  1. I filed as Single on my 2013 Tax Return ( i got married in October of 2013). After speaking with the IRS, Immigration Lawyer & a CPA i filed as single.

    You do have to file for an amendment to your tax return once your spouse arrives in the country and is granted a SSN.

    So once my wife arrives in a day or so and the SSN gets issued i will file and amendment to my taxes for 2013 and file my 2014 as married.

    Immigration did not hassle me one bit or my spouse as to why "I" filed as single. You cannot file as married in this country unless your spouse has a ITIN number or SSN.

  2. You will need to pay the green card fee ($165?)

    As it is a cr1 conditional visa you will need to file for removal of the conditional status in 21 months time -

    the time frame for that is 21 months from the date of entry and you have 3 months in which to file.

    She should apply for a SSN if she has not already done so.

    Do i need to pay the green card fee after she receives her passport/visa in mail as it requires a number that starts with "A".

    Also, does applying for SSN depend on her visa/passport arrival?

  3. Wife had visa interview this morning. Lasted 10 mins. Pretty easy.

    I had a question regarding the next steps:

    1. Does my wife need to complete any additional items before taking the flight over to the US? Besides just waiting for her visa/passport arrival using the courier service.

    2. As we will be married less than 2 years does she only get a conditional visa and then i will have file for her permanent residency? if so when do i file for her?

    3. Does her social security number arrive in the mail after she arrives here or do i have to file for it?

    4. Do i have to pay some fee on the USCIS website? i read somewhere that before permenant visa is given i have to pay a fee on the USCIS website.

    Please advise.

  4. Thanks for the response. I am the petitioner and i am the one sending in the I-864 documents and it has be sent directly to NVC from me before it even gets to the embassy.

    NVC really needs to get inline with the 21st century and take better use of the technology that is available if they cant get the budget to hire new folks. Having US citizens wait for their spouse for year to two years is just insane to me. I really feel for the folks who have been waiting for 2-3 years.

  5. I received a checklist for my I-864 form yesterday because item 7 in part 3 did not match the number entered in Part 5 item1.

    Is this minor error going to cause additional delay of another 60 days?

    Does anyone know if it is a minor error as stated above does NVCgo through my file again quickly or will i go back to the bottom of the totem pole?

    Please advise.

  6. Yes it is normal, it happened to me and others on here.

    Try again later or tomorrow for the DS-261 the AOS fee may take a day or two to be unlocked it took about 2 days for me.

    Thanks. So DS-261 Form did open up and i submitted it on behalf of my wife however I clicked "No" for "Did anyone assist you in filling out this form?" and hit submit which it seems like i shouldnt have done.

    So I ended up redoing the form again today (because when i signed in again to check DS261 it said incomplete) clicking submit. Hope that should be alright.

  7. I received Two Emails from NVC Yesterday. First was telling me that AOS is ready to be paid and the second telling me to fill out the DS-261 Form. However when i go to the given website and use my given case number / IIN i get the below error even after waiting for a day.

    "Please be advised that the case that you have attempted to access is not eligible for further processing by the National Visa Center at this time. Please contact the National Visa Center if you believe that you have received this message in error."

    And for paying the AOS fee i can sign in however it still says "Not Invoiced"

    Any suggestion as to what is going on?

    I called NVC today and the person on the phone informed me that she will reach out to someone to look into it however i was just wondering if this is a normal process.

    Please advise.
