  1. Hello Guys,

    I have a somewhat complicated question. What is the process of someone that has subbmited her US citizenship application and she recieved already the letter saying that USCIS recieved her applicatioin and the check has already been cashed. Now what happens if this person that is trying to get her US citizeship through her spouse (three years instead of five)however they are going through a dissolution of marriage. She filed the application for citizenship when they separating. Now my question is, does this effect at all her recieving her US ctizeship, or she will now have to wait the standard 5 years to get her citizenship.

  2. Hi Everyone,

    My grandmother is a green card holder and my grandpa is a US citizen. My grandmother has been living in Albania for the past 5 years and has not been back to USA in five years. Her green card expires in March 2012. If she wants to re-enter USA now will they give her a problem because she has not been back in five years. Does she have to go the the American embassy in Albania to re-apply? I tried to call the Albania embassy today but they left me on hold for hours and was unable to get someone on the line.

  3. CR-1 visa holders ARE immigrants, they get a GREEN-card that is valid for 2 years, UNLESS they are married longer than 2 years BEFORE entering the USA on the visa, if they are married longer than 2 years before green-card is issued, then the card will be a permanent 10 year card.

    Immigrants DO NOT file I-485, I-485 is only used for persons adjusting status from NON-IMMIGRANT to Immigrant in the USA, that is typically a person entering the USA on a K-Visa or some other visitor's of NON immigrant visa.

    You are talking about removing conditions on the CR-Green-card, this involves filing an I-751 within 90 days before the card expiration NOT 6 months.

  4. Hello Everyone,

    I have a few questions and hope you can clarify them for me.

    My husband entered USA on March 29, 2007 on a CR-1 Spouse Visa. He received his green card a month later. I heard somewhere that you have to apply 6 months before the expiration date on his green card, which it will be on March 29, 2009. Is this true? When am I supposed to file for the Permanent Residence green card?

    • Is form I-485 the correct form to file for a permanent resident?

    • Do I send form I-485 together with Biometric G-325A form and Affidavit of Support?

    If anyone has gone through this process or can help me, I would appreciate it a lot. :blush:

    I looked into this and I got very different informations. My husband is a legal resident (green card holder) and he wants to travel to Germany for about 10 days to visit his sister. Do you need a travel visa for Germany if you are a legal resident in the United States. I looked into the website of German Counsular service and it seems that you need a visa and they require a lot of things to get this visa. Health insurance, employment letter and to have a certain amount of money in the bank. However, I am hearing from different people who have traveled overseas with a green card and they keep telling me, my husband does not need a visa if he is a legal resident. I am planning to call the German Embassy here but I wanted to hear from you as well.

    I would appreciate it a lot if you know anything more.

  6. Hello Everyone,

    I have a question, and I apologize if I am not clear about it, this is the only information my sister has given me. My sister's fiance came to the United States on K1 on April 4, 2007. On May, she got married, however she just noticed that on I-94 it shows May 3, 2007 and his passport shows September as the exp. date.

    What does the "May 3,2007" on I-94 mean? When my sister went to get the employment letter for him they told her she cannot have it because of the exp. date on I-94. She is filling the AOS for him currently but is worried about I-94 saying May 3, 2007 as the return date.

    I would appreciate any advice or information you can give me.

    How are you doing?It is the opposite with me. Last week I called them and they just practically hung up the phone on me telling me they are not allowed to give information over the phone anymore. I wrote to them last week all week and they have not replied to me. I have to resend the emails today as well.

    I don't know what's going on with all this late breaking news, but I do have to say: The US embassy in Albania has been wonderful about returning emails and helping me when I call (although it is very hard to get thru by phone). I hope everybody else out there has the same results with communicating with the embassies.

    Filing the I-130 petitions

    Due to recent changes to U.S. Immigration Law the U.S. Embassy in Tirana will be unable to accept any I-130 petitions. Effective January 22, 2007, all I-130 petitions must be filed in the United States.

    It doesn't not say anything about transfering or canceling the approved ones. Am I right? Amy and I both are on the last step waiting for Packet 4 which is the medical and the interview date.

    This was very irresponsible handeling. Tomorrow, embassy's around the world will again suprise the people who are coming in for their VISA interviews, as well as people who thought they had an appointment to file a I-130 petition. Please understand if the US Embassy has a Consulate, it does not effect you, such as Rome, Moscow, and London. They all have local USCIS and can process the DCF's and I-130 petitions.

    I called my senator, the State Department,USCIS, and even went to Chicago with an appointment to talk to the Immigration Officer. NONE of them new of this and were all surprised and had to goto their supervisors who also did not know of anything. Word finally got out of what was going on late in the afternoon and now websites are now posting.

    Advice, first check to see if your embassy is a USCIS office, if not, start filing inthe US quickly!!!!! Call your embassy!!! CALL YOUR REP!!! Its a good law, just implemented incorrectly.

    Okay... just so I can get some rest without crying anymore (I spent my lunch hour on the phone with my husband trying to sort out how we are going to manage the DCF process and about tore my hair out!)

    This pertains to EMBASSYs only?? Will CONSULATES (such as Sydney Australia) continue to accept the I-130 petitions?

    My head is awash with too many thoughts.

    And I was going to begin getting my papers and proof of relationship for 2 years started tonight...

    How do I know if where I DCF'd is a conulate or embassy? Did u get any answers to your question?

  9. Hello Everyone,

    I have a friend from Hungary; he is an international student, actually just graduated. He wants to marry his girlfriend however does not know how to go through with the process or what he is allowed to do while living currently in USA, and neither do I.

    My questions are:

    Can he get married here in the USA? I am asking this due to the fact that he is an international student who actually finished school. He is looking for a job right now.

    If can get married, can he apply for the I-130 here in the USA without being sent back to Hungary.

    Please advice me in anything you can. He is my best friend and I myself am going through a lot with immigration from Albania and I don't want another couple that I care about to go through the same thing. :help:

  10. CONGRATS CREEL :) I AM VERY HAPPY FOR YOU. I know what you must have gone through at the interview because I felt the same thing when we were interviewed for our I-130. I can't wait until my husband recieves packet 4, I am so worried that they might find something wrong or everything will not be all right. By the way since your fiance went to the interview you did get the police records from Greece right?

  11. My husband went to the germany embassy in Albania and called them as well. The police in germany said that we already gave you those two papers regarding you being illegaly from court and that's all we have of your because you have not been a resident here. :unsure: do not know now what is going to happen now if they will accept them or not.

    Oh I hope you get those police records from Greece very soon so you will not have to resechdule your interview.

    My fiance was illegally in Italy and showed up where they issued the police reports. They said said you are here illegally and he said if you give me the police report I am heading back to Albania to apply for a US visa. They printed the police report and gave it to him!! They didn't do anything about him being illegal. I know Italy and Germany are two different balls of wax, but I would try and use the info given above on how to get a police report and at least try.

    Yes, we have his interview November 30th in Albania. I head out the day after Thanksgiving. Believe it or not our issue is now the Greek police report. The Greek embassy in Albania will only send it directly to the American embassy and it is still not there yet. If it doesn't arrive in time they will reschedule our interview. Very nerve racking.

  12. meauxna i have searched and read every post and you are right most of them do say that police records are needed, and of course it is required from all countries but my husband keeps insisting that he cannot obtain one :angry: and is driving me crazy..

    My opinion is that he only needs a police report from where he is living. This may or may not mention the other stuff. I would get the police report and see what it says and go from there.

    You need a Police report from all countries you have resided in for over 12 months since the age of 16 (or over six months if it is your country of citizenship or the country you are currently living in.) So he will need a police report from Germany.

    I'm afraid I do not know about how to obtain a Police Report from Germany when you are not resident here, but I can confirm it is possible to get a German Police Report when you are not officially resident here (although I am not 'illegal', I am not a resident of Germany and was able to get the Police Report very easily by applying at my local Rathaus.)

My husband was iligally in Germany and was given a court letter which states that he was iligally in germany and was not allowed back without a visa and that's all. I do not know Creel how can he ask for them. By the way did you recieve the inteview date yet?

    Paujoric I am thinking the same thing, that police records are needed only from residents, I do not know how he can get police records if he was iligally there. I hope to God the court letter will be enough for them.

And as I mention he was iligally in Germany....he was sent back to albania since being without papers and was given a court letter stating he was iligal in germany and that's all. My husband keeps saying to me that he cannot get a police report from germany since he was iligal there and doesn't know how to get a police report now from Germany. I hope they will just accept the court letter.

    I am going to have to fill out packet three pretty soon, and I had a question regarding police records.

    My husband was residing iligally in Germany for about 2 years and when we applied for the I-130 the lady in the embassy said that my husband was going to be asked for police records later on. Now we are going to have to fill out the packet three. The only record that my husband has from germany is a letter from court stating that he is ok however is not allowed to step in certain countries... like italy, germany vienna and so on without a visa and that he was judged for this by the court and returned to albania .

    My question is: is this court letter enough? if not what else can my husband do ?

  17. Hello Everyone,

    I would appreciate it a lot if someone can help me with some of the questions I have regarding the I-134 form, Affidavit of Suppport. My husband is currently residing in Tirana Albania, once the I-130 form is approved I have to fill out and Affidavit of Support. I petition for my husband in Albania, so my questions is once I fill out the Affidavit of Support I sent it to the embassy in Albania or somehow it has to be approved here in the US first. I downloaded a form and it says I have to give an Oath of Affirmation of Sponsor before and officer. Once that is done all I have to do is mailed to Albania Embassy? My parents are sponsoring my husband do I need to fill out a form as well or just the sponsors?

    I appologize if sounds very ingnorant :blush:
