  1. You don't submit the original marriage certificate for ROM. You take your original marriage certificate down to the county recorder, once they record it you can get certified copies. Here in Tucson they did the recording and issued us certified copies while we were there. You need to submit certified copies of your marriage certificate for ROM

    Ohh. Now it's getting clearer. We thought they only want photocopies of the original Marriage License. We didn't know we needed the CTC for that. Do you think that was the thing missing? Because the guy just said Vital Statistics

    And Notary of something. And I never read any of the Vital Statistics that he was talkig about anywhere here or o the requirements.

  2. We didn't get married at the court house, and we were not asked for any vital statistics documents. Did you have certified copies of your marriage certificate or just copies?

    We brought what was on the list and had no issues.

  3. Yes you can do everything in a day. We did ROM and my wife renewed her passport the same day during an outreach even up in Phoenix.

    I don't know whether there is a photo service at the consulate, but you can get passport photos done at most Walgreens or even the Post Office.

    Philippine consulate does not care about your "status" here in the USA, that isn't their requirement.

    Don't know if they will ask for a affidavit for delayed registration, we didn't do ROM until 8 months after we were married and was not asked.

    I just went to the LA Consulate today and I didn't accomplish anything.

    I got all the forms signed, photocopies of everything, and still they didn't accept it.

    I had a problem with ROM. They ask me for the Marriage License and I had that. But then again he asked me for a "Vital Statistics" from the court we got married at.

    It was not on the requirement list and I told him that.

    So now I have no choice but to wait for the Consular Outreach in Phoenix.

    I just wanna ask, did you experience these when you and your wife did yours?

  5. Hi. I know there are topics about this but I just wanted some clarification.

    My husband and I got married in AZ. My passport is already expired and we are here in California right now to renew my passport in a few days, also do a ROM.

    My questions are:

    1. Can we finish everything for a day?

    2. Do they have photo shop there to have our photos taken ( to make sure we do all the requirements ) or they don't and we need to do it somewhere?

    3. If we have to do it somewhere, where is the best place to get it that will follow all the requirements like sizes etc.?

    4. Do they ask for another valid state ID for both of these? ( I haven't filed my AOS yet and I'm out of status now so I don't have anything. )

    5. Will there be a problem doing both since I'm out of status?

    6. Also, we got married in 2013. Will they ask for a Affidavit of Delayed Registration ( in LA consulate ) ?

    All answers will be much appreciated. Thank you.

    You can do the ROM & ROB by mail if you want, but you need to be there in person to apply for a passport. My parents did my ROB for me 2 years ago. I was able to apply for my passport the same day, however be prepared for a long wait at the consulate. I think we were there for about half a day for my ROB and passport application. They can mail you the passport after a couple months.

    It looks like you just missed the deadline for the consular outreach in Phoenix, AZ. PCG LA usually has consular outreaches in different states throughout the year so that might be another option if you don't want to go to Los Angeles.

    Is the ROB necessary too to apply for US passport for him? Or is it only needed for PH passport? Either way, is it a must for both countries? Thank you.

    Yes, I just missed the consular outreach in PHX, AZ. But we are planning to go to LA next week so we figured to just do it personally. Do you think we can do it all on the same day? ROM, ROB, and passport renewal? Is it possible I can finished the ROM first so I can do the passport renewal on my married name too?

  7. Hi. I just posted a question yesterday about Report of Marriage and somehow I'm still confused.

    We got married in AZ, which makes LA our place for the Consulate.

    We've been married 2 years in Sept and we haven't reported our marriage.

    We are planning to do ROM next week and passport renewal with married name.

    If I am correct we are gonna submit ROM in LA Consulate General, right?

    And also, we have a 3 month old son. I am from Philippines and my husband is a USC. Our son was born here too ( AZ ) - Do we need to do a ROB? If so, do we need to submit it too to LA Consulate General or in the Philippines?

    Also, we were wondering how to do our son's passport.

    Any help and answers will be appreciated.

  8. 1. Once your I-94 expired you are subject to detention and deportation at any time until you receive the NOA-1 for filing AOS. There is no time limit to file for AOS but again, you are out of status and subject to detention and deportation.

    2. A social security card is not valid ID. As to renewing the passport I don't see why there would be a problem with this.

    3. I would think so but will defer to someone more familiar with the Philippine process.

  9. Hi. Its been a while since my last post.

    I just have a few questions, hopefully you guys have some ideas and suggestions and would appreciate if you have answers.

    I arrived here in the US with K1 visa last Sept 2013. Got married before 90 days. Never filed for AOS yet. Now here are my questions.

    1. I know I'm out of status right now, but if I am right there is no date limit in filing AOS. Right?

    2. I was not aware that I cannot get my SSN once my I-94 expires, so now I have no valid ID. My passport is expired as well, I'm planning to renew it in a few days. Am I gonna have problem since I'm out of status?

    3. Since I'm renewing my passport, I want it to be on my married name. I saw all the forms that I need. The Report of Marriage, is that form supposed to be send in the Philippines ( home country ) or the same address when I file for passport renewal? ( Los Angeles )

    I am hoping to hear from you guys. Thank you in advance.

  10. Your name was changed when you married. At that point you have the choice of using your married name or your maiden name. I assume the only ID you have is your passport in your maiden name. That plus your marriage certificate would be legal proof of you having his last name. In most if not all states you can give the child whatever name you wish. It does not have to be your last name, his last name, or anyone's last name, you can make one up.

    Off your main topic. You are pregnant and your spouse has no income. How are you paying the medical bills?

    Yes, I only have my passport as ID. I have an insurance which covers medical check ups. We have savings for other stuffs.

  11. Hello. I've been posting a lot of questions and I have another question now. I really really appreciate those people who finds time to answer and giving suggestions.

    I arrived in the US Sept. 2013, got married within 90 days. Never filed for AOS as my husband became disabled. Most people say we can't file for AOS if my husband is unemployed. We are still waiting for determination of our application for Social Security Disability which can be consider as an income. Right now obviously I am out of status. We wanted to file for AOS but we can't as Affidavit of Support is required. So as of now, I am wondering if there is any way I can change my name into my married name aside from filing for AOS? I am pregnant, if I don't have my name change by the time the baby is born, will he/she be able to use my new last name ( husband's last name ) even if I haven't change mine?

    We are really sad we can't file for AOS yet, though we have the money for filing.

  12. Hi Bare. Just to add with what Belinda and Girl from Celebes advised, here's the poverty guideline for your reference: http://www.uscis.gov/sites/default/files/files/form/i-864p.pdf

    You have to check the 125% column for the sponsor's household size, for example a gross income of $19,662 is required for a household of 2.

    For the joint or co-sponsors, they only have to be a US citizen or a LPR (GC holder) and he/she doesn't need to be related to you or your husband, meaning friends are fine.

    Also, another thing you also have to consider prior to filing your AOS is that your medical date should NOT be more than one year since you took it. If it is, you would need to take a full medical with a civil surgeon. The cost for this varies from CS to CS.

    I had my medical in St. Lukes June 10, 2013. So obviously it's not valid no more? I gotta have a new tests before I can file for AOS?

  13. I believe SSDI can be counted as income since it is based upon what he paid into the system. SSI cannot because it is based upon his financial need. Anyone who is a US citizen or LPR and who lives in the US can be your joint sponsor.

    You are always at risk of detention when you are out of status. The chances are small but it could happen. Usually the person is take before an immigration judge who orders them to file AOS within a certain amount of time. It is a lot of trouble and stress if this happens.

    We have filed for SSDI but actually the letter we got yesterday said we were declined for the SSI so now it is confusing. I mostly stay in the house since I got no papers so there's definitely no crimes or illegal gonna happen. There's no way they can deport me if I'm out of status is that right?

    • I have no idea about I-864 or affidavit of support. I will let others answer your question.
    • You can do by yourself. My husband and I are going to do by ourselves. Just like my K-1 visa.
    • Yes, the fee is 1070.
    • A green card holder can't have a US passport at same time. A green card holder is a legal permanent resident whereas a US passport holder is a citizen. When you intend to travel to your home country, you need your passport and when you are traveling back to the US then you need your green card to enter the country.

  14. Do you have a sponsor, other than your spouse, who can prove they make at least 125% of the poverty level for their household plus you?

    You are ok to file if you have a joint sponsor who meet the income requirements.

    $1070 is correct.

    You cannot receive a US passport until you become a citizen. You would travel with the green card and your Philippine passport.

    We haven't thought about sponsors, but if we do have a sponsor can it be just a friend of his or a relatives of mine who are in the US too?

    Just in case we wait until we got approved on the Disability before we file for AOS, would it be fine if it's like a year or more after my arrival and he has Disability Insurance? Do we still need a sponsor just in case we got the Disability insurance or that's enough?

    I won't get in trouble if I'm living in the US out of status for a long time as long as I don't do crimes or anything, is that right?

  15. Hello everyone. I have a lot of questions and I'm hoping you can give me some ideas and suggestions. Thanks in advance!

    I arrived Sept 4 in the US with K1 visa. We never filed any AOS within that time, my husband became disabled, filed for Social Security Disability but haven't got any determination yet. Just yesterday we got a letter saying that he was declined and we should file a claim and appeal. We are planning to file for AOS after 9 months of me living here in the US, I-94 expired December. I'm currently out of status right now, and my husband is unemployed, waiting for the Disability benefits. My question is will it be hard for us to be approve for my green card if he has no job and disabled and I'm out of status ( I-94 expired ) and everything or will it be just fine to file AOS with our situation right now and get approve with no problems since we're married already and I'm here living in the US?

    Also, we are planning to do it by ourselves ( no agency or anything ), will it be just fine?

    One more thing, it says on the USCIS website that AOS fee is $1070, is that it?

    I'm wondering too, if I have the green card would I need to have a US passport to travel or I can use my Philippine passport and green card?

You will send all of the required documents to prove and report your marriage to the Philippines government via the consulate in L.A., they will see you have a legal marriage, then you get a document called Report of Marriage mailed back to you with as proof you did in fact report the marriage.

    Then, they make sure your marriage is documented at DFA and the Civil Registrar in Manila. You will be completing 4 separate Report of Marriage forms -- one of those forms gets signed and an official seal, which gets returned to you for your records. Also, your original marriage certificate gets returned to you. Hope that helps now.

Note: Please take note of the mailing or courier tracking number since the Philippine Consulate General cannot assume responsibility for documents which have been mailed through the U.S. Postal Service or courier service.

    -- That is what I am confused about. I only need ROM. So do I still need to send $6? Do they send the ROM copy to ke and then send it to NSO Philippines too?

    That's the requirements isnt it? On the lower portion there is an option Additional Requirements. They are asking for $6 if I want it to be send back to me. All in all I am really confused. They are still gonna send something to me aside from them sending records to the NSO Philippines? A lot confused here. Thanks.
