  1. We sent in the package on October 28th, and today, November 7th, we received the 1 year extension notice. When we sent in the package we forgot to add a copy of her green card. The I-797C says "if you have not already done so provide supporting documents..." would it be good to go ahead and send in a copy of her green card to the address listed now?

  2. Also this university apartment is a true university apartment with only students (and their spouses) being allowed to stay here while they are an active student.

    Well I just noticed that even the university apartment lease agreements states that my parents address is my "permanent address," I vote there, and it is on my drivers id so I think that is sufficient. I will just leave it as it is and send it off today. Wish us luck everyone.

    How do you update the timeline? I added some stuff for AOS but when I click on my timeline link on the left I still see only the K2 stuff...

    College dorm is only a temporary address, your DOMISILE has remained your parent's home.

    If you answer yes, they will want to know why you did not file an AR-11 for new "PERMANENT" address, as well as I-865 for US Citizen sponsor's change of address.

    Time to update profile and timeline they lack Adjustment of Status.

    I have always kept my parents address as my "permanent address," our bank statements have my parents address on it, and my university lists my parents address as my permanent address but... I just realized that last year we filed our joint taxes using this address so of course my IRS transcripts show my college apartment address on them. Not to mention the lease agreements we were planning on putting in the package are for the college apartment. Even given this should we still say no?? Should I include anything about this being just my temporary college address or just wait and see if they question it?

  4. I have everything ready to go for our package expect the IRS transcripts have not yet come (I do have our own copies of what we gave the IRS). Is it worth waiting for the IRS transcripts or should we just mail it with the copies I already have? The 90 day window is just opening in 2 days.

    Included:

    • Joint bank statements
    • Copies of joint credit cards
    • Lease agreements (x2)
    • 4 x notarized letters from friends
    • Various cards addressed to us both
    • Copies of airline and hotel reservations we made
    • A letter from the church we attend
    • Various photos

  5. How should I answer Part 3 Question #9 "Have you resided at any other address since you became a permanent resident?"

    My permanent address which we have used thought this process has been my parents home. However, since becoming a permanent resident my wife has lived with me at my university apartment which is a temporary address just for graduate school. My permanent address is my parents house (and this is what I use for all important things). Should we say yes to question 9? If so do we just attach a paper stating that she has lived at my college apartment with me but that it is just a temporary address?

  6. My wife wants to start going to a community collage here in California. We don’t make much money and when she applied to the school their financial aid office said she qualified for a fee waiver offered by the board or governors ( BOGFW Type B ). I asked them if this is considered a "means tested public benefit" which she would not qualify for. They said they had never heard the term before so they could not say and if I wanted to be safe I should consult an immigration lawyer... what do you all think? So far she has simply refused to accept the fee waver and paid everything but they keep offering it.

  7. Okay thefish did you submit an I-864 too even though you did not qualify? I know even if you do not qualify you have to submit a copy from yourself.

    Yes I did fill out an I-864 myself but I have no IRS records as I am a full time student below the minimum income and my parents claim me as a dependent. I sent in a letter attached to the I-864 explaining all of this (as it says to do on the form if you have never filed a tax return).

  8. I filled out the I-864 and sent it along with our application but my income does not meet the requirements so I got my parents to be my joint sponser. My parents filled out their I-864 and we sent it in the package along with their IRS stuff and W2.

    This just has me totally confused, it sounds like they are talking about my wife but she has never worked int he USA how would she have IRS reccords to send them?

Ok so I got a letter today from US Citizenship and Immigration Services called "Request for Initial Evidence" it says they "On form I-864, contract between sponsor and household member the household member needs to submit…" then it lists a lot of things all of them relating to proof of income and wanting IRS returns. Now my question is who is the "household member"? Is it me (the USA citizen) or is it my wife (the one applying). I don’t know why they even care though since we had a joint sponsor who very easily covers the requirements.

  10. OK so I am helping my new wife fill out the papers for the AOS and I am wondering what address we should use. I have my address for my apartment in Davis, CA where I am currently a senior engineering student and hope to stay on as a master’s student. I also have my parent’s permanent address where I spend a good amount of time like holidays and some weekends. The problem with the Davis address is that it will probably change once or twice in the next few years, while my parents address will stay the same.

  11. Hmmm... is your apartment at school a dorm or an apartment you pay rent for that is near the campus? If it's the former, I would put my parents' address down, but if it's the latter and you intend to stay there throughout the summer, put the school address. Which address did you put on your I-129?

    I just signed the lease and took control of the apartment last month, it is a on campus but privately managed complex for graduate students and married couples (at least one person must be a student to stay there). It is not a dorm, and you have to pay monthly rent, sign a lease excetra just like any other private apartment. On my K-1 I used my parents address because at the time I did not have the apartment.

  12. Ok so I am a student studying my last year abroad in Hong Kong. As a result I don’t have a job, but that is not really a problem since I have a co-sponsor that can more than cover me. Now the question is this. For the I-134 what should I put as my address? My address in Hong Kong, my apartment at my university in California, or my Permanente (parents address)? Also what should I put for my income? My only source of real income is student loans.

    In summary I have some cash in the bank, some student loans guaranteed till I graduate (about 6 more months), some stocks, staying abroad for 1 more month, and no job.

  13. I am currently in my last year of University (Mechanical Engineering UG student) and am applying to all top graduate school now. Naturally in this position I don’t have a lot of money, mostly just student loans, and help from my parents. So I am sure I will need a cosponsor.

    How does the cosponsor thing work do we just submit 2 I-134A forms (one from me and one from them) or is there something else that needs to be filled out?

  14. I just got the NOA2 :yes: and now I am wondering how long it takes to get this show on the road? I was just looking at the immigration timelines and I see it says the average time for Hong Kong is 300 days after they get the NVC, is this correct? That is almost 1 year! Surly there must be some mistake...

    Is this correct?

    1-4 Weeks – Case Forwarded to Hong Kong

    1 Week - Embassy gets package and sends letter to Fiancée

    1 Week - Checklist and Forms Sent to Fiancée

    Varies - Fill out forms, send to embassy, and go to Medical appointment

    1 Week - Embassy issues interview date

    4+ Weeks wait for interview

    About 13 Weeks… unless it is true about the 300 day thing…

  15. She has to go through the interview in her home country, so I don't think it will be possible for her to "hang out" while the K-1 goes through. If that were possible, we'd all be with our fiancé(e)'s. :) She can visit, but if its like other countries, she has to show strong ties to her home country before the CBP will let her in. Hope this helps some :)

    They California office is currently working on December 31st 2005 our date is January 17th 2006, so I hope it will come through smoothly. Middle of March would be ok with me, what are the chances of this? Also my fiancée has a possible career move to an office in San Francisco (the company would supply a work visa) is it possible to get this even with the K-1 process going on now?

My fiancée is from Hong Kong and I am also currently in Hong Kong (will be leaving in June) anyway I am starting to think that the K-1 will not come through by the middle of June when I have to go home to California. By that time she will have already finished the embassy interview but it is my understanding we wont yet have the visa. I want to bring my fiancée with me, is there any legal way? She has a valid tourist visa, is it possible to come to the USA with the tourist visa then just kind of hang out until the K-1 comes through?
