  1. I am sorry to hear about the AP. For the guy taking an interview, I have heard they treat them differently but the length of the AP is indeed shocking. Have you contacted your State Senator, he might be able to assist you and get the ball rolling.

    As far as the last year, it was just tough on everyone. I hope things will turn around this year.

    I have 2 additional questions:

    1) the birth certificate and Translated Marriage Certificate (Nikkah Nama) will be the original documents; will it be returned by NVC? if yes when?

    2) This question is only for 'inlovebutlonely', How long it took you to have a NVC Case Status 'Complete'? from the NVC Complete Status to the Interview Schedule Date? Did you already have the interview and what type of questions were asked (focused on I-130 / G-325 / AOS / DS-260 / Bona-Fide Marriage, etc)? Did you get the Visa approval on your first attempt?

    I am having some confusion relating to the wording post DS-260 Submission; could someone with some experience shed some light on it?

    "You have successfully submitted your DS-260 to the National Visa Center (NVC). If you need to update your immigrant visa application, please contact the NVC."

    The above clearly states that I have already submitted the DS-260 form online.

    :If you have not already done so, submit your supporting documentation (as listed on the Documents The Applicant Must Submit web page) to the NVC. Upon receipt of your supporting documentation, the NVC will review your DS-260."

    The above states that I must submit the supporting documents to the NVC (Birth Certificate, Police Certificate, etc) when it should be submitted to Counselor at the time of the interview at Islamabad Pakistan. Now please check the below which contradicts the above:

  4. May I ask what you mean by " Ammending tax during the counselor processing is considered to be risky and they sometime look for the reasons to object"?

    Is this you speculating that it is risky or have you actually seen that it can be risky. I dont see why correcting a genuine mistake on your taxes can cause them to deny anyone. After all it is illegal to have an incorrect status with IRS.

    The reason I ask is because my wife has amended her tax returns from single to married and I will be taking them to the interview.

    Could you clarify why it is considered risky as I have not seen this anywhere and the comment has got me worried.

    The original poster is using his tax return as an evidence of his income, which was already submitted to the consulate. He has 3 years to ammend his taxes; The consulate can easily verify his tax documents with the IRS; they will not send him a letter requesting "Please provide us your updated documents", they will wait till you show-up at the embassy then they will request you to send them the updated document.

    Now the question comes, how long you willing to wait for the submitted W-7 ITIN? I send my tax forms on March/03/2014, I am still waiting for the ITIN of my wife. Yesterday I ended up calling the Comptroller of MD and Comptroller of Michigan that I need extension to file my State Taxes. If you get an objection (let say just a request) to submit the updated tax return, are you willing to wait till you get a refund to be sure that your returns are accepted by the IRS?

    It might be that I have overstated in my above response, it's better to play safe than sorry and lengthy wait.

    My answer may not apply to you, as the consulate scrutiny is different from Country to Country and above all it depends on how well you perform infront of the counselor. They won't even bother looking at the doc. other than the ADJ Gross.

    The original poster is on AP; he should not be giving them any reasons for additional Documents request.

    Back in 1996, when we went to the consular, we stayed on AP for one plus year, paid the consulate fees twice; below are the reasons of objections:

    * Tax Forms issue; when there was not any. they needed sometime to come-up with other BS... We submiited the same returns in official transcripts.

    * Your Dad married with the US Citizen to obtain a green-card; now provide them the documents, how he got the green card; when they can easily check, he did not.... they are the DOS.

    * I am not the son of my parents beacuse the age diff. between my sister and me is 11 months, now get your DNA done through the embassy.

    Now tell me, isn't that a bunch of non-sense #######?

    In some countries they just need the reasons, Pakistan is one of those countries. You give them a reason, guarantee, they will exploit it unless it slipped from their eagle eye-sight.

  5. If you have a co-sponsor whose income is above 125% of poverty guiideline (close to US$ 30K) then you should be fine. Provide the documentations that the CO has requested from you. Answer to your 2nd question is: if you have vacations and are approved then yes, if you don't have vacations then no. Loosing a job might playout differently infront of the counselor eventhough if you do have a co-sponsor.

    The Poverty Guideline I stated above in incorrect. My apoligy for the incorrect information. The actual for 2014 is $19,662 (125% of POV).

    This is a FACT; no matter how you take it. From the guards to the high-level officers tells a same story.. Have you ever been there? if not then don't question it.....

  7. There will be 2 lines once you entered the interview building. Select Urdu if he's not fluent in English to avoid any extra pressure. The counselor will be a US Person along with an interpretor from Pakistan (Local).

    I have few questions regarding the counsulate Paper work, they are as follows: (these questions only applies to Islamabad Embassy)

    -- I will be submitting the I-134 (AOS) to NVC, do I still need to take the same to the Islamabad Embassy?

    * Is the Tax forms suppose to be regular copies of what was sent to IRS or it has to be transcripts from the tax office?

    * I have read few threads where the CO's are also requesting I-864 (AOS) in addition to I-134 which usually goes to NVC, any idea why?

    -- If Visa approves on the 1st Visit, do you get the stamp on the same day or the next day?

    -- If Visa approves on the 1st day, do you get the seal packet on a same day or the next day or they sent through certified mail?

    -- To be successful on the first interview, what documents a person must submit to avoid any kind of objections, in other words, a slam-dump of all possible documents?

  9. Everyone go through this department, mine is just taking little longer, not exactly sure why.

    The cases that are red flagged transferred to the local office for a face-to-face IO interview. It's most likely resources issue due to high no of files as I am told to expect something by June, you might get little bit earlier than June which I was not happy to hear. I will find out soon from the Senator office. TY.

  10. It looks like no one has such experience which does make sense; as the IO does not provide information on the type of check the petition is going through. I guess I got a good IO over the phone.

    I did call the Senator office today, and I am told that they have sent the request to the USCIS Texas on 03/14/2014. Now I am back into a waiting game. I'll let you guys know as soon as I receive any message from the senator office.

  11. I agreed with Mrs Adnan; if it's from Nadira or already have a seal, stamp and autograph of the agency then you should be fine. Attesting from the foreign affairs is mandatory only if you got it translated from the court office. Now days, Nadra issues Birth Certificates in original local language and English. I have seen attestation from the foreign affairs on the Marriage Certificate as they are always in Local Language.

    NVC usually does not require Birth Certificate; it's one of the list of document for the consulate.

  12. Proudly canadian comment is correct. It USCIS Policy to send !-797C of !-130 with a K-3.

    On Friday (Mar/21/2014) I called the USCIS, the IO told me that my I-129 was sent to the Bona-fide marriage dept. for verification on Jan/28/2014 and my I-130 joined the I-129 in the same department on Feb/06/2014. They have combined both petitions and you should expect the approval of both on a same day.

    Now the question I asked on the other VJ forum which no one is able to answer is how long it takes for USCIS to verify the Bona-Fide marriage paperwork? As I am already told that all the other checks are clear by the IO. The following I have send to the USCIS as a proof of Bona-Fide Marriage:

    Marriage Certificate, Pictures, 2 sworn statements, New Joint Bank Account Confirmation letter.

    Any information will be highly appreciated. Thx.

  13. I am agreed with the above responses; I will not recommend to amend at this moment. If your marriage is less than 2 yrs old and your spouse will be on CR after arrival then your ammended tax will be one of the supporting document towards changing Conditional Residence (CR) to Permanent Residence (PR). Ammending tax during the counselor processing is considered to be risky and they sometime look for the reasons to object. For now, you should be fine as long as you are above 125% of poverty line and if not then have a co-sponsor.

    In my case, I am waiting for the NOA2 which is way before CO Interview. I mailed my taxes (MFJ) with W-7 Form. I am still waiting for the ITIN to file my State Tax. It takes quite a bit of time till they send a ITIN through the snail mail. I will be most likely submitting electronic form for State Tax Filling Extension. In your case, time is luxury which you don't have.

    Turbo-Tax will not allow you to get ahead till you have a SSN for your wife and this is the Fact. You can use 111-11-1111 or 999-99-9999, let the turbo tax calculates the numbers and then Print it out. Now fill the new 1040 Form online w/o the dumy SSN, fill the W-7 with supporting Document and mail it to the IRS address given on the W-7 Form. Online submission w/o SSN or ITIN are not possible.

  14. looks like your files has been combined and your spouse has been assigned a ARN. You still need to wait for April End or May for the Backgroung Check to Initiate or file get transfered to another Service Center. Pray that you get lucky to be Ajudicated prior to 6 mos. Unfortunately I-129F (K-3) won't be any help.

    If your receipt # starts with MSC, they are very slow. The others, I won't comment on it.

Secondly, make sure you have your papers arranged professionally in the sequence it was requested as I heard it makes a difference when infront of the counselor. Third and last, be confidence, smile and do not answer more than they ask for. Best of luck.

  17. NBC has Posted the new dates on March/18/2014

    For I-130, they are processing upto I guess July/16/2013 ("Field Office Processing Dates for National Benefits Center as of: January 31, 2014")

    My PD is August/2013 and it has been transferred to the TSC from MSC (NBC), My I-129F (K-3) and I-130 are now joined at TSC. I called them yesterday using my I-129F Petition # and asked about the I-130 question in addition to my I-129F Questions. They have different kind of checks that are causing a hold as they are waiting for the response from the department. Mine is on hold due to Bona-Fide Marriage Department Approval. The other checks are already complete.

    I would recommend to call USICS using your I-129F petition No and request the rep that your timeline is outside the six month timeline and you would like to speak to the tier 2 Immigration Officer (IO). If you call them using your I-130, they will not transfer to the IO (Tier 2).

    I have found NBC the slowest of all.

    I Called USCIS today 03/22/2014 and talked to the Tier 2 IO (Good IO); he digged little into the system and told me that everything looks good, all the paper work they requires are already there and there won't be any RFE. He further said that my I-129F was sent to the special department on Jan/28/14 for Bona-fide marriage check and my I-130 joined the I-129F in February. All the other background checks are clear and good.

    Could some one please shed some light on this Special Department who checks the bona-fide marriage, as my application is still in this department which is holding my approval and how long should be the wait (expected time of approval)?

    I sent the following documents as a I-130 proof of my Bona-Fide Marriage:

    - Marriage Certificate

    - Joint Bank Account Letter (Confirmation Letter of the New Joint Bank Account)

    - Pictures of Wedding

    - 2 Sworn statement (one from my relative's friend and second from my wife relative's friend)
