This only means that you can't move to a new state, file, and enter their N-400 queue until you've lived in that state for three months to establish residency, not that you need to be physically in the US for three months before you file, I think to prevent people from filing from states with faster processing times when they're not true residents.

As long as you've resided in the same state that you are filing in for at least three months, you'll be fine. I agree that you should wait until you do the biometrics to take the trip just to avoid missing the notice and delaying the process.

Gotcha, that makes sense. I can't avoid this short trip and i wont miss the biometrics because 2 -3 days after i apply online i will be on my way back to us where i live. thank you

You've not resided at your current address for at least 3 months?

I have. I live in the US. In the past 7 years i've been out of the country for 6 months in total in at least 10 trips.

My confusion was does USCIS is asking before applying for n-400 to be present in the US for the last 3 months, but it's all clear now.

I should have used the right terminology - Physical Presence Requirements.

Physical presence requirements requires that you should have been pysically present in the US for at least 913 days (30 months) within the 5 year period before applying.

"In addition, applicants are required to show they have resided for at least three months immediately preceding the filing of Form N-400 in the USCIS district or state where the applicant claims to have residency" this was my concern, so applicants should be in the US for 3 months before they start n-400, means i can't go in europe for 2 weeks.

  5. For the person who is in charge for the spreadsheet. Can you make column named "Date i-751 mailed" to be in chronological order please? It's easier to see till which date USCIS is working at the moment. Also can all the column be smaller? It's easier to have all information on one page instead of scrolling across. Please and thank you!

    p.s. It's my OCD, can't help it :)

The first form for one year extension there is a receipt number that from the first their site didn't recognize it, even on that paper says: " the above receipt number must accompany all inquiries."

on the paper they sent for my bio appt: there is two receipt number, which one of them is as same as the number on extension paper( I already said it doesn't work) and there is other number that when I enter on their website says :

On May 17, 2016, we received your Form CRI-89, Petition to Remove Conditions of Permanent Resident Status Received, Receipt Number EAC**********, and sent you the receipt notice that describes how we will process your case. Please follow the instructions in the notice. If you do not receive your receipt notice by June 16, 2016, please call Customer Service at 1-800-375-5283. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

Even when I contacted them and I told my receipt number doesn't work and they sent a letter to me they used the same receipt number and it was written our record shows you applied on May but we are still working for the case from 2015 and.....

I just want to does anyone has the same problem as me?

It makes me very nervous not knowing what's going with my case and each time I call, I get the same answer and they wonder why my case doesn't come up.

The number that says On May 17.... is the number for tracking your case. On mine says the same. They usually don't update cases online. Plus we, May Vermont fillers have still at least 3 weeks to a month more to wait until we get some movement so no worries. Check your mail daily because most likely we all gonna start getting some letters soon (Approvals and RFE's).

    I have a question...

I called today, looking for to speak with a supervisor (and like always they're BUSY), I submit a call back and they're suppose to call back between 3 and 5 days, but I ask the lady with whom I spoke to, about the naturalization process and when can I apply she says "you can start you're naturalization process when you had completed 2 years with your Conditional Card, and one year with your permanent 10 yrs Card" a total of three years...... So it means that once I get approved with my 10 yrs GC, do I have to wait another year to complete the three years...?? or do we get approved retroactive meaning that the date on the 10 yrs card where it says "resident Since" will be since the day after our 2yr expired???

Can someone help me with this??

You can start naturalization process prior 90 days before 3 years anniversary since you become resident. So if you become resident for example August 2014 you can apply for naturalization May 2017. Because even you haven't gotten your 10 years green card, you have 1 year extension letter, so technically you are going to be resident for 3 years and that's what matters (of course if you're still married to your spouse). If not, you gotta wait 2 more years. Hope this answer your question.

  8. From which visa? So you tell us you don't make copies of what you sent? Because they basically ask for what you sent in, nothing new much. They mostly ask for hard-copy because they don't have time to cross check every detail you submitted (like how much your sponsor makes...)

This is not about visa, it's about Adjustment of status (AOS).

You should have made a copy of the file you sent to the USCIS. If not I suggest asking the joint sponsor for a copy of his w2 and the last few months leave and earnings statements. He works for a different branch of the government. It's up to you to bring what's needed, not them to look him up.

I already have a copy of his w-2 form, i'm asking should i bring to the interview original documents or it's fine with copies. And he already send me his paystub (leave and earning statement).

  9. I got letter to show on interview for i-485 with my wife.

There is a list with all documents that i should bring with me.

I have a question, my cosponsor live far away from me in different state and he is busy working, so i don't want to bother him to ask to send me some documents that USCIS ask. Should i ask him for him original documents like: employment letter, w-2 and birth certificate, because i already submit copies from w-2 and birth certificate. And he is forking for US Army, that's Goverment institution, so USCIS easy can check how much he is making and that he is US citizen.

And also if you have some tips for me for this interview?

    Thanks a lot

  10. Hi. I finally got my interview notice. Will be in august. I'm not concern a lot, but still i know some people that get denied even they have real marriages.

Do you have any advice to give me to kinda prepare myself and my wife?

I'm only concerned about one stuff. I worked illegal for three months before i got my work authorization card, and they asked me to bring my pay stubs for the last two months. they will see that i worked before and i don't wanna lie them. i wanna tell the truth but did i will be in some danger or maybe denial because of that or they will forgive me?

    thanks

  11. Wayne,

You appear to being chasing adjustment of Status, judging by the forms you filed, but you are 1) calling it a visa, and 2) posting in the spousal visa forum.

If you find the Adjustment of Status from work, student, and tourist visa forum, you will find a bunch of people doing the same thing as you, plus a lot of information on the process.

You have EAD/AP approved, so that is good. Now you wait for an interview letter, and at the interview, they will decide on the I-130 and I-485.

    Good luck.

I'm calling it a visa because is a visa.

    thanks anyway on your information

  12. I answer on RFE two weeks ago and then my case online was "Request for evidence respond review". Two days after i changed my address online because me and my wife moved in another house. And now again is showing "Initial review" and message that i changed my address.

What's gonna now, why my case is going back instead of forward?

Is maybe some delays or something wrong, or it's because i changed my address?

Should i be worried or not?
