But they didn't apply based on financial hardship. They applied based on income below 150% poverty level. And the only requirement for that is to send the tax return, which they did. So I don't see how this is an issue of not sending enough evidence or documentation.

    Exactly!  I guess we'll get a letter??

  2. My husband said that he sent in the N-400 and also the I-912, and then a week or 2 later he got a letter saying he used outdated forms and also needed to provide credit card info.  So he redid the application and waiver with the new forms and send in cc details!

I was away visiting family for a few weeks, so I wasn't here, and this is only based on emails and phone calls while I was away.  I'll need to ask him to clarify.  You're right, it doesn't make sense to provide payment details PLUS a request for a waiver.

He only gave low income info because he said you only need to choose one.  I just read that on the website too.

If USCIS determines through documents you sent with the waiver that you are not eligible, they will process the payment and deny the waiver.

What did you send them as supporting evidence in terms of income?  What is the size of your household?

I think my husband said they asked for last year's tax return, so he sent that.  Our household is 4 people, and income is $25,000.

  4. My husband submitted the fee waiver application with his N-400 application.  We are well below the 150% poverty level.  He just noticed there's a pending transaction on our credit card for the full amount of the application!  He sent the application about a week ago.  No mail from them yet.  Does this mean he was denied and they're just taking the money???

  5. I don't know if this is helpful but I just met someone here in the US who said they came for a visit and the Green Card, then went back to the UK, then he got a job in the US so they moved over, just 5 months ago. She told me you have 6 months in which to get to the US, and if you leave, you then have one year to come back. This is just what she told me a couple days ago, not sure if it's 100% correct.

  6. Dh's interview is next Monday, I think he should start applying for jobs in the US already. Once he has the IR-1 he can truthfully say he's legal to work in the US, right? So he might as well say that now? Or at the latest, wait till he gets that? He shouldn't have to wait till he gets to the US and has the actual Green Card right? The kids and I are over here in the US waiting for him, so I would like him to get a job asap!

  7. I sent the I-130 and a few weeks later left for the US with my kids. I'm here now, while dh waits for the Green Card. I'm not working, we're living with my parents, my dad said he can be a joint sponsor, his income is 125% above poverty level for me, my kids, dh and my parents.

My question is, where do we send it to? Do we need to fill this form out and send it to my husband in the UK to mail it in, or bring it to the interview, or do we post it from here?

  8. I thought I needed someone to be a joint sponsor, but just read the instructions and I'm not sure how it's different, but I can use just myself as the sponsor for my husband, and my dad's income. My children and I will be staying with my parents, so my dad will be 'in my household' I guess? As long as my dad makes at least 125% of the poverty level for our family of 4, plus both my parents?

Is that right, and how is it different or easier? Is my dad not held responsible for my husband then?

  9. On the website it says they are currently processing I-130 petitions from about 5 weeks ago. I just sent mine a week ago, does this mean they won't even open it and send me an acknowledgement (Is that the NOA-1?) for a month, or do they open it, acknowledge and then process it? They haven't charged our credit card yet.

    Here's the website: http://london.usembassy.gov/dhs/uscis/i130filing.html

  10. My kids and I are all US citizens, we're moving back to the US And although we do 'have money' while my dh is still working, it's only enough to live on and not enough to cover medical emergencies! It would only be till dh came over and one of us got a job and health insurance, which we'd of course want asap! Mainly I'm thinking of it for the kids.

  11. I'm so confused, I get that I fill one out for me (USC and UKC in UK) and one out for my husband (UKC), but who is the applicant on each form? Our addresses are the same so that doesn't matter, but when it asks for applicant's employment, do they want my employment on my form and his employment on his form? We live in the UK, so our employment is here, is that what they want to know?

Then for 'signature of applicant' do I sign my form and he signs his?

And in the heavy border box at the bottom, do we each fill in our own info on our own forms? Or am I petitioning for him so he's the applicant??

  12. It's on the London US Embassy website, so must be for DCF London. I hope it's CYA! Ha ha I'd never heard that before!

    Here's what it says,

    Planning Ahead

U.S. petitioners who are planning on filing for their foreign spouses/children for immigrant visas to relocate to the United States should file the Petition for Alien Relative (Form I-130) a minimum of ten (10) months prior to the date of the plan relocation.
