  1. 2-As a US citizen, she is expected to file taxes even if living abroad. Did you do that? If so, send it. If not, backfile taxes right now, and then send proof of having done so.

    Yeah exactly, and she sent the taxes that she filed. But she doesn't have any W2s or any exotic form that she would get if she was here. So we can't provide what she was not supposed to have. Maybe we should have sent a letter explaining why we can't enclose this stuff.

    She's working for a big and major company in the US. But we gonna provide a joint sponsor, that is retired by the way, so she doesn't have all the forms either.. but she has a lot of asset, so hopefully with the two sponsors will be more than fine..

  2. Hello Everyone,

    I sent my Adjustment Of Status 2 month ago to adjust my Status from a K1 Visa.

    Today I received a Request For Initial Evidence

    1) Evidence of current income :

    We didn't send any pay stubs cause she just started in the company, so she sent her contract only. They request a letter of employment which we can get.

    But they also require "Pay stubs of pay for the past 6 months" which we don't have cause sh's been working there for only 2 month and before that we were abroad. Is that a problem?

    2) Submit all supporting all supporting tax documentation (W2-s, 1099s, Form 2555, and all supporting tax schedules) for the most recent tax year.

    So we arrived in this country in October 2014, what are we supposed to send?

    3) I guess they think we don't meet the income required (125% poverty line), so they said we need a joint sponsor or we need to show proof of assets etc..

    We didn't fill this part in the I-864 because she's making 50K+ per year so it is optional to fill this part (about asset) when we meet the required income.

    Do you think we need a co-sponsor?

    We haven't been in the country for the past 3 years, so she doesn't have all the IRS and Tax papers (except the taxes that she filled from abroad) what are we supposed to send?

    Do you think we need a joint-Sponsor?

    I guess it's our last shot, if we don't provide the right information we gonna have a denial, right?

    Yes she does meet the income requirement. Do you think it will be a problem if she is retired?

    Also, I just saw that the I-134 affidavit of support form has changed. And I don't see any co-sponsor section, should my fiance and co-sponsor both fill out the forms and send them together?

    We are currently waiting for the NOA2 and we are already thinking about the next step. More specifically about the affidavit of support and the co-sponsor that we gonna need as we both live in France (so we don't have any assets in the US).

    We'd like to ask my grandmother to be my co-sponsor. She is retired so will she meets the requirements? Can it be a problem if her only income is her savings and pension?

    What would it entail for her to our co-sponsor? What are her risks?

  5. We (American girl, British guy) are in a similar situation - with the added complication that we're both living in Japan together.

    1. We used our shared Japanese address as the mailing address. It's not been a problem so far, we got the NOA1 fine in the mail and are waiting on NOA2 approval.

    2. We plan on living in her parent's house whilst we get ourselves settled.

    3. Her parents say they are going to act as our co-sponcer, too, if our assets don't quite make the cut for AOS later.

    The way I figure it - living together, even abroad, is very good proof of ongoing relationship.

    That's reassuring.. :) Did you take a lawyer for the process?

  6. Hello everyone!

    We (American girl, French guy) are starting the process of the K-1 Fiancé visa. Our situation is not typical, as we met in France where we both live and work.

    Therefore, we have some doubts regarding some of the forms we need to fill out:

    1. As the US Citizen is currently living abroad, what would be her "mailing address" on the I-129F (Section 2)? Should she put her French address, or perhaps the address where her drivers license & bank account is linked in the US?

    2. As we both live together in France, and we would not be looking to move until the visa process is over (in approximately 8 months) we do not know the exact address of where we will be living once we arrive in the US. This poses a problem on the I-129F Section 28, where they ask for the address in the United States where your fiancé intends to live. Once again, would it be best just to put the address where the US Citizen's drivers license & bank account is linked, even if that will not be where we permanently live?

    3. Because we are both abroad, the US Citizen doesn't have any income nor assets in the US (she has a full time job in France). So we read that she can use a co-sponsor who is in the US and meets the requirements. She has family members so that's ok, but who has to fill the Affidavit of Support, her or the co-sponsor or both? Or is there another form for the co-sponsor? Do you think it is an issue if she doesn't meet at all the requirements, but only the co-sponsor does? We can still send proof that we both have income and assets in France (bank account which we will transfer).

    Many many thanks to anyone who could help us to clarify the above points! We would really appreciate it!
