  1. Unfortunately, I have heard this exact same thing. Many say it could be easier to file another petition instead of fighting.

    So you did not make it to the interview process based off of what you described. You can try to respond to the NOIR or file a new petition. However, I heard not responding to the original petition's NOIR could make a misrepresentation case for the embassy at the interview stage.

    You should talk to an attorney. There is a lot of things on the internet about this.

    We responded to the NOIR in December the 4th. my wife spoke to a woman she seemed mean anyway and she told my wife that this might take 24 months. Is that true?

    because i heard ppl got reaffirmed in a month or a couple of months

  2. Hi everybody.

    My wife got a letter from USCIS about (Notice Of Intent to Revoke) 2 months ago but a week ago they sent back our original papers like the wedding album and marriage certificate etc... Today my wife call them and she was on hold for 2 hours finally someone answered and she had to ask them about the stuff they sent back so, they told her cuz those are the original papers they dont keep them cuz we would probably need them anyway, after 10 min of talking the woman told my wife that our process will still gonna take more 24 months my wife was broken crying and she made her day worse for telling her so i feel so sad and i want someone to tell me if this is actually how long it takes or she just lied to her please and thank you.

  3. ya, and it's the petitioner's job to handle the NOIR. Alas, it's the beneficiary that's asking about it. I can understand trying to help one's spouse, it's normal and natural, but IMO, with so many other opportunities to present stuff for a high-fraud consulate, it's very lucky USCIS even offered a NOIR back to the petitioner

    Is there anything wrong if im asking? my wife is working hard to get all the evidence they need us to submit . I just dont understand are we here to get help or getting

  4. In other instances, the approval of an immigrant visa petition may be revoked upon notice ("revocation on notice") by issuing a Notice of Intent to Revoke (NOIR) to the petitioner. See 8 CFR 205.2. The NOIR will explain the reasons the approved petition should be revoked and will give the petitioner a reasonable period of time to submit evidence to show why the petition should not be revoked. The petitioner must respond within the time allotted. An extension may be granted at the discretion of USCIS if the petitioner needs additional time to obtain documentation from abroad or for other meritorious reasons; however, the petitioner must respond in a timely manner to the NOIR by the stated deadline, and provide a reason for requesting the extra time.

    If the answer is NO , then i'm sorry to tell you to Just give up, because whterever evidence you provide....you will just prove their point( sham marriage). Because bona fide marriage need both of you to fight for.

    Yes my wife is working very hard and she is getting as much evidence as she can...I am just asking people who went through this to give me an Idea the petitioner which is my wife is fighting to prove them they are wrong

  5. I don't think USCIS will ask for a joint bank account or any other evidences that require your legal residence in the US.

    I think you need to be specific on what USCIS asks to be proved, otherwise, you gonna get a vague answers, that will not probably fit with your case.

    USCIS didnt ask exactly what they need us to send they just told us the reason why the consular didnt issue the visa, and joint bank account was on the list

  6. I couldn't add my husband to my bank account either because he does not have a social security number.

    I added him to my car insurance and my rental insurance.

    Do you own a house? You can add her name to your house and your bank account you have in your country.

    I also provided a copy of the email from the bank stating I couldn't add my husband.

    I got a letter from the USCIS stating the reason why my visa was denied at the embassy in Casablanca some of it is not true LIKE I dont know some stuff about my wife but some reasons like joint bank account we dont have that because they told my wife that i need a social security number and also they think our marriage is sham not bonafide so please can anybody tell me what should i do to prove our marriage is real i am really confused and i only have 26 days left to send them the proof any help would be appreciated

    Your first step is to contact the US consulate in Casablanca and ask for the reason you were given a 221g.

    Once you know the reason you can prepare more evidence or if its based on the income requirement - then either get a co sponsor or work to find a job that would give you an income that meets the 120% that the consular visa officer at the interview based on their personal choice can enforce.

    Yes I highly recommend in such a situation - getting an immigration lawyer well versed in 221g cases. I recommend calling your local ACLU office (http://www.aclu-nca.org/ )and your local CAIR office for local recommendations.

  9. Very sorry this happened to you. I'm not an expert in the denial area but this is definitely the time a lawyer can get involved. I would also recommend writing your state representatives in the federal government. My congressman's office has been a great resource for our case from the beginning which is now in AP.

    Many threads I have read on denial also try to include more details about their specific case and why you would be denied. For example, non bona fide marriage, criminal record, national security concerns. If you have any insight I'm sure others will be able to offer better advice.

  12. They do!! This is what they want. I will not give up. I will continue to fight!!

    They said we misrepresented. What??? They said because we didn't turn something in to them. We can't give to you something you did not ask for!!

    People in customer service with miserable lives should not be in customer service. If people have true love, why oppose someone else's true love. It is not for them to rain on someone else's parade.

    Are they are threat to the U.S.? Is the relationship real? Give the visa finished.

    This process is embarrassing enough as it is without them denying us the love and emotional support of our loved ones.

    Nobody would give up on their loved ones... they told me they would send my petition back to the USCIS with no reason, no red flags they didnt even bother to tell me what was the main reason all they said is that they needed more information for God sake it doesnt make a damn sense

    I wish I could take the case to the court and sue them too for playing with our life

  13. Actually, we had AP over a year with the embassy. It wasn't USCIS. We had a CIMT but the embassy wouldn't make a decision. AP for no reason. We filed a writ of mandamus, they make a decision to make him inadmissible and they slapped a misrepresentation on us. Purely retaliatory. So now we are fighting the misrep too.

    See, no light at the end of the tunnel. They can do whatever they want to anybody they want to and there is nothing we can do about it. The embassies and the U.S. government just rape us and they are never charged with the crime.

    I don't know why they would do that to people. I think because they want ppl to give up

They called me to come to the consulate and i did then they told me to go back home and wait for the call. when i got back home the consulate called again and they asked me to come so i did, the consular gave me back my passport and told me that they were returning my petition back to USCIS for a review... I was in shock cuz i didnt expect so.

    Does anybody know how long this review takes? or if i can hire a lawyer or anything that i can do?
