  1. Hi Everyone,

    Its been awhile since I have been on here because I filed my forms to remove conditions back in November of 2019.  Received a letter shortly after saying they were extending my green card because of a back log in the system.

    Fast forward to end of march I  got a letter in the mail saying they are requesting evidence.

     

    Issues with my application were as follows:

    1.Income tax return only includes first page of form 1040

    2. Address on auto insurance is different than listed on petition

    3. Auto purchase contract is only a partial copy

    4. Form 1095-B is not sufficient evidence to demonstrate joint health insurance.

     

    So my questions are as follows:

    1. when submitting tax returns do we just print out the 1040 and submit all pages?  is there something else I can obtain from the IRS that shows it was filed?

    2. Auto Insurance is self explanatory as I will just update the address and resend that.

    3. We will resubmit the Car Loan Application with all pages

    4. What forms can we submit for Health Insurance?  I am covered under my wife's insurance through work as she works for a city government. 

    5. our mailing address has always been a PO Box, and we in the last 18 months bought a house.  Should I file a AR11 form to change my address and submit everything with the new house address on it for ease of things?

     

    Any help would be great.

  2. Hi everyone,

    Just had our interview today for AOS on my K1. In Santa Clara, CA

    Interview was 15 minutes, asked for acouple documents, original marriage Lic, and had to update some things because I am employeed now and when I applied for AOS I was unemployed.

    They said all was good needed to run some sort of check but said there shouldn't be any issues. Said it would be 24 to 48 hours for an update.

    So I guess we wait and see.... fingers crossed.

  3. Hi everyone,

    Had my AOS interview for my K1 visa this morning. The interview was fairly easy, they asked some questions to my wife of where I was born, date of birth and if she had met my family.

    Wanted a copy of the interview letter, marriage certificate, some bills with our names on them. Nothing to hard.

    After said it was all good and they needed to do some sort of system check and we should get notice on the status of things shortly.

    Anyone that has gone through this, how long did it take for you to get an update after leaving the interview?

  4. Ok so I have the PDF of my I-864 on my computer and all of my other documents that I submitted for my AOS, EAD and Travel DOC. Just not the ones with the signatures.

    The only thing I don't have which was submitted is the Completed Medical Form I-693 - but I do have a Vaccination Document Worksheet US Department of State.

    Hoping the I-693 is something that they have a copy of??? Anyone know?

    The last question I have is the I-94 document is expired and I don't think it ever got updated? And they want a arrival/departure document. Is that something I can get online?

  5. Well I know I submitted the one and you are right it was during the first process with the US cons in Montréal.

    So if I submitted stuff during the EAD, Advanced Parole and AOS will they have it at my interview and I don't need to bring it with me? I can't seem to find my back ups of what was sent it.... I need look alittle harder tonight for that stuff.

    I am going through all my documents what I have collected over this process.

    On the checklist that came on my I-797c form on what is needed for the interview.

    1. Bring my wife - that's the easy one.

    2. There is a lot of items that say unless already submitted - examples: medical examination I-693 which was already submitted and I don't think I have a copy of it.

    EAD and Advanced Parole (Form I-512) I just have my EAD card is a copy of thatgood enough?

    We had submitted an Affidavit of support form I-134 but this checklist is asking for a I-864? Is that different?

    If things have already been submitted what on this check list would have been submitted already and I don't need to bring with me?

    Any help is greatly appreciated as I am stressing I won't have everything I need for this Interview other than my Wife hahaha

  7. I believe you will receive a letter from them telling you the things they need.

    But what's needed is evidence that you both are married and live together as man and wife. Lease or deed, utility bills, financial commitments, insurance policies, kid(s) registration of birth if any etc.

    Thanks the letter came yesterday in the mail. It basically looks like it's a repeat of the orginal packet that I had to take to my other interview to have the K1 approved.

    It's looking for medical info, police reports, evidence of marriage, passport and birth certificate, Plus government issued ID's from California. Financials for us also. Oh and my wife is being asked to come which she is happy to be there. I wasn't sure it was necessary but with it in writing on the items to bring we will make the trip together.

    There was also a supplement page outlining police check, criminal records and anything to do with a criminal record.

    All I have is my Police background check from Canada which was clean and it was good enough when I went for the K1 interview.

  8. Hi, my online status for AOS form I-485 has said "As of July 27, 2016, we are ready to schedule your Form I-485," since that date for the Dallas, TX office. I just wanted to get get some feedback from anyone else who has been assigned to this office as to how long it took for them to actually get their interview scheduled. Thanks.

    So I am not in Texas, but located in California. My status date shows April 21, 2016 and I am still waiting. I was told over the phone that they are only processing currently for my County for Appilcations received in Nov 2015. Which means they are are about 12 months from date of submission. Which is rather sad.

  9. Hi Everyone,

    So I am trying to understand the process alittle better as I am starting to get worried.

    I am located in California - San Jose Area

    In January I filed my I-485, I-131 and I-765 - received my I131/I765 in on May 1st (Expires 05/02/2017)

    My I-485 has a status of ready to schedule interview and this has been saying that since 04/13/2016. There has been no other updates and I haven't received anything in the mail over that time frame.

    I called USCIS today to find out some information and he said that it likely I won't get my Interview set till January 2017.

    So based off that info it means I am right up against my EAD expiring, and I was told that it could take 150 days for approval of the EAD and he said I should start the renewal process soon to make sure that it doesn't expire. I don't want to spend almost $400 to renew my EAD but it seems I am screwed if my Interview doesn't get set early 2017 I could have an expired EAD, my employer will require the EAD be valid, and my Travel Documents will be expired also...

    Why would USCIS put a 1 year expiration on the EAD if they know the Status Change process is taking longer than 1 year? Paying the almost $400 to renew it seems like a waste as I can't get a refund for that money if my Status Change happens before my EAD Expires. Also would think they might push out the EAD Expiration date so people don't need to pay the renewal because they have a pending Status Change Application.

    Anyone have insight and or help?

  10. CRA international tax services, you'll find their number on the CRA website. NR73 will determine what you must pay as far as Canadian taxes and other deductions. I'll try to remember to send you a draft of the letter I sent them.

    You will also have to file taxes (not necessarily pay) in the US/ your state

    So the company can hire me, pay me in Canadian Dollars with me living full time in the US?

    There won't be issues with my visa, EAD and Green Card?

    Plus I want to know who I have to pay regarding taxes and where I get the tax breaks?

    Because we had planned to file a return as married couple for 2016 but I worried that being paid in Canadian dollars and possible being taxes in Canada for some stuff, and not knowing what I need to pay tax wise here in the US?

    And what is NR73?

    Yes if you could forward me the letter that would be great.... I will PM you my email.

  11. US SSN is when you work for an American employer - you are going to be working for a Canadian company, right? Not an American branch of a Canadian company? Then, you use your Canadian SIN. They will prepare your T4 and such at the end of the year.

    Ok so the company is having some issues getting some sort of approval to hire me.

    They don't have any US employees as of yet and are not a registered company in the US.

    So what I am trying to find out is if I am going to work for them here in the US and they are going to pay me in Canadian Dollars, is this something I can do or will it cause problems with my green card.

    Plus when it comes to taxes, What do I do as the payroll company will want to deduct CPP, EI and other taxes. But not living in Canada do they need to deduct this? And is there a CRA number I can call to get info on this?

    It's so confusing

    Correct the company is only in Canada and said they weren't sure they could pay me in American based on not being set up in the US but would pay me in Canadian and make up for the Exchange rate.

  13. 1) yes you can get a Canadian job

    2) yes you can be paid in CDN $$

    3) Canada and the USA have a tax treaty so you shouldn't be double taxed

    4) you would file both a US and a Canadian return. The US return would be as a resident and I think you claim a foreign tax credit, https://www.irs.gov/individuals/international-taxpayers/foreign-tax-credit-how-to-figure-the-credit, and in Canada you'd claim as a non-resident

    I highly suggest Serbinksi tax forums (and the firm) for your issues.

    But if I am filing both who am I actually paying? And with it being a Canadian company do I still pay EI and Canada Pension?

  14. Hi Everyone,

    I am trying to do alittle research on this topic and hoping that there might be someone that has gone through this, just as I am right now.

    Just moved to California and on a K1 visa, have my EAD and SSN.

    A Canadian Company has approached me about working for them, and are totally fine with me working from California. The biggest issue right now is the discussion was around wanting to pay me in Canadian Dollars (but would compensate for the exchange rate on a monthly basis to make sure I am close a USD amount that we agree on).

    First am I allowed to accept a job that is for a Canadian company while living in the US? is it ok for me to be paid in Canadian dollars? lastly what does this do to me from a tax stand point? Do I have to file in Canada and the US? will this cost me more in taxes and ultimately not be worth my while? or can I claim the income thru US taxes at tax time since I leave solely in the US?

    Plus maybe things that I should go back to the Company with if I have to negotiate to better my situation

    I do plan on speaking to a TAX professional but wanted to see if anyone here has had this situation and maybe had some advice.

  15. Guys, my status finally changed to "The Card Was Mailed to Me"

    I wanna know how to track it's delivery. I tried making an account on my usps but it's giving errors. Any other way!!?

    Also, Congrats to all who already got it! So happy for all :)

    It took 3 days from status change to my in box.

    It can in an expedited envelope.

    So you should see it by Thursday or Friday this week.
