    Your circumstances have changed since you entered the USA. The burden is upon the USCIS to prove that you committed fraud, not up to you to prove that you didn't. You may adjust your status if it is now your wish to stay in the USA.

    Everyone else that says you cannot AOS, is wrong. Boiler is quite correct. Nor do you need to be here for XX days to do so. Circumstances could change the day after you entered the USA and you want to stay. The point is the CBP let you in, you truthfully can say you did not intend to stay in the USA, and you can AOS to your hearts content as soon as possible if that is your wish.

    My husband and I were married before he entered the U.S. on a VWP for a visit. Circumstances changed, so he adjusted his status.

    As for a lawyer--I think it's a personal choice. When we first started the process, I was dead set on hiring a lawyer. All of the different possible options were really confusing and overwhelming. Once we figured out we were going to AOS, though, it was far more manageable. We used the guide here as a starting point. Look through the forms. Read through the instructions. And use these forums. I was able to find answers to every one of the questions I had on VJ threads.

    It did take a lot of time and effort, but I felt very confident in our packet when we sent it off. I knew what was needed, and I knew what was in it, and that was a really comforting feeling for me.

  3. I am in the process of filling out the i-130 documents now. But where they ask me for my 'Alien Registration Number' what should I put if I don't have one?

    The I-130 instructions say:

    Answer all questions fully and accurately. State that an item is not applicable with "N/A." If the answer is none, write "none."

    So I think you would put 'none'.

    Is the i-130 document the absolute first thing we file before any other documents or are there any other steps to be taken prior to this?

    Also after we got married (3 weeks ago) are there any other steps we need to take to register or get the marriage validated? Or is the Marriage license/certificate we got at the chapel sufficient for the legality of the marriage?

    I believe you can file the I-130 (the Petition for an Alien Relative that your wife will file) and the I-485 (your application to adjust status to permanent residency) at the same time as one big packet.     It took some time to understand what we needed, figure out how to fill out the forms, gather the documents necessary, get his medical examination, get photos taken, etc.

    The marriage license and marriage certificate are two different things, I think. A marriage license is something you get before the wedding that allows you to get married, and the marriage certificate is a proof of marriage. The marriage certificate should be all you need for marriage legality.

    My husband who's Danish didn't have an overstay, but he did enter on the Visa Waiver Program without intent to stay and then adjusted his status to permanent resident. We followed this guide: http://www.visajourney.com/content/i130guide2and haunted VJ forums to help answer the hundreds of questions that came up. It's a bit of an ardouos processs, but definitely worth it :-).

    He did have to get a vaccine or two because we didn't have his records from Denmark, but I think he did manage to avoid the flu shot, even though it was flu season. No guarantees on that one though.

    Wanted to updated your guys on my progress.

    After I received my EAD, applied for SSN four days later and received it in 3 days.

    Then converted my out-of-country driving license, passed all the test on the same day!!!! Got my MD DL!

    Now trying to get a job of course!

    I'll update after the interview!!!

    I'm very impressed with the Social Security Office. They were extremely efficient for both my name change and my husband's SSN, as well.

  7. We had our interview today in Omaha. It went great. The IO was extremely friendly. She said our application was well done, and seemed to just ask standard questions, most of which were directly from the forms. The whole thing took about 35 minutes, but most of that was just chatting about this and that. She said a big part of it was just to see how we interacted together. She did ask if there was anything else we wanted included in our file, but didn't seem overly concerned about any of it.

    We were approved on the spot and got the standard info about ROC in 2 years, and that was pretty much it. So glad to be done!
