  1. I have a question about the filing fee and form fee for the I-765.

    At the time that we filed for AOS and all that fun stuff my wife was pregnant and did not want to work.

    A short time after, we lost the baby. Its been a 7 months and the last thing we have heard from USCIS is that

    because of increased workload not related to our case we should hear something by July. We filed last summer

    and its been a long wait just to get the hurry up and wait letter.

    Which brings me to my question. My wife would now like to work and we are going to file the I-765. If filed at the

    same time as the I-485 there was no fee. At the time, it wasnt something we wanted to do. Things have changed.

    Now, with the delay in handling our case, is there a fee still required? Reading the instructions, it isnt clear.

    If someone has more info on this I would appreciate it. I called the service center just after 6pm and they were

    already closed for the evening.

  2. I am very humbled in having to post this. I hope that I have found the correct forum for my questions.

    I needed a co-sponsor to bring my Fiance here to America. We are now married and about to file the AoS paperwork. In the last couple of weeks I have been to the emergency room for treatment of sever sciatica and back problems. I will likely need to have surgery to correct the problems.

    My question is: Can I alone apply for medicaid, not listing my wife as a person needing, applying or requiring medicaid and still do the AoS paperwork (and nothing interferes with the immigration process)?

    I had planned to finalize my AoS packet and have in the mail on Wednesday.

    Couple more questions:

    1. Why is the I-131 Only partially fillable? I have tried other copies from the net inculding the USCIS website, checked my Acrobat version... and once I get to page 2 I can not longer fill it in.

    2. For the name of the person requesting adjustment of status, my wife, are we now using her married name (she is taking my name) or using her maiden name on the application?

    This may seem like a silly question but I want to be certain the forms are filled out correctly.

    3. Question 16 on the I-765 say to refer to the "Who may file" part of the instructions. There are two letter/number combinations for the K1 visa holder. One is used on the example form

    On this site and the other is not. (a)(6) and ©(9) are both used. (a)(6) is in the title and ©(9) is at the end of that particular area. Which would be the correct one to use?

  4. I have a few questions about the forms for the AoS.

    When the forms are asking about current USCIS status, going from K1=>Marriage=>form filling... what is the current status? Where do we get the Alien Number from? I dont see it on the I-94.

    The Visa expires June 13th, I had thought it was the 23rd so now I am in panic mode, needing to get these done this week and mailed off. She came April 25th, we were married a month later and here we are... her visa expires early, we are told because of the date of her medical exam.

    If there is anything that you think I should have asked and didnt please feel free to answer that as well.

  5. Thank you to all who replied.

    We researched the I-94 and apparently it was supposed to be attached to her passport at the port of entry.

    After flipping through her passport we were only able to find the visa, CFO sticker and certificate. Now I

    think were left with petitioning for a lost/missing I-94.

    This forum is an amazing resource. Thank you again.

  6. Hello everyone.

    I have read that once your fiance arrives the first thing you should do is get a SSN, as it is supposed to be easier and a quick name change application after you are married.

    I have a form downloaded and filled out. Seeing that she is here on a K1, I did not see the anything listed from the Social Security Administration website that seemed relevant to the paperwork that we have filled out and filed with USCIS. I do not know what papers to take other than her birth certificate, passport and the I-797 approval letter (original).

    Can anyone advise on the correct documents to bring with us to the SS office?

  7. Thank you on the information to all about Tokyo airport and also on the new CFO thing.

    I hired an attorney at the beginning of this process. It was wasted money. None of this was ever talked about or mentioned... and the firm was well aware

    of her intent to travel home before coming to the USA.

    Her flight is non refundable and scheduled for the 25th of this month. It would be ideal to get this seminar and sticker taken care of ASAP. Can anyone advise on

    where she can do this. Currently she is in Isabella Province. Not sure if that matters...

  8. I hope this is the correct place to post.

    My Fiance received her visa and we already booked a flight. Now I am learning that it may not be that easy.

    Her visa was from the US Embassy in Singapore. She traveled back home to the Philippines to visit her family

    before coming to America. In 2 weeks she has a flight from Manila to the USA, stopping in Tokyo to change planes.

    Can anyone advise on what to expect in Tokyo? Are there any pitfalls for US Visa holders traveling through the

    airport on the way to the US?

  9. The checklist is all that is needed. A non-citizen doesnt always need the waiver.

    My fiance is a filipina working in Singapore as a domestic helper. She went to the SPF with the checklist, her passports and working permit, filled out the paperwork, was fingerprinted and returned a week after to collect the Certificate. We also had concerns about the waiver but it was not needed because the US Embassy checklist.

  10. Hello. This is my first posting to the forum. I have looked at this site from time to time to verify if what my attorney/caseworker have told me. Long story here... bad caseworker, bad communication...

    My questions is: My fiance has paid the visa fee and sent all documents to the embassy in Singapore and is now waiting for her interview appointment. It has been 3 weeks and no contact back from the embassy. Is this normal?
    I did send the embassy a formal email with all the particulars of our case and let them know that she is awaiting the appointment letter/phone call (was told to expect one or the other).

    How do we know how long before they contact her for the interview? The waiting and not knowing is the hard part. Just not knowing.

    Any and all input would be greatly appreciated. Thank you.
