  1. Hey there! I have been visiting my husband regularly throughout this whole process (we have our interview in 1 week) and have never had a problem! I drive, so I'm not sure if flying is more difficult but in my case it has been super easy every time. I travel with some ties to Canada just in case (letter from work, bills etc) as well as my approvals from USCIS and the NVC correspondence, but I have never needed it. Lately I haven't even been asked one question about the whole "your husband's American?" thing. I know it's not an official answer but in my experience I believe he is fine to keep visiting!

    Oh and by the way...CONGRATS!! First big hurdle accomplished!!

    :thumbs: Yes, Thanks...big sigh of relief since it is was later than expected...Great to hear that you have been visiting regularly without any hassles. Sometimes its hard to remember that we cant JUST VISIT without having all this 'official' stuff with us...when you live 45 minutes away from each other and have been visiting back and forth a lot...we are seriously trying not to take it for granted and I do get nervous that we may forget something if we travel together to Canada or if we come back through the POE together into the US. But it has been relatively painless. They have been very professional for the most part to each of us. It was before we were married that he got (as the Canadian) more questioning at the POE.

    Thanks for your reply so quick! He plans on coming here after work tonight and I wasn't sure anyone had encountered this before since so many live far away from their spouses. I thought I read that the beneficiary must file the visa docs "completely abroad"...which seemed to indicate we had to be apart through this part... We had also started out with an attorney who said similar...but that was just garbage advice, I think that advice was entirely meant to intimidate us into retainer her....either way...a big 'whew!'

Our I130 Petition was approved today and I added it to our timeline....now I am trying to figure out if he can still use his regular passport as a Canadian citizen to visit me as he has been doing throughout the 130 pending process....He lives and works in Canada...I have tried to find threads about visiting after I130 approved but before the NVC gets the petition and sends out my husbands packet to fill out for next step. Anyone out there to weigh in on that topic or direct me to the right place to find out if he has to stay put in Canada (even though he just renewed his travel/passport)?

Im living in the US but my husband is Canadian and works and lives in Canada. i guess we face longer time to process or approve since im not abroad. not sure why that makes a difference except that maybe they think you should get preference to come home to pay taxes sooner?...lol. i need him here as much as anyone wants their spouse in the US living under one roof as a family. But i feel for those who only rarely get to see their spouse...i wish everyone the best. :)

  4. i dont mean to confuse the issues either but the US petitioner fiance would need to petition for visa and pay for both his canadian fiance and her canadian child which wasnt spoken of in earlier comments so i thought id throw that out there....im no expert but costs add up and also wanted to mention taking minor across international border may need permission of other biological parent but im only assuming that the other parent is someone other than the US citizen fiance in Florida and that custody or visitation orders are not a factor for you...again, just mentioning my thoughts, im a newbie...my joint custody orders incorporated into my divorce prohibits me from moving to any foreign country or taking my son out of the US without getting specific permission or to tell his dad if were visiting....luckily my new husband is moving to the US and not the other way around...peace and good luck!

  5. My husband and I just got married on Monday. We have only been officially engaged since March 26th, but we have had no problems so far visiting each other in our respective countries(I live in the US and he lives in Canada)He went back to Canada without any problem. He always comes prepared to show latest rent receipt or bank statements of check for rent, plus pay stubs from work. He typically visits me 3 days per week and I go to Canada one day/night. He was taken into secondary inspection area and questioned multiple times before we were engaged so we feel like its old hat now. Even though they have been hard at times, once he became accustomed to what he needs and is prepared, they have been very pleasant with him. Almost non chalant about things. he never stays very long and doesnt bring anything but clothes he needs. hes honest and open but it was intimidating at first. i hope now that he says hes visiting his "wife" the US Customs will still be as pl easant with him. we will find out on friday when he crosses this weekend. im doing all the name changing stuff so i can cross again with my new married name. i kind of expect Canada may need to question me. ill let you know how things go. our I130 is on hold til i get all my documents updated with new name and he still needs long form birth cert from Ontario to come too.

Unfortunately, its just barely become legal in my homestate,i think governor passed law earlier this year....much debate but i think he'd have to be diabetic or cancer patient to obtain and use legally. thankfully hes neither. Even if that route were appropriate and Im not sure it is, fed law says its still illegal and its feds that are reviewing my petition and issuing visa... :(

  7. yes, thats already the situation...hes not using for extended period of time just didnt know if this automatically was tested for and if (for lack of a better word) his sobriety from any recreational drug would be tested automatically...some one mentioned their urine, hair, blood was sampled and my understanding that this can show use in distant past....just didnt want to go into this without thoroughly understanding what may happen. this discussion of course is second hand and im not implying by this question that hes committed a crime or that hes using...sorry for any confusion...

  8. yes, we are planning cr1 route, not k1 route. we plan on marrying on april 15th without much fanfare but filing I130 after that. He has had no problem visiting as usual on his days off since referring to me as his fiance. We just hoping to get reassurance from forum members that other than the usual potential "grilling" he can get at the POE, hes not or were not doing anything inappropriate by continuing our usual commutes cross border while awaiting the processing of our petition for spousal visa. we are starting to get really excited about marriage, finally.

  9. im a newbie and this situation hopefully wont pose a problem for my fiance but he used to smoke regularly recreationally but really it just helped him sleep. he isnt an addict but should we be worried? should he be making sure he has months free of use to prove no addiction or has anyone got any advice? we planned on marrying next month small civil ceremony while he intends on continuing to work and maintain residence in Canada until he gets CR1.thanks

  10. Im American and own a home in the US near a common port of entry and recently got engaged after a year. Weve been going back n forth visiting one another in our respective countries and we just want to stop trying to maintain two households and start our lives together. I realize once were married I have to file the I130 and my affidavit of support but my fiance is a canadian and wants/needs to continue to go back to Canada everyday or so to work. He really has no intention on quitting his job (he only lives 25 miles from me in Canada and another 7 miles to work). If he intends on working and maintaining a residence in Canada until he gets permission to live here, what do we to make sure he can still come n go to work? im sorry but i keep reading and cant seem to find our exact situation for guidance. Can he declare his intent to marry me without my filing k1 visa since he has apt and job still in canada? he has passport for tourist stay which is valid thru april 2015
