I am US, she is Canadian. We have been together for most of the last 4 years up until Dec. 2005. We lived in another country together for 2 years. I took a job back in the US in late 2003. She followed in Jan. of 2004. Since that time she traveled regularly back and forth to Canada without a single problem. However , upon returning to the US in Dec. 2005 she was Denied entry at a border crossing. She was questioned, and fingerprinted. She was told she was being denied entry for the day and she needed to have documents, reference her ties in Canada. She returned home and collected bank statements, mortgage info, hydo bills etc. Several days later she attempted to fly out of Van and was stopped again and told she needed to re-establish her ties in Canada. This time they had her sign a WITHDRAWAL of APPLICATION FOR ADMISSION/CONSULAR NOTIFICATION Form.
Now, after 3 weeks of reading all we can on immigration,we are ready to start the long visa journey. But which one? K-1 or I go to Canada and we get married and go the I-130 route? Please understand we love each other very much and have dedicated our lives to being together no matter how long it takes. We are seeking advice from thoses that have experienced any or all of our circumstances. Like all those before us, we want to get back together as soon as possible, but we want to do things properly. We would like to be together in the US while the process is taking place but are fearful if she got denied again they might ban her, making things worse. Any suggestions or comments will very much be appreciated.
