  1. In the beggining of November, after getting married, we sent all the documents needed for the Green Card, the Advance Parole and the Employment Authorization.

    In the middle of the process we moved to a new house and did the change of address online, for some reason it was processed for the Green Card but it wasn't for the other two cases, and we received a RFE related to our address (for the AP and EAD). We sent everything needed for the RFE very fast and they've received them.

    So, I got an e-mail update saying that my AP was approved, and today in the mail I got the Notice of Action I-797. Something in the text has really confused me and my husband. The notice says "The above application for an Advance Parole Document is approved. DOCUMENT IS ENCLOSED. It shows the validity dates of the document, and any conditions attached to the travel".

    The only thing inside of the envelop was the Notice of Ation, nothing else! Am I missing something? Are they refering to the actual Notice or my envelop is missing a document?

    Also, I read many posts saying that the AP and the EAD usually come together. I can see at the USCIS website, an update in the EAD case stating that they received my RFE. Does anyone have any idea of what is going on?

    I'm about to send my AOS application, and the instructions for form I-485 say to include your form I-94 arrival/departure document. I understand that these are not issued on paper anymore, so I went online to check my record (https://i94.cbp.dhs.gov/I94/request.html). The most recent record is in 2012, but I have been to the US 3 additional times (including my most recent entry on the K-1 visa), and none of these are on the electronic record! I was inspected by an immigration officer just as everyone else coming off the plane is, and I have stamps in my passport proving that I was here and was inspected each time, but I don't understand why 3 arrivals to the US would not be on this electronic record.
    Has anyone else experienced this? What did you do?

  3. Has anyone been in the situation where your I-134 was lost in the mail en route to the foreign country, or is delayed for some reason? Despite paying a small fortune, it looks like the USPS may have lost my I-134/documentation, or it may be held up in customs.

    Any personal experience would be appreciated (I realize that the degree to which an embassy might accommodate such a situation may be specific to that embassy, but for context we'll be dealing with the Rio de Janeiro consulate).

  4. My fiancee is preparing for her K-2 interview, and I am mailing her the original I-134. Obviously, this needs to be the original since it contains my signature.

    Does the supporting documentation need to be original copies? I have:

    -signed statement from my employer

    -signed statement from bank officer

    -copies of NOA1, NOA2, and NVC approval

    -tax forms (W-2 and 1040)

    -bank statements

    -stock statement

    -pay stub

  5. My fiancee spent a summer working at a camp back in 2005, long before we ever met. She came on a J visa and was issued a Social Security number/card. Not knowing that she and I would meet 6 years later in 2011, she [i think] threw the card out. Now, she is filling out form DS-160 for her K-1 interview and the form asks for her SSN, if applicable (I've read that even for foreigners who come to the US on separate instances with different visas, the number stays with them, so I believe that the number must still be associated with her).

    Is there any way for her to recover the SSN?

  6. My fiancee is scheduled to have her interview later this month. The interview was scheduled for 7:20am, so I would imagine that she is either the first or one of the first people being interviewed. Is there any reason (worst case scenario perhaps) that the interview could spill into a second day? Has anyone been required to come back a second day/time because the interviewer decided to check or look into something? The interview is a plane ride away from where she lives, so we're just trying to decide whether it's worth buying a second night in a hotel.

  7. The I-134 instructions don't mention anything about certain other assets that could represent a substantial portion of one's net worth. I'm assuming that it's because they are less liquid and couldn't really be readily used to "support" the fiance.

    The kinds of assets that I'm thinking of are: 401k, IRA, ETFs, mutual funds, Health Savings Accounts, cash balances in a brokerage account, etc.

    What do you all think of these three ideas?:

    1) My plan is to take a literal reading of the meaning of amounts "on deposit in savings banks in the United States" as balances in savings/checking accounts only.

    2) Also, I planned to interpret "other personal property" as tangible property such as the trade-in value of a car.

    3) Finally, I plan to take a literal reading of "stocks and bonds" as exactly that, and not include the other financial instruments that I mentioned above.

    For context, income is not an issue (> 125% FPL).

    Though it seems like the different consulates evaluate petitioners in different ways (ours is Rio de Janeiro, for what it's worth), any insight/experience would be greatly appreciated.

  8. It didn't dawn on me to ask for the case number. I assumed that since it hadn't been "processed" and sent to the overseas embassy yet that it hadn't yet been assigned a case number. I know that it arrived because the lady told me that it had gotten there last Friday. Should it have already been assigned a case number as soon as they put the information into their system?

    I called the NVC and got my case number, and also learned that the petition was sent to the overseas embassy on 7/15. However, when I enter the case number on the CEAC website (regardless of whether i select immigrant or non-immigrant [technically the K-2 is a non-immigrant visa, but some advice above was to select immigrant]) the site says that my case number is invalid. Does the case need to arrive at the overseas embassy before the case number is recognized?

    We got our NOA1 in December 19th, and we are still waiting for our NOA2. After 5 months, my fiance called USCIS and a guy, who was very nice to him, admitted that our case was running late and classified it as "Outside normal processing times". He told my fiance that he would hear back from them after two weeks, which is today.

    So, my fiance has just received an email that basically doesn't help us with any good information:

    "You or your representative contacted USCIS concerning your I129F to notify us that you believe your case is outside of our normal processing time. Below is a summary of what we found and how the issue has been or may be resolved.
    Your petition is still pending consideration. We regret that we are not able to give you a timeframe for when we will complete the review of your petition.
    What You Can Do
    Please see the "Online Services" below to check the status of your case in the near future. We apologize for the delay."

    Has anyone experienced this before? Is there anything we can do about it?

    We would like to know something that is not really related to our visa, but maybe someone here can help us: what are the steps for my fiance to get a driver’s license in the US? Is it possible to get a driver's license before the AOS is complete? Does having an international driver’s license help? Is it a complicated process?

  12. Hello all,

    My fiancé and I are still waiting for our NOA2 to arrive, but while we wait we would like to know a few things:

    - Is there any problem if we get married in a court right after my arrival in the US (like within a week), to allow us to get our AOS done as soon as possible, and after a month or two get married in a church?

    - We also would like to have a reception and honeymoon in Brazil a week after our wedding in the US. How long does it take for us to get an Advance Parole, and is it expensive? How realistic are the chances of getting the AOS within a month?
