Anyone have any experiences with the DMV in DC? We are going in with an EAD in hand. But the DC forms say that you cannot get a license if you are here on a K-1.
Are you really on a K-1 if you have gotten married and applied for AOS? It's odd, but we are not yet approved for residency, but also not here on a valid K-1 since that expired some time ago. We are in that limbo period waiting for the adjustment of status to come through. The I-94 is obviously expired since we got married and adjusted.
Anyone out there seen how the DC DMV handles the K-1 in adjustment status?

Got our biometrics appt in the mail last night. Jan 2.

Yup. NAO date is Nov 14. (I had it wrong in the previous post). NOA says wait for letter on biometrics. But nothing we have not even gotten a touch on the EAD, AP or Adjustment of Status since the Nov 14 NOAs for all three.
I called USCIS. They say wait for 60 days after the NOA to call about biometrics.
Frustrating, since everyone else seems to get the biometrics appt 2 weeks after the NOA.

Each state is different. In DC, if you don't have the EAD, then you will need the Green Card. So yes, you need to wait in DC. Your state may be different.
I found that out the hard way - by waiting in line at the DC DMV today.
As many of you already know, a few documents are needed to get a US drivers license.Passport
Drivers License from home country and proof it is currently valid
Marriage certificate
Utility Bills
Ok here is my confusion.
It specifically says you need proof of applying for Permanent Residence
and a valid EAD work authorization card
Does this mean you have to wait months to get the license? EAD cards are currenly taking 100 days.
What if my wife doesn't want to work how would she ever get a drivers license in the states unless she gets an EAD card? The reason I ask is because we do most of our work internationally.

I heard a rumor about getting rid of EADs. Could that be why we have not gotten a biometric appt for an EAD - they are simply going right to the AOS process?

We applied for an EAD with NOA of Nov 17. Mailed it to the Chicago address, but our local office is in DC.
We have not gotten any touches or any request to schedule a biometrics appt. I see that the normal time between NOA and Biometrics appt is 14 days, while we are closer to 28 days now.
Anyone else having a similar problem, i.e. not getting a request for biometrics appt?
Also, how do they inform you about the biometrics appt? Letter in the mail?

Just tried this today at DC DMV. They require either Green Card or EAD valid for 6 months. The temporary EAD we got at JFK was not enough. So we have to wait.
The website said nothing about that. But then again, it is DC.

We went to the DC DMV today with the K-1 visa, I-94, temporary employment authorization (stamped at airport) and marriage certificate.
DC has a rule. Cannot get drivers license on a K1 until either you have:
1- Permanent EAD, or
2- Green Card.

Directions on the form says:
"The photos should show a three-quarter frontal viewof the right side of your face, with your right earvisible and your head bare (unless you are wearing aheadress as required by a religious order of which youare a member).
The photos should be no larger than 2 by 2 inches.From the top of the head to just below the chin, theimage of your head should be about 1 and 1/4 inches.Using a pencil, lightly print your Alien RegistrationNumber (A#), if any, on the back of each photo."
I thought they went to straight on passport photos? Can I get some feedback from those who filed their AP with their adjustment of status. Did you use frontal or 3/4 photos?

I am in too, and I live in DC.
Here is what I think we need to do. This would be better organized through email, since that it can spread better.
I set up an email account to start the chain. visaaction@gmail.com.
Send a note to that account with your email address and we will start an email chain to organize. We can always change it later, but that at least will give an alternative forum to gather interest.

So I recall reading somewhere that the Service Centers have a 4 month timeframe for processing the petitions, between NOA1 and NOA2. Basically, if it takes longer than 4 months, even USCIS says that it is too long. It's the amount of time that they allow themselves to do the job, even though VSC was taking only a few weeks, back when the system actually worked. One of the many people that I called some time ago at USCIS told me that they had a 4 month window to process, and that I could not complain as long as it was in that 4 months.
So my 4 months is up on July 20 and my case has not been reviewed yet. Can I complain now?

Oh my - I'm really befuddled now. Just got off the phone with VSC - they DO NOT have my petition. NVC from yesterday said they DID NOT get my petition back. Ergo, my petition is still at the consulate or explicably still on its way, or, in the worst case, completely lost. So I ask, how can I get in touch with the consulate to find out when the case was sent back without paying $5/minute and getting no answers? Luckily, I'm in Moscow and can go directly to the US Embassy here, but who do I ask for - Head of CIS? I'd like to find out the info from the Embassy side before I contact DoS...

Last week, I was in the same boat as you, my petition having been lost somewhere between Moscow and Vermont. It had been mailed from the Embassy in late May and by the first week in July it was still not at the NVC. It took some time, but here is how I found it.
First, I called the Moscow embassy phone number and gave them my MOS#. I asked them if my petition had been sent back to the NVC yet. They responded that it had been sent.
Second, I sent an inquiry to state via email. nvcinquiry@state.gov. Give them your Receipt Number from the service center and ask them flat out: "Have you received my petition back from the Embassy yet?" Also ask them in the alternative if they sent it to the Service Center yet. They will respond in about 3 business days.
Third, call the state department. They have a visa inquiry phone number posted on their website. 202-663-1225. Go buy a phone card on the street for 10 cents a minute. Worked for me when I lived in the 'Scow.
These things are not "lost" as you and I know it. They are just "in transit" as the government knows it. That means that they are often sitting somewhere, waiting for someone to process the paperwork to move it from A to B. Eventually, they get where they are supposed to go, but the process is long and arbitrary.
I know you probably know all of this. But I was able to locate mine by using that process. Not so sure that it moved any faster, but it did put my mind at ease a bit.

finally got touched today. Case was re-opened July 10. I got the same email message as everyone else, something about "further review" etc.
It only took them 6 weeks to get it back from Moscow...
Maybe I should have read my message from USCIS a bit better. Case has not been re-opened, they just informed me that it had been received by VSC from State:
"On July 10, 2006, we received this case back from the Department of State for further review. We will mail you a notice when our review is complete or when we take other action."
Anyone gotten this message before? I have seen a lot of messages about cases being re-opnened, but none about informing petitioner that the case had simply been received back.

t&s: I am in the same boat as you. Petition recalled but Vermont has not even re-opened my case yet. I have never gotten any word, even from the Embassy in Moscow, other than a phone call from the Embassy to my fiancee a few days before her interview was supposed to happen.

I did some math based on the information we all provided in our other thread. I am calling it speculation, so it belongs here. Based on our group as a cross-section, here are some thoughts about how well VSC is doing (did not count the CSC entry):
65% of people who received NOA2s have had there cases "re-opened".
35% of people who received NOA2s have not had there cases "re-opened".
(This will loosely corellate with the percentage of people whose cases have not been received back from State. Lag time between receiving case back and re-opening it might make the figure different).
61% of people who received NOA2s have received notification that they will be receiving an RFE.
17% of people who received NOA2s have received RFEs.
Based on the 1100 number they gave us earlier:
715 People have had their petitions re-opened.
385 have not had there petitions re-opened.
187 people have received RFEs.
Cancelled interview that was never scheduled?

So we got an email cancelling an interview for AOS. Trick is, we never got any notification, email or by post, that the interview was scheduled to begin with. Now, we have not gotten a letter by post saying it was cancelled.
I know that if you have an interview cancelled, you should go anyway just in case. But in our situation, since we never got any notification of an interview to begin with, we don't know when to go for the "cancelled" interview.
Called the "help" line, they could only tell me what was available on line.
Anyone else see a situation like this? Infopass appt set for March 1, but could use some history from others while we wait.
