    If you are married less than 2 years when your green card is approved, then you will receive a 2 year conditional green card. Those that enter with a CR-1 visa and most people that adjust from a K-1 will receive a conditional permanent residence > http://www.uscis.gov/green-card/after-green-card-granted/conditional-permanent-residence

    There is no such thing as a permanent visa. You are now a permanent resident. You will need to apply to remove the conditions within 90 days before your 2 year green expires. Once the ROC is approved, you will receive a 10 year green card. http://www.uscis.gov/green-card/after-green-card-granted/conditional-permanent-residence/remove-conditions-permanent-residence-based-marriage

    Actually, if you don't do Removal of Conditions, then they will terminate your LPR status and begin removal proceedings against you.

    It is a mandatory step, the final mandatory step, in fact. After that renewing the GC is simple, like renewing a Driver's license.

    First of all, congratulations for the approval. Must be a big relieved after all kind of papers, lol. Secondly, most of people who adjusted from K-1 visa got 2 year conditional green card unless they filed later after being married more than 2 years. And there is no such thing called "permanent visa".

    Oops my bad, wrong wording! Did you get conditional green card too?

    We had our AOS interview yesterday and were approved on the spot! We were given the 2 year conditional green card as we werent married for long but were still very thankful! I checked it online today it's already for production! But I was just wondering does everyone who applies K1 get the conditional greencard? And there shouldn't be any problem adjusting it to permanent visa right? Just making sure before I can completely run free!!!

    My husband just got his interview letter from the mail today! We're very excited as at the same time very nervous about this interview. I have read here that the OI usually asks for joint account /anything that has both our names on it to be shown during the interview, however, we have none of those. :cry: We currently live at my parents house as we dont have stable jobs YET. What do you suggest we bring instead? And also, what are usually the question they ask during this interview?

    I checked our application online today and saw this. "Your I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS is now ready for interview scheduling. When scheduling is complete, you will receive a notice with a time and place for your interview." Does this mean we'll have and interview for sure? If so, do you know the time frame for that so I could prepare the documents needed :)

  6. I am not sure why they did not ask for the I-864 from you, the USC petitioner/sponsor, if you did not send one to begin with. It is not unheard of for people to receive more than one RFE, so perhaps they overlooked the fact that your I-864 and supporting documents are missing. I would personally go ahead and include the I-864 from you along with the IRS tax return transcript for your joint sponsor. Include a statement/cover letter explaining that you had not sent in your required I-864 and are including it now.

    Cause I already sent both my I-864 and my mom's along with my AOS status, that's probably why they did not ask for it again.

    I'm so confused if I should send another I-864.

USCIS widely accept copies of tax returns that have been ordered directly in the website of the IRS (either online or request to send by post mall), it includes all the information required even from the W-2. Don't send W-2 or copies of your tax returns that you filed otherwise you will get RFE.

  8. Just to clear up something first: you do not have to send in an I-864A just because you reside with someone. The I-864A is used by a household member to combine incomes with that of the sponsor filing an I-864. A joint sponsor uses an I-864, even if they live in the same house as the primary sponsor.

    Also, if you are using someone as a joint sponsor, they fill out only the I-864 and not both the I-864 and I-864A. They cannot be their own household member.

    The USC petitioner/sponsor must fill out their own I-864, even when using a joint sponsor.

    From Page 8 #1 of the I-864 instructions> "The petitioning sponsor must sign and complete Form I-864, even if a joint sponsor also submits an I-864 to meet the income requirement."

    As for the RFE: You must provide a copy of the complete tax return OR an IRS tax return transcript. A complete tax return consists of all forms, schedules, attachments, W-2s and/or 1099s. It is not necessarily just the 1040 and W-2. Perhaps that is why they sent the RFE. If you get the tax transcripts, then that is all you need and you do not have to worry about whether or not you included everything needed for the return.

    They did not ask me to re send my I-864 application. I only had one check box and it was the Federal Income Tax Return. Do you still suggest to still send out another I-864?

  9. 1. Don't send tax return copies, because it is clumsy with many forms and USCIS can misplace those forms. And they will ask again in a RFE. Order tax transcript of 2013 to save a lot of hassle. Only most recent tax transcript is needed, older transcripts are optional.

    2. No matter how much you make, you must include your I-864 form. If you leave same roof with your mom, then she needs to do I-864A not I-864. Along with the form, yes you need to include your tax transcripts as well.

    Hi!

    We sent both I-864a and I-864 along with our packet. However, it did not say on our RFE that we need to send them again. They were just asking for the complete federal income tax return. I have her 1040s and W2s here with me. Would that be enough? The transcript your order from IRS, is that the same thing as what I have?

    It also said, joint sponsor, would you still suggest that I include mine?

  10. 1040 and W2...you can also call them to clarify if they want anything else. You're adjusting status? So, you're in the states already, right? In Modesto??? Ugh. Not much goin' on there, is there...

    Yup, I'm adjusting his status. And he's already here with me.

    Definitely nothing to do here. Full of cows, really. Lol

  11. 1040 and W2(s), possibly letter from employer, letter from bank, bank statements. The letter that you received should list everything that they want from you.

    Hi! Thank you for the quick reply. They did not disclose anything nor gave me a list of the things that they wanted. It just said the complete federal income tax return for the most recent tax year. That would be the 1040 and W2, right? Also, do you suggest in sending all her taxes or just 2013?

  12. Hello guys!

    I have a question regarding this letter we just got from the mail today.

    We sent out our AOS packet last week of May for our AOS and got the initial evidence today asking for "The Joint sponsor on form I-864 must submit a complete federal income tax return submitted to the IRS for the most recent tax year."

    I am confused as we sent these documents along with our packet. Do you think they misplaced my document? Even so, we are still going to send these documents back to them. I just want to make sure of the following:

    1. Joint Sponsor- meaning my mother right? Since she's the one I listed as my co-sponsor.

    2. Do we just send the 1040 and W2? Or is there any other documents do we need to add?

    3. Do I need to add my own income tax return?

    Hoping you could shed a light.

  13. You are already married.... doesn't matter if a person gets married HK or Singapore or where ever... married is married... can't do it twice.

    Churches do church wedding but ... YOU ARE ALREADY MARRIED!!

    Tell you what.. .do as you please, but when it comes back to bite you one day... remember...

    I get your point.

    I wouldn't do it twice if I had the choice. It was our family, really.

    My concern is, would that affect our USCIS AOS application?

  14. To clarify, there are two issues here:

    1. The Catholic church may not allow you to do a ceremony for "show"

    2. If you do a ceremony for "show" then no official paperwork can be involved, it doesn't prevent you from repeating your vows and having whatever party after that you want, you just can't do the license/certificate again, however you may be able to get an unofficial certificate that isn't legally binding. I am not clear whether the vows need to be worded as a reaffirmation or not though.

    It's not for show. We jus want a church wedding. This issue only applies to the church right? It does not affect our application to the USCIS? That's my main concern. Churches in the Philippines allow people to do a "church wedding."
