  1. Thank you for the reply. I am wondering how to schedule the interview. We need to know a date because we need to get her son in for the medical exam, and she is returning to Ukraine for only a limited period of time. We would like to get an interview scheduled so we can schedule a medical for the day (or two) before.

    Is the best route to call them? Also do we need to fill any forms to 'reactivate' her sons petition, or will they just conduct the interview as if the petition was still active?

  2. Ok this is a somewhat complicated situation.

    My girlfriend is a LPR who came to the USA last year on an F1 visa via consular processing.

    On her F1 visa application her 10 year old son was also listed. However, she was unable to gain permission from her ex-husband to bring their son to the USA at the time of her interview. During her visa approval interview (at the embassy), she explained that she is still trying to secure the proper court ruling to allow her son to come to the USA as well. The person at the embassy said that was ok and that they will 'leave her sons file open' as long as she continues to notify them at least once per year that she is still trying to bring him to the USA.

    Fast forward 8 months. She was recently able get a court ruling allowing her son to come to the USA without fathers permission (full custody). Where do we go from here?

    Questions are mainly:

    1) how do we schedule the interview (is there a form to fill out? Call the embassy? etc)

    2) will the embassy still allow her son to come under her visa petition? (impression is, yes because his file is still 'open' and on file according to the embassy)

    3) Does "follow-to-join" rules apply to her and her son's situation?

    I appreciate any insight, thanks in advance.

    FYI this is for Ukraine.

  3. You mean when they immigrated legally and integrated and contributed to their communities and country instead of bringing the standards of living down and turning it into Little Shithole Mexico?

    Right, I forgot, all those people who came over in the early 20th century waited for a decade to immigrate right? No. They got on a boat and were admitted into the country. Back then the system was different and wasn't the mess it is now.

    My point is the system needs reform. Our immigration system is a complete mess, and we should give people the ability to come here just as easily as YOUR ancestors did!

    And you are complaining that illegal immigrants bring down our standard of living? I agree, but you need to ask yourself why? Maybe its because they don't have access to healthcare, minimum wage, education, and other benefits that US citizens enjoy? If you give people the ability to work, pay taxes and contribute to the system, these people wouldn't be as much of a burden on society. However, your line of thinking doesn't do anything to solve the problem - only vilify hard working people who want a better life... bravo on your selfish, xenophobic and non-proactive perspective.

  4. and yet, whatever problems he is facing is NOT MY RESPONSIBILITY, nor that of any other American citizen....it is not my fault nor the fault of any other American citizen that Venezuela is a country that is, well, a cesspool....sorry...but I cannot fix it, nor is it the moral obligation of the citizens of the US of A to 'right some wrong' somewhere in the world....no Venezuelan is offering meaningful employment to some American citizen who is out of work...why do any of us owe some standard of living to somebody who is a citizen of another country? (cannot think of one single reason)....you may think I am heartless, mean, uncaring, or whatever....but I don't care what YOUR opinion is...all I know is that the US is MY country, not that of some random citizen of Venezuela, Honduras, Outer Bum Phuqque Mongolia, or wherever....it is MY country, with its own laws, and.....our focus should be on our own citizens, not people who are not citizens of the US of A, who have not paid a penny in taxes, not joined our military, etc, but who somehow believe that they are entitled to some largesse courtesy of the US taxpayer....nope....not gonna happen....

    Your grandparents (or great grandparents) are lucky that they didnt have you around back when they came to the USA. Keep watching FOX news bozo. Your lack of critical thinking, and overt bigotry is obvious.

  5. allowing unfettered access to the US by every child who is unhappy with their lot in life will only result in diseases arriving by the carload, huge tax burdens on the American taxpayer, etc....why allow this? The US of A does NOT owe a decent standard of living and free education and medical bennies to the entire planet...ship those brats home....otherwise, guess what happens next? Yep...their irresponsible parents will be given some sort of status so the family can be reunited...and the US of A rapidly spirals down into third world status.

    OR we could have immigration reform and have these people be able to get jobs, pay taxes and contribute to the economy and not be such a 'drain' as you so eloquently put it. Grow a brain. The system is broken the way it stands, and instead or resisting change, you should embrace it and create a system that recognizes the reality that people are going to come to the USA either way.

  6. You are better off traveling to europe, or some country that does not have visa requirements for ukrainians (thailand, turkey, etc) to meet up with your friend. I did this last year and met a friend in Prague.

    Or as mentioned, she can try for a student visa, or she can try out the work travel program (lets ukrainians come to usa to work on a temporary basis).

  7. Recently as of June 14th or so, they changed the locations where you get your medical exam. The one on the Kyiv embassy website is correct.

    Called yesterday however, and like you said, no one answered. After calling a few times, a 'security person' answered and transfered the call to a very rude woman whom sounded upset to be bothered.

    Not sure whats going on there...

  8. Ok yesterday finally received interview letter.

    I am wondering what documents I must bring to the interview at the Kyiv embassy, besides those listed on the interview letter. For instance, I intend on bringing my minor son with me. It mentions nothing on my letter about having to bring court documents showing sole custody, but it seems obvious that they will want them.

    Can anyone comment on additional paperwork that I will need to bring, besides what is listed on the letter? (I have a new police certificate already).

  9. Just dropping in to say, we called NVC, finally got through.

    They said they have an interview date scheduled in Kiev on July 2nd, and that they havent sent out the interview letter yet, but should receive it soon.

    So based on this, I guess most letters, but not all letters, come during the first week of the month. But some still come even after the VB is posted.

    And to comment re: slow movement of F1. We really need immigration reform in the USA and it should be (and is) a non-partisan issue. When you look at why is F2B moving faster than F1 now, America's broken immigration system is your culprit. Its frustrating but the only way to change it is to become an advocate for change, contact congress, write letters, make phone calls. Support candidates who take a non-idealogical, pragmatic approach to immigration. /rant off

  10. Hey Cassanoa apart from the updated tax papers were u requested to bring an updated Affidavit of support.

    In my letter the code states that NVC has sent the financial evidence to the embassy. It does not ask me to bring it along. But it does state somewhere on the letter that even if i have submitted documents that i must still bring them with me. Does that mean that i must bring along an updated affidavit of support.

    It would be appreciated if anyone who knows the answer can reply. Thanks.

    THey probably want an updated AOS with 2013 tax information from your sponsor. Be sure to bring a copy of your sponsors 2013 taxes just in case. You might even want to bring an updated AOS with the new tax info to have all your bases covered.

    Hi thank you, embassy says it cant do anything yet because it hasnt received my documents from the NVC. Meaning, I give them my case number (KEV###) and its not in their system/cant do anything yet. This was some time ago though, not within the last 2 weeks. Maybe will try contacting embassy again.

    Based on what Ive been seeing my priority date will become current as of July 2014 VB. However, it seems everyone else (from other countries) have received an interview letter, but I have not. I am wondering what the problem could be and if perhaps its because the Kiev embassy is overbooked/too busy to schedule an interview?

    It seems I should have gotten an interview letter by now, and am confused why it hasnt come yet. I tried calling the NVC but I keep getting the busy signal for the last two days. Anyone have any thoughts or theories?

  13. My son is under 21 and unmarried. He qualifies as an Immediate Relative. The reply that I received stated that the petition is with an adjudicator. So, you are saying that the request was denied because the priority date is not current and that the petition is not with an actual employee who is processing the application?

    If your son is under 21 then from what I understand, he doesnt have a "priority date" per se, because he qualifies as immediate relative (as your husbands step-son) and doesnt need to wait for a visa #. I thought "adjudicated" meant waiting for PD to become current (as in I-485 applications "waiting adjudication").

  14. You expedite request was denied because your sons priority date is not current. You can only expedite a case whos PD is current, or qualifys under "Immediate Relative" (IR) status.

    Adjudication = waiting on PD to become current

    (Since you didnt give specifics on whether your son is over age 21, or whether or not you are a US Citizen, I am assuming he is under F1/F2B visa category)

  15. Abuse isnt just physical. Controlling behavior of her spouse certainly qualifies as 'abuse' (psychological). Abuse is completely about controlling someone, whether that be through physical means or in this case, through the fact that her husband has power and control over her due to her immigrantion situation.

    Whether or not that qualifies under VAWA is a different matter, but the point is, there are resources out there, and people she can contact for help.

  16. There is lots of information and help available to you, through the VAWA (Violence against women act) and protections for immigrants who are being abused (it sounds like this applies to you).

    You can also contact this organization, they deal with immigration and abuse situations. They even offer free legal advice. I recommend talking to a lawyer who knows about the immigrations system:
