  1. You will have to stick with the supervisor or ISO at USCIS that is handling your expedite request, hammer on that human via telephone until you get the answer.

if you included a reasonable letter in the request for expedite, then supervisory review should speed things along.

This is actually good news ,

    as

the casefile is on a human's desk.

That human handles adjudication on the casefile.

It's been a bit - was the casefile approved during June 2014 or no ?

The I-130 was approved on August 8, 2014.

  2. Good morning everyone. My husband doesn't have his i-95 do he need it to file for his green card and if so , how can he get it back.?? What are the procedure.??

Do you mean I-94 arrival/departure record? If yes, you can go to https://i94.cbp.dhs.gov/I94/request.html and enter your husband's name, date of birth and passport number and print the I-94 information. Sometimes the record is not found and you will not be able to print the I-94 information.

My husband and I were not able to find his arrival record on this site. When we filed for his green card we sent in a photocopy of the entry stamp in his passport and wrote a note on the photocopy that this page is submitted as evidence of my husband's arrival to the United States. This information was sufficient and we did not receive a RFE when we submitted our application. When we went for our interview, the officer did not ask for the I-94. The officer looked at my husband's passport. We were approved during our interview.

  3. IMHO the interview letter is a form letter that is sent to all applicants. My husband and I panicked when we read that we needed birth certificates for each of our children. My husband made special arrangements to get the birth certificates and the officer did not ask to see the birth certificates. The officer only wanted evidence of our bona fide relationship.

Don't mention the employment letter during the interview. Only respond to the officer's questions.

I haven't really read of any couples who had their IO ask for letters of employment for their co-sponsors, just tax transcripts/returns if anything. Of course I am going to ask him, it's just a matter of if he sees the urgency or decides to be compliant.

I understand that in the letter it is put under required, yes. But in actually submitting the I-864, all they required was proof of US citizenship and the most current year of tax transcripts. Letters, paystubs, and extra transcripts from previous years were just suggested in the instructions, but I did submit his last 4 years of tax transcripts because he allowed it.

I don't know, I just want this interview to go really smoothly and not have to wait any longer.

  4. According to your timeline your EAD will be adjudicated July 5-7, 2014. The VJ timelines were accurate for my case. My husband received his EAD about a week before our interview. Early biometrics does not always speed up the process.

I recommend that you search for April 2014 AOS filers on VJ. This will allow you to compare your case with others who filed around the same time as you.

  5. You expedite request was denied because your sons priority date is not current. You can only expedite a case whos PD is current, or qualifys under "Immediate Relative" (IR) status.

Adjudication = waiting on PD to become current

(Since you didnt give specifics on whether your son is over age 21, or whether or not you are a US Citizen, I am assuming he is under F1/F2B visa category)

My son is under 21 and unmarried. He qualifies as an Immediate Relative. The reply that I received stated that the petition is with an adjudicator. So, you are saying that the request was denied because the priority date is not current and that the petition is not with an actual employee who is processing the application?

  6. same boat as you, my wife aos was done on 2/24/14 now waiting for step daughter whose i 130 was filed at same time as wife 12/2/13 at vsc. the kids go thru the long process. still waiting

I made an expedite request on yesterday afternoon. Approximately 1 hour after my request was submitted I received a notice that my request was denied because my son's application is with an adjudicator.

Have you received an approval on your step daughter's case? I have followed February 2014 I-130 filers on VJ and VSC February filers are getting approvals.

  7. I made an expedite request for my stepson's I-130 petition. I am the US citizen petitioner. The application is at the Vermont Service Center with a March 4, 2014 priority date.

Approximately an hour after my request was submitted, I received an email indicating that my request was denied because the application is with an adjudicator. Does this mean that the application is currently being processed? Will we not have to wait the 5 month processing time?

  9. My interview in 4 days.

What is the best to wear for this interview, not a suit right? (For all those who have done the interview)

Dress as if you are going to court or to a job interview. My husband wore dress pants, a button down shirt, and dress shoes. I wore a dress, a cardigan, and 1.5 inch heels. I believe that your appearance is important and can have an impact on how you are viewed as a couple. Our interview was last Monday. There were some couples there in jeans, short skirts, and midriff baring shirts-very inappropriate.

  10. I am a U.S. Citizen. I filed applications I-485 and I-130 concurrently while my husband was in the U.S. My husband's applications were sent to the Chicago Lockbox. I filed a separate I-130 for my stepson who is still in Jamaica. My stepson's application was sent to the Chicago Lockbox and transferred to the Vermont Service Center. My husband's applications (I-485 and I-130) were approved on May 19, 2014. I would like to know if my stepson's I-130 application will be pulled and processed now, based on my husband's approval or will we have to wait the current 5 month processing time for stand alone I-130 applications?

  11. I have attached the 2014 HHS Poverty Guidelines. This document can help answer your question. You will need to know the number of people in their (your girlfriend's parents) household and if they have sponsored other immigrants. If there are 3 people in the household (2 parents and girlfriend) add yourself for a total of 4 people in the household. An income of $39, 962.00 can cover a household of 6.

  12. Thank you to my Lord and Savior Jesus Christ. Thank you to VisaJourney.com. This website was so helpful to me and my husband throughout the AOS process. This website has accurate information and I found answers to so many of our questions. We did not use an attorney to prepare the applications (I-485, I-130, I-864, I-765). We followed the guides from this site. Our interview lasted about 45 minutes. We had a couple of red flags and I thought the officer would review our case for a couple of months and then make a decision. We did consult with an attorney and were told not to expect an approval on the day of the interview. The attorney advised us that we could wait up to 90 days.

The officer told us that we had sufficient evidence (I had tons of evidence) for an approval and I was so happy inside when I heard the loud thump of the approval stamp on our AOS application.

Again thank you VisaJourney. This site is so wonderful and helpful for people with straight forward cases and people with red flags like ours.

Our case status has been changed on the USCIS website to Card Production.

Send an email to me if you would like tips on what marriage evidence to submit.

  14. My husband and I went to the SSA today to apply for a SS card. We were told that he had to wait 10 days before he can apply. So disappointing to wait in line for over an hour and have to return in 10 days. USCIS should provide this information with the EAD.
