  1. Lawyers say that if you adjust within the first 30 days in the country, it is assumed that the person had preconceived intent to make the change before they even arrived in the U.S. It's out of a section of the USCIS field manual.

    Personally, I see no need in your case to hire a lawyer as long as you feel comfortable filling out forms and collecting the papers that you will need. There's a easy guide here to follow to complete your AOS if that is the route you choose to follow.

    I don't think you will have a problem with intent either. Intent is typically decided by the CBP when they let you in. They may ask you during your interview why you decided to file the way you did and if that happens, simply tell them the truth.

    If you do file soon, DO NOT LEAVE the country until you have your EAD/COMBO Card(I-765) in hand. If you leave the country without that while your I-485 is processing, your whole application will be considered abandoned.

    I came in USA with a waiver visa to visit my boyfriend. We got married and now we are filing the different forms for the AOS.

    The fact that I came with a waiver visa I didnt get the I-94 form that they are talking about in the AOS papers. Is it a problem?

    Do I have to send all the papers before the end of my waiver visa?

    How long does it take to get the green card?

    I-94's are electronic now. You don't get a paper when you fly in like you used to. I don't have the link right now but you can get your record from the DHS website.

  3. Hi, we r filling AOS now after we got married and i already have my ssn card, and a letter back from Selective Service System ( military ) saying that i don t need to register the SSS because i came to the USA when i was older than 26 years old.

    We have stucked on the i 864 form the affidavit of support, and we apreachiate any help.

    My wife has no job history at all and even now unemployed, and we are putting 0 income on the pettitioner i 864 form and we gonna put no job history , i do not know if that s gonna be a problem but at the embassy stage it wasn t a problem i have a joint sponsor.

    We are living with her mom now, and the house she renting is on mother s in law name and my wife s name, her mom wasn t making enough to be my co sponsor.

    We are living with her mom just for the fact that we can t afford another place on our own since i can t work without EAD and noone is hiring my wife to this point and my mom in law is helping us out until we start working and go in our own.

    I have a joint sponsor who qualifies over the poverty lines guide, and he s married.

    Now i have a couple of questions to make and please help me out with some answers.

    1. Do we need to put even my wife s mom on the question about the household size? If we put her down as an household member , does she need to fill out a form i 864a? (She s not my joint sponsor)

    Your wife will only have to list you and herself as her household. She needs to include a letter stating that she has not worked and therefore does not meet the requirements necessary to file income taxes for the years mentioned. There is no need to bring your mother-in-law into it at all.

    2. My joint sponsor is married and has even 3 kids but he makes a lot of money and that s not a problem, he qualified to be my sponsor since embassy stage.

    He needs to fill out the i 864 form ,does his wife need to fill out a form i 864a or she doesn t need to fill out a form?

    And how many years of tax returns and w2s does the joint sponsor need to send ?

    Does he need to send even pay stubs or bank statements ?

    And they are already us citizens.I know i need a copy of their usa passport.

    Does your sponsor make enough alone without his wife's income? If he does, He can fill out the I-864 include his tax returns and W2 showing his income alone and that would be fine. It'd be just as easy to have him fill out the I-864 and the wife the I-864a and just include a tax transcript (which can be obtained free online). If you send the tax transcript and they both fill out the 1-864s there is no need to send W2's.

    I sent in 6 months worth of paystubs. The more the better. If the sponsor makes enough money, there's no need to send in their bank statements.

    Please guys give us some help because we are so stressed out.

  4. Exactly! We're not worried about what it says on the card. We just want to get the SSN ASAP. His job just hired him without the social security number since the form he received from the SS office said that it's perfectly legal to work until you receive your actual card. We just need to turn the number into them the day we receive the card.

    We'll deal with updating the SS card when he gets his GC but he's losing his mind not working or driving!

  5. EAD card received yesterday. Now to apply for SSN

    My husband received his EAD in the mail yesterday as well and even though he's been approved for the GC, we figured that we'd run down to the SS office to apply for one since he's waiting to accept a job and any extra time having it will help! The people at the office were pleasant but they were unable to verify him in the system. They said that it was right on the cusp of the ten days that it normally takes DHS to update their system. They said that they would hold on to the application and try to process it every day until he shows up in the system. You're on the same timeline as us for the EAD..same approval date, same day receiving it. I hope yours is already in the system by the time you get there!

  6. Congrats, that was really fast!! I remember we started this process almost the same time and I don't even have an interview date yet lol

    I can't believe how quickly it all went by! I guess Boston is processing really fast at the moment. I hope that everything speeds up for you and at the very least that you get your EAD card like..tomorrow!!! :P

  8. So we were scheduled to have our interview today at the JFK building in Boston at 2pm. We arrived to the building at 1:40 and went through security checks. We checked into the waiting area at 1:45 and were directed to sit there until someone called us. At 2:15, an IO came out and asked that I (US Citizen) come with him and that my husband wait in the waiting room. We went to his office and he was very friendly. He asked me to remain standing and raise my right hand to swear that I was telling the truth. After that he asked me to sit down and he told me that if I had any new documents or evidence that I would like to show him then I could pull it out now.

    He pulled out my I-130 and quizzed me on the information on it, putting a red checkmark next to every question I answered correctly.

    What is your full name? Previous alias? DOB? SS#, Current husbands name, his DOB, Any kids? Address?

    After he was done with the I-130 part of it, he asked me questions about our relationship while he was jotting down the answers. This was a very laid back questioning and just felt like a normal conversation.

    How did you two meet?

    Who went to meet who?

    Who proposed? When? Where?

    He asked about my 2 children from my previous marriage...what grades are they in? What sports do they play? How old are they? How do they get to school?

    What is our new address?

    Who lives with us?

    Where does the income come from?

    After we were finished talking, he asked me to move over one seat and that he was going to get my husband. He explained to me that he was going to ask my husband the same questions that he asked me and I was to sit there quietly.

    He had my husband take an oath, then asked him to sit down next to me. He asked him all of the same questions. All of our answers matched perfectly.

    Next came all of the NO questions (pologamy, gun training, prostitution) on the 1-485. After answering no to all of the questions, he said that he was going to approve our case!

    We ended up walking out of the building about 2:45 and ten minutes later we received text and email notification that our Card was in production! :dancing: :joy:

  9. I keep forgetting to update this because I haven't been receiving my text/email updates from USCIS :/

    Anyway, we received the EAD card about a week or so ago =D.

    Our interview is on September 4th as well, @kcros. We're going to start gathering up all the paperwork and evidence to bring to the interview. I'm not what they'll specifically ask for. I'll let you guys know how it goes afterwards

    I've been working on gathering up all that we need to bring in with us. It's all in random little piles so I need to figure out how I want to organize it to bring it in. I wish the hubby would take a little more interest in the paperwork aspect since you know...it is for his benefit:p

    I'm guessing that the EAD will show up in the mail about a week after our appointment lol!

  10. I filed my AoS package on June 26th, I've had biometrics (on July 25th or something), and online it says that I'm at "Testing & Interview". However, I spoke to my lawyer a few days ago, and he said it'll probably be December before I have an interview. Everyone on here seems to be going through much quicker than that. I'm going through the Detroit field office, which doesn't say it's any slower than the national average. Does that seem like a reasonable time frame?

    Typically the whole process takes roughly 5-6 months. It seems to be going a lot quicker lately. It really all depends on how backed up your local office is and when they scheduling appointments now. I wouldn't be surprised if you got your interview date in the mail soon, unless your lawyer knows someone there that is telling him/her that Detriot is backed up and that's what they're going by telling you Dec. I filed on the 13th and recieved my interview date about 2 weeks ago so it's possible you could be hearing back from them in the next week.

  11. Hi guys, On the 26th I received the notification that the I-765 was in Card Production, then again on the 28th I received the same notification. When do you think they ordered the card production? Is this normal? How long does it take to have the card shipped to my address after card goes into production?

    I was just logging in to say the same thing! I received my first Notification yesterday saying it went into production on the 28th. I just received another update today saying that it went into production today on the 29th. I'm not sure what's going on I just hope it hurries up and gets here lol!
