  1. Hi all,

    I am a non-resident alien spouse of a LPR and do not get any income from US and from foreign source(no property,job,or any source), dependent on my spouse. my doubt is...

    1) should my spouse have to file tax returns under the status 'married filing jointly/married filing separately'

    2) is there any exemption for NRAs like me

    3) Is single filing status(spouse's) would possibly affect my Visa application(F2A CP) or any chance that interviewer may express doubt(filing single means the person is unmarried)

    How to proceed if i qualify for Q1)

    Please Help!

  3. Thank you :) .The appointment is valid for the next day after submitting the application( the date and time chosen). Printout of the application receipt. Documents you need to carry is just a photocopy of your passport with your signature & your original Passport. The fee is Rs. 500 & has to be paid at the passport office only. They issued me my PCC on the same day the whole process took a hour and half.

    We need a copy of PCC proof, a copy of marriage certificate(if you wish to mention you are married or spouse name in the PCC application) along with appointment receipt, copy of passport . We should carry all the originals and their self attested photocopies.

    Though the proof of PCC is not mentioned in the documents advisory, it depends upon the decision of the PO/granting officer.They mas ask us for much documentation.

    It's my personal experience recently...PO asked me to show the sponsor letter...They may not aware of the rules sometimes,but we have to avoid risk and deal smoothly with the officers of any country.

  4. Its not necessary to include your spouses name. Its entirely upto you if you wish to change your name after marriage ( Female) and include your partners name . Kindly don't listen to Indian officials who state otherwise and ask you to go through the process of getting your passport re-issued unless you want to change it to include your husbands name.

    In Indian Passport, at the back side we have section for Spouse name, so i was wondering if i need to include my spouse name in my passport...!!!

    My PD is 28-JAN-14 & i received fee bill from NVC.

    I've applied for PCC at local Passport office.They told me to endorse your spouse name on Passport in order to get PCC(i mentioned my spouse name in PCC application). For this, I applied for re-issue of passport and it took 3 business days to get new one. Also, it is important to add your spouse name on passport,(in case) to obtain minor passport. I think its better to add spouse name in passport.

    And of course, one last point I forgot to mention:

    The process may turn out to be different in other peoples experience. I've read in other forums that some people have walked into the PSK and gotten their PCC done on the same day! I have no idea how that would be even possible, unless an exception is made. But what we had to go through does seem to be the logical progression/expectation of events to take place..

    So if you see anything different, please do share... If you skip some steps, that'll be brilliant!

    I had my interview at the Chennai Consulate. Which consulate are you applying at?

    You can do fill the application yourself or hire an attorney. There is no processing time period. You need to book your interview slot online after paying the application fee. If your visa is approved you can collect your passport after stamping in 2-3 days time ..

    The Visa Officer who interviews you needs to be convinced that you will return back . So you need to prove really strong ties . Like a good job or enrollment in a college/university could get the visa officer to be convinced that you will return back. And of course, you will need to take leave approval letters from your employer/college for the VO to be really convinced. Having property registered in your name could also prove that you have ties with your home country.In my case I had neither.

    About being worthy or not, well I don't know. It's entirely upto the VO to decide. Sometimes you may have a job/property etc. but they may still deny it. And be very honest while filling in the B2 application form. There is a question which asks "Has anyone filed an immigrant petition for you? " Answer "Yes" and below that there is a column where you are asked to explain. I have heard people do succeed in getting it but again I'd say it is varies from case to case.

  9. You can always try and apply although there is no guarantee. The consulate can deny it. One of my friend has got tourist visa while her petition is pending. But she did state in the interview that she has already applied for F2A. And ones she/he comes to USA on tourist visa, has return back to her country in 6 months.

  10. I will be going over on the VWP, which I believe is a lot easier than a Visitor Visa, which if I am not mistaken you need, if you are an Indian citizen.

    To show proof of ties I will show the CBP officer, my NOA1 and 2 - to show I intend to immigrate the right way, a letter from my employers, a recent payslip and maybe a later from my folks saying I live with them, but they are expecting me back on x date. I know from other peoples experience this is more than enough for the VWP - with the Visa I am not sure, just bring things like I mentioned and maybe a lease agreemenet and any other documents showing you are tied to your home country, e.g you need to return.

    Thank you tim131 for knowing me about how to show ties as proofs. I think India isn't a participating country in VWP.
