  1. So, to understand you two live in Germany. Then the best process for you is DCF, you file the petition to USCIS Frankfurt and all the process will take approximative 5-6 months. In the moment you have your immigrant visa in your passport, you have 6 months to move to the States. You are not planning to move in one year do not start the process.

    Thank you for your help - that is the way I understood it as well. I just wanted to clarify and get things rolling ASAP since I know this is a hassle and a half.

  2. I am an American married to a German (living in Germany) and we were starting to file the visa paperwork.

    We are not planning to move back to the states for a couple of years but wanted to have things done for when they were needed. Upon reviewing the papers it was slightly vague as to how long we had to move to the states.

    My question is - is there are time limit in the amount of time we have after we file?

  3. My husband (German) and I (American) are going to be filing shortly. We intend to stay in Germany for a while, however we are trying to get things taken care of on both sides of the ocean, as I am sure everyone here is.

    When looking through the paperwork we noticed there were things about domicile... we live in Germany (Munich), however I assume my parents house that I grew up at in Ohio is sufficent.

    Does anyone have an idea what I am supposed to put for that?

    Also, when making the payment what are the options? I am going back to the states in a couple weeks, and while I understand Frankfurt does not take personal cheques my other options are what? Credit card or international money order (is that in USD then I assume)?

  4. Further, the law was signed and went into effect on 7/27/06. It's the USCIS that has been sitting on it lo these many months, "interpreting" and then swinging into action in a heartbeat.

    Ok, now I have a quick question- does this law make my visa invalid?

    We filed my petition in Frankfurt on Sept. 1st and I had my visa in hand on the first of November.

    I activated the visa just before Christmas and am now back in Germany for a little while before returning to the US for good.

    ETA: I think Frankfurt has a USCIS field office and they still accept petitions filed directly in Frankfurt (at least according to a post here)

    Can you direct me to the information that states I am able to file with Frankfurt? We are living in Munich and want to get our US visa filing underway while we are still living here. It is much easier to deal with it now while we have the time as opposed to needing it immediately.

  5. Although I would be filing for the K3 and not the K1 I assume that the payment procedures would be similar if not the same.

    My husband and I were trying to figure out if we would pay using a US Cheque or how that works. I did not see the website that you mentioned about paying for things. (we are also in Germany, although we are in Munich).

    Any help on this matter is greatly appreciated!

  6. My husband and I are also in this mess... one question that you have not brought up that I am curious about is how you make your payment for your visa. Do you bring US cheques and use those or do they take some other currency (namely Euros or in your case pounds?).

    We are planning on staying here in Germany for some time, however we want to get the visa stuff out of the way so when the chance arrises (say through his job) we would have the option to go back with out additional hassles of paperwork and extra things.

    Please keep us updated on your progress - it is really helpful! I will do the same as soon as I have any extra info!

  7. I am wondering how many copies I should have 'apostilled' of my marriage license and birth certificate. I know that it is going to better to have more than less but if someone has already been there and done this do you have any advice?

    I don't know if most places will accept a notarized marriage license and birth certificate or if they are wanting the apostille as well. I have 2 weeks before I move to Munich and I wanted to get this rolling!

  8. My fiance has a round trip ticket and WILL be returning to Germany - I will be following him and 'moving' approximately 2 weeks to a month later. He is not coming to the US on business, however he will be on business in Frankfurt after our wedding (which is why I am planning on moving AFTER he gets back)...

    This is a tricky situation because I definitely want to be honest and we are not doing any illegal but I also do not want it all to be a huge hassle - especially since we have everything planned for our wedding.

    Any additional advice on what to say at POE?

  9. I am leaving a couple of weeks later - He will be on business so I am planning on going once I'm able to move my things into our apartment. I will book my flight and give him that information as well.

    I just thought of another thing... I'm was planning on booking a round trip since they are less expensive and then not taking the returning leg - I don't know how this would play into things.

  10. I am wondering if anyone has gotten married using the Visa Waiver Program (your fiance comes to the US with appropriate documentation stating they will be returning home), you get married, and move to their homeland.

    My fiance and I are doing this and I just wondered if anyone encountered any issues in doing so or if there are other documents besides a letter from his employer and lease agreements that he should be bringing along.

    Any help is GREATLY appreciated!
