If he was living in the US while being a permanent resident when she became a USC, then he should have become a USC at that point in time.
If he abandoned his residence before she became a USC, then he has no claim too be a USC. He would need to be petitioned by somebody - presumably the mother - to obtain a new green card.
Depending on his current age (under/over 21) and marital status (married/single), the process could take about a year (IR-2) or several years (F1) or ~13+ years (F3).
He lived in his home country with his green card. He was told if he entered the US he would have to stay, he couldn't because of new born son.
His mother was a citizen before he was 18.
what is his best course of action to obtain green card or should his mother go for citizenship for him?

Hello I am trying to help a friend, Ok here goes.
1. His mother is a citizen
2. He ,her son had a green card
3. she was a citizen ,before he was 18
4. he over stayed his green card, in his home country
5. Green card was returned
what is his next course of action to be legal in the USA

My wife a citizen cant find her birth certificate, we have our citizenship interview coming up soon? what else can she use?

souldnt be a problem, but if you have a tracking number for you,see if they got it yet and if not have it return to you so u can make the change

That's what we were told.
So we did file an AOS it was received last month & biometrics are next week...so maybe a month until we get an update?
ok yes once ur I94 is expired , you now have to wait for your AP/EAD to get approved, after your Biometrics, you can then go get your SSN card.

When you filed, did you do all together, AOS,AP and EAD? do you have your GC?

you can get SSN number now, actually you could have gotten it when you came, all you would have to do is show your K1 visa to the ssn office. Take your passport,marriage certificate, birth certificate. they will give you a letter and mail it to you.

We received the same exact letter today, and we are from DC.

did you take your wife passport with the K1 and I-94 inside? once you show this you will get your SS number, you check out the step by step here on visajourney. some SS place dont know so they will refuse you but its the law and when she gets it, it will have her number and also work authorised by DHS only.

go to the step by step ssn and print out the form and take to your SSN office, some staff dont know that a K1 person can get a SSN., you can also take the passport that has the K1 visa stamp inside of it .

If you search some of the post on here, you would find that once you dont file the AOS, your not on the hook financially for him or you can just not submit the evidence , which will most likly get a denial and send them a letter stating that you have ended things and wish to end the paper work. But check out other post or ask one of the admin like penguin for advice.

question what is the $420 for? AOS is just $1070.00? which includes AOS, EAD AND AP.

thanks but i am still confused by the category of of C9 or A6, the form on VJ says one thing but the list says different? HELP VJ CREW.

I am filling out my AOS Forms which category do i use is it A6 OR C9, ALSO is it just the I-485 and I765 that i fill out? I dont need the Advance Parole but i will do the G 1145.

i guess it depends on the time to travel, the morning flights arent as busy. plus also the CBP Officer said to go get my SS asap, since the I-94 is electronic the SS offices doesnt have to wait for it to update in the system anymore.

Came thru Miami on the 7th of feb, gave the IO the package went to back room,the guy didnt ask any question, he just said try to be married before 90days and congrats. I made my flight I had bought one with a 3hr lay over just to be safe and only took 5 mins . then was off to DC. Thank you soooo much VJ crew.now on to the next journey AOS.
