Let me warn you that the US embassy will put your file in a permanently “burned” grouping if you so much as even mention this notion. Maybe she will in “reality” have to stay since you cannot afford to bring her to the US. However, as far as the law, on paper, and the US embassy are concerned you cannot petition a foreign national without also petitioning for all their minor children that are dependent on them with a k2. It is a requirement (see: LIFE act). Again, failing to mention the child is considered concealing a material fact which is Felony perjury. I would advise you to either earn more income, delay until your finances are stable, or find a sponsor with considerable assets or a annual income above 40k.

You guys are off your rocker. You absolutely have to include the daughter and file respective k2. They will be interested in your annual income above 125% poverty level for all of you. In this case, it would be in your interest to consider getting married in Jamaica. In any case, you will have to find a co-sponsor that has enough income for all of you + him/herself.

Cashing the check merely confirms it has been approved. As many people on here have noted...it can take up to 60 days for them to cash it.
FYI- Prepare yourself mentally now for the real America and losing many comforts/programs you may have become accustomed to.

I would not advise it in her case unless it offered some considerable advantage over the k1 visa. Based on her country of origin and her fiance’s occupation I do not believe it will. However, I can assure you that a legal marriage presented before a court is a legally binding contract irrespective of national origin and/or legal status. A US marriage license trumps many immigration laws. Again, it is all relative to the case….in this instance NO…. in a case of an illegal immigrant from Latin America…..ABSOLUTELY YES!!!!

Technically she can just get married in US. You’re from the UK ...your fiance is in the US Navy.... you pretty much have it made either way. I believe if you get married (legally) in the US it will save a little bit on time/costs in your case.but i'll defer to more experienced UK posters. Most people will state that this is not allowed but i know several friends that married international students in college and their spouses were able to get a permanent resident cards despite them overstaying on their tourist visas.

It has been received on the 7th of march. However we haven't received a notificiation or they haven't cashed the check yet. Did we do something wrong? Or is it sending it to that address a longer route as they have to ship it to Dallas and from Dallas to a different processing location?
My fiancee is slowly panicking and I'm trying to keep her calm.

no...my fiance is Vietnamese OK so I guess I was wrong... I stated it would be difficult for an American to learn how to speak Indonesian in 6 months based on the language's historical influences.

By the way...the US embassy would (in your case) know that you were visiting China based on your passport. However, unless it was for 1 year it is not necessary to list it.

I am still waiting to receive the letters from her…she sent with DHL. As soon as I get it I will submit this part. Then I will send her the ENTIRE packet that I sent… and then we can work on the things the embassy will need…including the I134, her criminal record check VN, single status VN,,,, and work on her vaccinations for medical. A lot of hard work ahead… I know it is all worth it though

Let me break this down for you… your visa was already rejected… you plan on visiting the US on a tourist visa (B).. yet they have told you that you don’t have sufficient ties to Nigeria…correct? This generally means they think that you are trying to get into the US so you can stay and/or live. If $150,000 USD is mostly in your house (or real estate) ..you will have a difficult time convincing the embassy.

There is maybe ...maybe...a 10% chance they will accept your visa app. Who is the US relative you will be living with? Have him send notarized affidavit to the US embassy that he will be responsible for you 100%.

What country you are applying in makes all the difference. Example: Australia = visa already in your hand... China..... maybe (if u are lucky)...a 5% chance they would grant you a visa with 150k in assets

OP is correct. Make up income shortfall with assets is generally allowed with 5 years * gross shortfall. With ANY visa (including marriage)... USCIS does NOT have to allow anything. There are no "rights" with regard to this process. In general, the embassy will like to get a complete picture of your financial standing before rejecting your application solely on a financial basis.

My absolute final questions here… I got my fiance’s g325 and picture and letter of intent from dhl yesterday. Should I make a copy of the packaging to prove that she actually sent them to me? She made 4 originals and also has 4 passport pictures. I am going to include 2 of her passport pictures and she wrote “phot of ‘her name’ on the back of them. So I am placing these in a ziplock and stapling to a paper titled “photo of her name” Now I also have placed my $340 payment in a ziplock plastic bag paper clipped behind the cover page. My coverpage is signed. I only signed/dated the last page (page 6) of the I 129f apllication and every page of the “part 2. Q 34 a supplement.” I feel/think I need to at least initial pages 1-5 or maybe just sign them too… just in case? Now I have 2 notarized timelines so I will send one original and then send the other to my fiancé. But I only have one notarized letter of intent (from me) …so should I send the original to UCSIS and send my fiancé a copy …or vice versa?
I made a black and white copy of my entire passport and it was a total of 18 pages. I also included color copies on photo paper for my “evidence” section. I just went to Walgreens and printed out all the pictures 3 times. I am sending one set of originals with this application in a big freezer ziplock bag with a paper attached typed “photographical evidence.” Should I label the back of each picture? I Have exactly 120 pictures…there in chronological order… I don’t know if I should write “1/ 120” ….99/120” on the back of each picture with a black sharpee? All of my proof is either copies of originals or email printouts… Basically each section is individually paper clipped and then I got one of those giant black clip things to clip the entire package
I need to send my fiancé all originals.. including my birth certificate/i134 …right? I am just afraid the Vietnamese government my lose/steal/misplace my docs. I really hope this first part goes smoothly at least.
