  1. Hi -

    So I got a call from the NVC today. I sent all my papers on October 15, 2014. After many calls and requests for them to look at the paperwork, they finally responded. They said I was missing my wife's original police certificate. I know it was in the package that I submitted. I asked them to look at the paperwork again. I asked how long it would take for them to look again and for me to know they have it. She said it might take anywhere from 30-40 days, but it probably will be sooner. Has anyone had this before? What is the quickest way to resolve this? Can I just tell them to forward the documents to the embassy and my wife will provide them with a copy of the certificate? Or do they need it to come from me if they can't locate it (i.e. they lost it?) Any help would be appreciated. Thank you!

  2. It would have been easier if you filed the I-130 with the new name. However, since she has already changed her passport, everything from now on should be submitted with the new name. You may want to contact the NVC so that they can update name on the case. If anything they'll ask you to email a copy of the marriage certificate.

    If you filled out the application you can fill this part out. Of course you want to be with her on the phone so you can go over the questions together since their is some info you will need from her, like passport info.

  3. In filling out the DS-261, I have two questions (mainly because I tend to overthink everything):

    1. My wife changed her name for her passport after the initial I-130 was submitted. Should she begin using her married name at this step in the process or wait until we file further paperwork (think it is packet IV) showing the name change?

    2. If I am able to fill the information out for my wife online, I believe there is a question that asks if anyone assisted in filling out the form. Would I mark "yes" at this point, or no because even though it is for the applicant, I am the petitioner for her?

  4. Thank you all for the clarification. Yes, I understand the meaning in terms of the U.S., I was just confused how to account for my wife's children from her previous marriage (especially since they were not coming over immediately). We had several discussions regarding bringing them over at the same time or not and we decided to do it this way. Thank you all for the responses. We appreciate your help!

  5. I have a question about determining the household size for the AOS. I am the sole sponsor for my foreign wife. I have two children. So that means my household size is 4. My wife also has two children that will remain overseas and come over at a later time. I am confused if I need to add them in the household to bring my total up to six. I thought I read that I can leave them off until we petition to bring them over. I am confused if "dependent" means for U.S. tax filing purposes or just because they are children and will rely on us. Does dependent really only mean if I include them as dependents on my tax return? Any clarification would be greatly appreciated. Thank you!
