  1. Hi,

I've contacted NVC the other day and seem like it might take 6 more months before the interview. Here's my timeline according to NVC:

    • 60 days to check my AOS checklist
    • 60 days to check my birth place (which they wrongly assumed)
    • 60 days for IV package
    • Interview

I am eligible for the visa waiver. So I think it might be a good idea to go to the US and stay there for 90 days while waiting and come back to my home country for the interview. I've research and see this in a US embassy website: http://barbados.usembassy.gov/spouses.html

Can I travel to the U.S. while my application for an immigrant visa is being processed?

If you intend to take up permanent residence in the United States, you are required to wait until the immigrant or fiancé(e) visa is issued. You cannot reside in the U.S. on a tourist visa or travel there visa free under the Visa Waiver Program while awaiting the issuance of an immigrant or fiancé(e) visa. However, if you wish to make a short visit for business or pleasure at the end of which you will return to your permanent residence outside the U.S., you may travel on a tourist (B-2) visa, or visa free under the Visa Waiver Program, if qualified.

If applying for a B-2 visa, you are required to furnish evidence of your residence outside the U.S. to which you intend to return at the end of your temporary stay. Although a pending immigrant or fiancé(e) visa application is not necessarily conclusive evidence of intent to abandon your overseas residence, it is certainly a factor considered by consular officers reviewing a visa application. If you are unable to convince the consular officer reviewing the application that you do not intend to abandon your overseas residence, you will not be issued a visa.

When traveling to the U.S. either with a visa or visa free under the Visa Waiver Program, you should be sure to carry with you, for presentation to the U.S. Immigration Offier, evidence of your residence outside the U.S. If the Immigration Officer is not convinced that you are a bona fide short term visitor for pleasure, you will be denied entry into the United States regardless of whether you hold a tourist visa or not.

What does it mean by 'business or pleasure'? So I can't say that I'm visiting my husband at the immigration? What evidence of 'my residence outside the U.S' should be brought to the US for the immigration officer to see, if the questions arise? Was there any senario that the entry was denied by the immigration officer?

    Thanks

  2. I requested that my file be transferred from Montreal to Vancouver. It took a month between the time i received confirmation in the mail from Montreal, and then asking them to change it, to receiving mail confirmation from Vancouver. So yeah about a month delay. Hop on it right away and ask Singapore to change it and cc Yongon for good measure.

    Good luck!

  5. Hi NLR,

Regarding some of the supported documents, such as pictures etc. Do you suggest placing the pictures on an 8x10 white sheet of paper for each picture? With dates etc.

    Thanks!

    Hi Lukee,

In my case, I printed out photos of us together (trips, visiting him, with his family, with friends) directly from Facebook ( with dates and comments form friends etc) on the A4 papers and wrote descriptions and signed on each paper after that. And arranged chronologically. Around 20 pics I think. Some pictures are quite funny :D

    GL!

  6. Is your case an expedite? My husband and I applied from abroad through Chicago, yet we are still waiting 5 months.

No, our case is not an expedite. We just filed following the standard procedures and the case was transferred to California Service Center. Maybe they just randomly chose the applications or we just got lucky.

Wow, Congratulations! We applied to the Chicago lockbox in March 2014 (we are from Chile, but we sent the application to a friend in the US, who mailed it for us). Our case was transferred to Nebraska Service Centre. Perhaps we should have sent it straight from Chile.

    Thanks.

I saw a few cases on VJ who sent the packet from overseas and got through quickly. We sent the packet with Fedex from Singapore.

Hope you all get the reply soon :) Cheers!!

  7. Hi,

My husband (USC) is a university student and he doesn't meet the AOS requirement. But his parents will help him file as the joint sponsors.

I would like to know what are the forms that we need to fill up? We know we need to prepare I-864 and I-864a but for who? He also has 3 siblings and his family meets the poverty guideline. Does he also have to include scholarship and grant as his income?

    Thanks heaps in advance.

    Nova

  8. First of all, congratulations! This is strange/exciting/good news... and the second time that I have read this today. Another I-130 petitioner filed from abroad in April 2014 and got approved in about two weeks (through Chicago Lockbox and transferred to California Service Center). Where were you transferred to?

Good luck in the next part of the process!

We filed from abroad tru Chicago Lockbox and transferred to CSC. We haven't received the hardcopy doc for NOA1 yet.

Do you know how long we need to wait for the NVC case number? Meanwhile we are preparing for I-864 packet.

  9. Thanks for the replies.

We were very careful with every documents we filled out. And we added evidences like lease agreement, some dated and captioned duet photos from when we were dating for 2 year, and plane tickets which we travelled together. We signed up for USCIS notification too. I think everybody is careful about everything and provide enough information. We are just lucky yeah :dancing:
