  1. Why would I fire my Lawyer? They got my petition approved and did an excellent Job. You fire someone because they didn't do their job. That may not be true living in certain states, some petitions take longer or some go by faster but no one one will nrver know. Anyways, the first petition, I only paid $795.00 for everything so that's very cheap compared to some immigration attorneys who will charge $1,000+ so I'm happy with my attorney. I already know and Im familiar with the steps of the K1 petition. Besides, I'm also a truck driver. I drive 48 states including Canada and southern Alaska and sometimes I'm rewuired to drive in Hawaii 1-3 months a year so thats why I have an attorney. I send them all the documents they need and the file the K1 petition for me. You can file on your own but everyone has their own preference and different situations.

  2. Well I've got good news and bad news. The bad news is that my fiancé and I have to refile for the K1 petition again. That means I have to pay the attorneys all over again and all the fees with the USCIS. My attorney's told me not to worry about anything. Every state is different when filing the K1 petition. Arizona is the fastest State to process K1 petitions. Also my Fiancés aunt works at the City Civil Registrar so as soon as my fiance Annulnent is done Sept 20th, her aunt will resister her as single and my fiancé will take her discree to the NSO. We will file again sometime in october and hopefully by january, the Embassy in manila will receive the petition. My fiancé is part of the Fernandez family.

  3. Ive been to Cavite 8 times to attend all my fiancés hearings. The courthouse in cavite is very small and seldom handle annulment cases. I'm not worrired about the annulment because the judge said this will be my fiances last time going to Cavite since we both travel 14 hours by bus from Santa Maria, Isabela. The annulment isn't my concern. Just wanted to know how does it take for the LCR to send the Decree to the NSO. But now I have some good news so I'm nor worried anymore.

  4. The last process for my Fiancés annulment is the cross examine but the physiologist. After that, the judge will grant my fiancés annulment. Her annulment is in Cavite province and she is the only person in the province that has an annulment case in the court house. Anyway I just spoke to an attorney's and it looks like I'll have to re-file anyway. Thank you everyone for your comments. Disappointing this unexpected event happened even though my fiance was still legally married for 19 years now without her knowledge.

  5. Well there are a lot of stories in the philippines people getting married and they have 30 days afterwards to file sign the marriage certificate which my fiance never did. She got married to someone wheb she was 24 and they both went their separate ways one day later. My fiancé told me that if she didnt sign her certificate of marriage within 30 days, her marriage would be voided which wasn't. It was filed without her knowledge. Here it is 18 years later she found out when she went to the NSO last year. She had no idea she was still married. I dont think im screwed. As long as she goes to the interview in s single status, thats all that matters. Ive already spoken to an immigration attorney and there are a few cases that are like that but my fiancé case is much different than others. By my question still regards the LCR and the NSO. If we can get it expedited, then thats good.

  6. My Fiancé's annulment will be completed September 20th, 2016 finally after one year of waiting but she needs to have her interview on or before October 14th, 2016. From what I've heard, after she gets her Annulment Discree, she needs to go to the LCR (Local Civil Registrar) to file her Discree and it can take up to a month for the LCR to send the Discree to the NSO. Can we take the Discree to the NSO to get it notarized by them rather then waiting a month which is after the time she is suppose yo go for her interview which is before October 14th? I already requested one extension last year so I'm afraid that we might not get another extension. Would the interviewing officer accept the Discree with a notary from the NSO? I would appreciate it if anyone knows this situation. Thank you.

  7. Was your petition approved by the USCIS and did you receive your NOA2? I'm confused what your asking...sorry. It seems your saying that your petition was approved January 18th and you received an email that your petition was received. Is this correct? From what I've heard from the time they receive your petition till they complete your petition varys. After receiving your petition, wait 30 days. If after 30 days, if you haven't received anything, you should call them.

  8. Im here to tell you this. I graduated from ITT Technical Institute with my Associates Degree in Electronics Electronics Engineering Technology. I graduated from AIT, American Institute of Trucking and have a CDL licence Class A. I have all my endorsements: Tanker, Doubles/Triples and HAZMAT. Last, now im a student pilot working to get my private pilot license. Whatever your personality is, if you enjoy doing mulitple things, then go for it. For me, I have backup. If one does not work out, I can do something different. My fream is to get my PPL license so never give up that dream. Flight attendant jobs will always be there.Do what you do best.

  9. K1 Qualifications stands:

    You (the petitioner) be a US citizen.

    You intend to marry your fiance prior to entering the United States within 90 days of your fiancé

    You both are free to marry and prior marriages must be annuled or terminated or by death.

    You've both met at least once within 2 years.

    Not having a ring or did not propose to her is not a requirment of a K1 petition. You must meet either 125% of the poverty guidelines, or meet the asset requirement. If unable to do either, you will need a joint sponsor. $24,000 Is sufficient income for a K1 Petition.

Why is is so hard for people to get married within the 90 day period? there better be a good explaination why you didn't get married within the 90 day window but as required you are to get married prior to what Immigration says. Take care of this ASAP. You went through all the time to get your fiance here so don't go through the whole petition process again.

  11. Well its obvious that you've both met since you had his baby. I was in your shoes though and countries are different. An annulment can take some time and there are statue of limitations when it comes to annulments. Its much harder to prove an annulment rather than just getting a divorce and annulments are very expensive. I was married to a japanese woman for almost for years and my statue of limitations were running out. based on the state of California, i think its either 4 years or 5 year limitation before you can file for an annulment and anytime after the statue of limitations is up, the harder it gets for an annulment. annulments can take up to more than a year. In the state of California, a divorce can take between 6 month's up to a year. I couldn't petition my fiance last year because i was still married till a judge signed my divorce on November 19th 2013. There is a mandatory cool down period that I wasn't happy about. exactly 6 month's and 1 day. This cooldown period allows married couples to think and give some time if they want to go through the divorce. After 6 month's and 1 day, the calender stops and your case will be set for review to be looked at by a judge to sign the divorce. This doesn't happen right away. after the cooldown period, it can take a judge between 2-5 month's to sign your divorce.. its a depressing situation.......My timeline for my divorce....Feb 28th, my ex-wife was served the divorce papers and signed on the same day. the day your spouse is served is when the cooldown period starts. From Feb 28th to August 29th was the end of the cooldown period. Finally a judge signed and stamped my divorce November 19, 2013. As you now know, it almost took 9 month's. From my experience unless your marriage is fake there are 6 facts to prove: You were force upon to get married, Physical incapacity basically, it means that 1 of the spouses or partners was physically incapable of “consummating” the relationship) and the incapacity continues and appears to be “incurable.” Fraud just to get a greencard, Unsound mind: either party was of “unsound mind” or unable to understand the nature of the marriage or domestic partnership, including the obligations that come with it, Incestuous: when the people who are married or in a registered domestic partnership are close blood relatives; or A prior marriage or a domestic partnership, the person you married is or was under age, Bigamous: where a spouse or domestic partner is already married to or in a registered domestic partnership with someone else. these are all the facts to get an annulment. I understand you want to be together with him but if you want to be with him, you'll have to grow patient and do everything the right way. I say get divorced right away. The sooner the better.

    I hope everyone is doing well and we are all desperate to be with our loved ones. My attorney received the RFE notice Feb 24th. It was an easy fix, the USCIS requested my divorce decree or proof that a divorce was filed so no big deal. My attorney's mailed out the decree last week friday. I know it can take up to 60 days or the deadline date to submit the evidence. How many of you received an RFE, responded and mailed out your RFE and afterwards, how long did it take to get your NOA2?

  13. Im in tbe same situation. Last week my attorney received the RFE and tol me that it was only requesting my divorce decree. The evidence of my divorce was mailed out last week on friday by my attorney. I didnt go to the court to get mine certified though. If the USCIS needs it it be certified, then do so otherwise its extra work but in your case the signature was hidden like you said. Hopefully mine gets approved by next week.
