will have to move to the US and file for you later.

    There is a lot of proof required to show he intends to live in the US. A good start would be seeing if he could live with his cousin while he establishes himself. Your husband will need a US address he is living at and other proof such as a driver's license, voter registration, bank accounts in the US, etc. to prove he intends to live there. He will also have to provide proof he makes at least 125% of the poverty level for his household size. If it is just two of you that would be around $20,000 per year (it must be US income) or that he has assets of about $60.000. His cousin can be a joint sponsor for him if the cousin meets the 125% poverty level for his household size plus you.

  8. He will probably need to travel to the US to obtain a residence and employment. He will need to prove you have a place to live in the US and the income to support you when you arrive. Read the requirements for a spousal visa and see what he will need to do. Highly unlikely you will travel together unless he has good friends or some relatives living in the US already.

    He does have a cousin in the US. How can he help us?

    i'm married to an US Citizen. We both live in Portugal.

    He was born in the US, but he came to Portugal at the age of 2 and he live is whole life here.

    I don´t understand why he must live in the US. He just want to go back there and take me with him. How can i go if he doesn't live there? Can anyone help me?
