  1. I am a US citizen and my wife of 4 years is Brazilian. My wife was granted her green card over a year and a half ago however the post office delivered it to some random address and it was never recovered. I immediately filed a petition to replace the green card (i90). Now 18 months later I received a letter from the Potomac office in Arlington VA that the request was denied as they didn't ever receive the green card back from the USPS "undeliverable" so thus they think we did receive it. However now I have a sworn statement from the post office saying they delivered that piece of mail to another address in another city and it was lost forever.  

     

    My question is I would like to file an appeal based on new evidence but on the i-290b on section or part 2 there are six different boxes to check like filing an appeal with AAO or not etc etc... which box would I choose? I'm a bit confused with which of the appeal options best matches what I need. Any help is very welcome, thanks!

  2. I'm an American filing the I485 for my Brazilian wife of 2 years here in the USA. We have already gotten the I130 but we are sending in the I485 now...my question is, when we got married in Brazil her birth certificate was kept by officials where we got married as we were given a wedding certificate with all her information on it...DOB, parents names etc...Will this work? She doesn't have her birth certificate as it's not allowed under Brazilian law for fear of marrying with multiple names/times. Any ideas of they will request a RFE or should this marriage certficate serve with maybe a Brazilian ID with her DOB on it? Any help is appreciated!

  3. I am an American citizen, I got married to a Brazilian citizen in Brazil last August, I have permanent residency in Brazil. We are currently visiting my parents in Florida and have decided to stay because of work for me. Is there a process for her being able to get permanent residency here if she only has a tourist visa now. I read something about adjustment of status, would that be an option? Is it very expensive? Any help is appreciated!

  4. I'm American and married my Brazilian girlfriend about 6 months ago here in Brazil. I now have permanent residency in Brazil. We would like to go visit my parents who live in Tampa but we are afraid she may get denied her tourist visa. She has been denied once already about a year ago, what do you think her chances are now? Thanks!!

  5. Hi, I am an American citizen and I moved to Brazil about 6 months ago and married a Brasilian girl here. I have already received my permanent resident documents to live and work here.

    However I have literally had no luck im finding any decent job at all and I am getting desperate.

    My question is since Brazil stopped doing the DCF according to their website except in exceptional cases, does anyone know if I'd be able to get an exceptional cases for my wife to come back to the US with me since I have a job offer back in the US and can't find work here and things are very difficult now and I don't want to leave her in Brazil for an extended period of time waiting for the K3 visa.

  6. Thank you so much Menina for you help! I am definitely leaning towards the CR-1 option after getting married here with her while she's on her tourist visa. One question I did still have however, we could start the process for these forms and stuff here to speed up the process but wouldn't that increase the chance of her (she is leaving the Usa after being here for about a month then returning to Brasil) being banned from returning to the USA under any type of visa again because of a possible "visa fraud" allegation? I assume that wouldn't happen but regardless my only real concern is about how long would it take for her to receive the CR-1 there in Brasil? It's going to suck being away from her while I am working here in the USA but realize sometimes it's necessary and she needs to take care of some things there in the next few months, so it might be a good plan as long as it doesn't take years for the CR-1? Thanks a a million again!!!

  7. My Brasilian girlfriend of over 1 year is coming to the Usa on a tourist visa in May to visit me, (an American) and the Usa. I used to live in Brasil, speak portuguese and also have a tourist visa for there. We want to get married either in the Usa or Brasil soon, what is the best route for us to do so that will get us to be able to live together here in the Usa legally the soonest? What visa or process would be best to achieve this? Thank you in advance!
