  1. Hey guys, I need some help. My friend (the beneficiary) is married to a Legal Permanent Resident. She was born in the Dominican Republic, but shes a Turkish resident and has a daughter, who was also born in the Dominican Republic but is a Turkish Citizen. He wants to file for her to become a permanent resident of the U.S. but he's not sure if he should file for her to do the Consular Processing (NVC) with Dominican Republic or with Turkey. Please advise. Also since they have a child and a minor, she's a derivative from the mother so she can just be added to the NVC documentation and pay the $325 for the processing of her visa as well. Please help me out so I can inform them. Thank you.

  2. I am curious, did you also include a hardship letter with the waiver form ?

    Working for an immigration attorney who has experience with waivers certainly helps.

    Congratulation on the waiver approval.

    My advice to others reading this is still : do not attempt it without an attorney.

    I did include the hardship letter, and a few affidavits from people that know our relationship n proof, lots of proof :)

  3. What exactly was the misrep ?

    It is very difficult to file a 601 with quality supporting evidence and not advisable without a lawyer or at least experienced guidance.

    He was previously married to a USC, they went to the interview and had a few disagreements on their answers a notice of intent to deny was issued, they responded but she didnt provide much proof of a bonafide relationship and she did that on purpose because she wanted to mess him up so that they would think it was fraud so automatically, if someone else petitionedd for him, he wouldnt be able to come but unfortunately for her, I prepared everything myself, all of our proof, I used to work with an immigrationa attorney for almost 5 years so I know exactly what they look for. Now our waiver is approved and we just need notification of what else he needs to take to the embassy so his visa can be issued :)

  4. Its incredible but i sent out my fiance's 601 waiver n it was received April 17 and we got approved May 7!!!! No RFE nothing It was a misrepresentation, I prepared it myself and sent enough evidence that they wouldnt have any doubts!!! My country is Dominican Republic, whats next? Out k1 interview was on Dec 17 2014. The CEAC status still says refused but the date changed to 5-7-15....Staying hopeful so We could celebrate my fiance's birthday before the end of June...what do you think???????

  5. Wooooooow....Соngratulations for the approval!!!! That's really fast ! Was it just a regular I-601 for overstay only and did you request an expedite? Our reсeipt date is Маrсh 19th and still waiting.....Thanks in advanсе!

    HIIII, NOT I WASN'T A SIMPLE OVERSTAY, IT WAS MISREPRESENTATION. I PREPARED EVERYTHING MYSELF AND SENT ALL THE PROOF AND I DID REQUEST AN EXPEDITE DUE TO MEDICAL REASONS, I HAD A RISKY PREGNANCY AND UNFORTUNATELY, I MISCARRIED A COUPLE OF DAYS AGO. I HAVE A HISTORY OF LOSSES. ITS SAD BUT AT THE SAME TIME I'M HAPPY BECAUSE NOW I WILL HAVE HIM WITH ME AND WE CAN KEEP TRYING. THANK GOD.

  6. I am in absolute shock.

    We waited 8.5 months for our AOS interview, so we assumed we were in for another long wait for the waiver. However, less than one month after USCIS received our I-601, the waiver was approved.

    We received three e-mails on Tuesday saying the I-601, I-485, and I-130 were approved. We are still waiting on the welcome letter. I don't think we'll really believe it until we have the card in hand...

    Hello, I have a similiar case to yours, we had to submit an I-601 waiver for misrepresentation for my fiance since he was previously married. Can you please tell me what was the misrepresentation?? I just want to keep my hopes up that our waiver is approved as fast as yours :)

  7. Yes we have been through all the steps, denial sent 601 and finally approved. I know we will have to do the interview and medical again. My question is not in regards to this, My question is in regards to when we will hear from CDJ on when they received our electronic file from USCIS so we can actually make an appointment. I want to know if anyone else is having a delay or had a delay in the past due to a holiday or some other reason. There is nothing at all on the CDJ site.

    I have a question, what was the reason for the 601? I went to the interview as well and my fiance has to file the 601 waiver for misrepresentation, and how long did it take for them to approve it?

  8. In your topic line you mentioned misrepresentation but in the post you said he was refused the visa due to the previous petitioner (his ex wife)

    not sending enough proof for a bona fide relationship. Did the ex receive a RFE and did not respond to it ? Revoked petitions carry a hard marker

    of misrepresentation even if there was no misrepresentation per se. So you need to understand and let us know if he misrepesented himself in some way or if the revocation marked an automatic misrepresentation (even though he may have done nothing wrong). What exactly is the core of the mirepresentation ?

    You need to consult with an attorney. Waivers for misreps are not as easy as filling out a form but are accompanied by a hardship letter packet

    with supporting evidence attesting to what your hardship points are, of which you need several points (reasons) and proof why you will endure

    hardship without him in the USA. If you got along without him just fine before then it is hard to proof that you would suffer extreme hardship without him

    (financial, health wise, children etc). Just being depressed won't be a good enough reason for them.

    If it was an automatic misrepresentation by way of revocation due to lack of proof or never answered RFE, then they may be more lenient.

    More details are needed.

    Yes the consular officer gave me the 221g and told me to file the 601 waiver for misrepresentation due to the fact that because of his previous case that got revoked, she wouldn't be able to approve it. She told me and I quote "I want to approve you guys, I know your relationship is real, but due to the fact that he had a previous case revoked, he needs to file the waiver. When we receive the approved waiver packet, We will send him another interview so he can drop off his passport and put the visa on it." She gave us that famous "green ticket" to pay the passport fee and we did. She said to pay it in advance and like that, when he goes back, he doesn't need to pay it again.

    My interview in DR was on December 17, the consular officer asked me most of the questions, but we answered everything correctly, I took all the proof, a 4 inch binder full of pictures, receipts, money transfers, my passport copies, all my flight itineraries since we met, any single document to prove our relationship was legitimate. The problem was that the consular officer said that she wanted to approve us because she believed our relationship was real but that because of my fiance's previous marriage to a USC and the petition she had previously submitted for him was revoked due to lack of proof on behalf of the petitioner, she said that he had to submit the 601 waiver. We paid the fee at DOMEX for his passport delivery yet they didn't keep his passport. She said that once I got to the states, to submit the waiver for him and when the Embassy received the approved waiver packet, that he would get another date to go and drop off his passport and submit any additional paperwork he would need to give them. Can someone please shine a little light of hope among all this discouragement and depression I am going through? This is ridiculous, we had plans that just went to hell when his visa was denied. What can I do?????

  10. Florlinda, we have similiar timelines, my ceac status date was changed on the 24th. They even emailed me that my case was already scheduled for an interview and to see the attached file but come to find out, the idiot that sent the email didnt attach the interview letter with the instructions, so i had to email them back n its been a few days already. Im going to DR next week and Im just gonna show up to this stupid new place they have to schedule appointments and see whats the deal. This is so not fair...

  11. My case has been in the Embassy since the 2nd or 3rd of November. I filled out my DS 160 on October 11th, and sent them an email with the confirmation number and the dates. Still no interview. This is WORSE than waiting for the NOA2. My petition expires on January 25th, and I am really nervous to a point where I barely sleep just waiting for this damn interview date. Sooooooooo stressfull!!!! And to top it all off, the people at the new number dont know about K-1 visas. It is such a crappy system, we should be able to schedule our own interviews like other embassies in other countries. Is there any other way we can get a live person on the phone for this #######??? Im tired of emailing and not getting back a reply. I am truly fed up...I havent seen my fiance in 5 months because I wanted to wait for the interview date, but I already purchased my ticket, going for 4 days on the week of Dec. 3rd, and i know most likely I'll have to be back in January for the interview.

    We have a similar timeline. My petition was approved on September 25, then the embassy got it on 10/10/2014 and a case # was assigned Then on Oct. 30, it showed in transit to the Embassy and on 11/04, the status changed to ready, and I checked it again today and the date changed to 11/06. I have called and emailed them and they said that still no date was given...I'm so pissed off :( I hope I get an early December interview :(. When you called, which number did you call?

  13. Hi guys I got my case number n invoice # over a week ago. I keep checking the CEAC status and it says "At NVC" and I have seen some people get their petitions forwarded to the Embassy like 2 or 3 days after getting the assigned number. I also called the visa specialist and they said that it was already forwarded to the condulate and I emailed the consulate and THEY said it was still at NVC undergoing some administrative processing then to be sent to DR embassy... I'm so freaking confused. By the way, I already did the DS160 the same day I got the case #. Trying to be ahead of them so I wont have to wait as long for an interview...
