    BTW, September 2016 is the last month of the fiscal year 2016 for immigration. A new year is coming up in just 2 weeks 2 days (October 1st, 2016) :jest: .

    This is NEW YORK CITY, the fastest working environment in the US..........well I don't trust my words :whistle:

  2. Hi! We also went to the interview that week at Federal Plaza and we haven't heard back! We got the same letter as "amango" and the case status on uscis website did not show any update. Not sure what to do now.

    Hi everyone! Would love to hear what you think:

    We got our interview on May 23 at 9am at Federal Plaza. We were interviewed together, and weren't separated. The SO officer was friendly and she looked at our documents and photos, but we stumbled on a couple of questions. At the end, we got a letter that says "your case is held for review and you will receive a decision within 180 days, no additional documents needed to be submitted at this time."

    Seeing that many of you were approved on the spot, any suggestions what this might mean?

    Did you get any news or update after your interview?

  3. Hiring a lawyer will do nothing but waste a lot of money unless she files for his adjustment of status. Even if she does file he must be able to prove a bonafide marriage. I am not sure why people think that hiring a lawyer will solve everything. Without her there is absolutely nothing a lawyer can do to help him file on his own. You sent a link for VAWA and there is no abuse in this relationship.

    Hiring a lawyer ...... because "Battered Spouse cases" are not "do it yourself cases".

    I came to USA on H1 but i am out of status right now and wants to apply for adjustment of status.

    i need help/advise from the forum community with my situation/hell i am going through. Here is my story....

    i met his girl three years ago when i was in chicago, we dated for a while then i had to move to Los Angeles for work, we kept talking and then she visited me three four times, we get serious and we decided to take this relationship to the next level and i proposed her, she said yes and we decided that she will move here after the wedding and we will live in Los Angeles.

    The day came and we got married in Vegas, after the wedding she said she will go back to Chicago for couple of weeks to finish some unfinished business and then move here for good, she went back and then my nightmare started, she asked me to send some money coz she resigned from the job which was understandable so i sent her money and after couple of weeks i asked her when she is coming back to which she responded that she needed more time to finish up everything, i said OK, but then asking for money became a habit, realizing she is just using me for money i stop sending her the money and asked her to come back or i am going to divorce, and she started threatening me with how she is going to report me to immigration and put me behind bars and everything. four months passed and then one day she texted me and told me that she was on drugs heroin, and that she kept it from me coz she didn't want to lose me. i have never touched any drugs or alcohol in my life so i had no idea why she was behaving strange.

    she apologized me and told me that she is on methadone maintenance program and now she wants to move back and have life with me, so i asked her to come.

    after coming back she was behaving good for couple of weeks and then the old thing, lying, smoking weed all day and night in my apt. i have a full time job as a IT professional and now i cant even sleep because of the smoke and tv running all night and if i object she just make that face and tells me that remember "i can send you back or i will report you to the immigration" my life is living hell right now and i dont know how deal with this thing the only time she seems happy when she gets money from me. what are my choices with my Adjustment of status case.

    Sorry to hear that there are still some USC taking advantage of honest people.

    I do not know that much, but look into this link (http://www.uscis.gov/humanitarian/battered-spouse-children-parents). It will be very helpful to you. A friend of mine was living the same hell like yours, and he ended up talking to a good lawyer who helped him file by himself.

    Find yourself a good lawyer, keep all the evidences you can have, and go ahead. Read very carefully the link and talk to a good lawyer. This is not a DIY case.

    I usually go to N400 related topics to have some news and info on naturalization because my wife is waiting for her oath letter.

    I will be consulting a lawyer for my case in the meantime.

    Have no idea what you were looking for in N-400 related topics (where I usually post), but anywho, since I am here and have read your post I will chime in with my two cents.

    #1. Short answer to your topic questio is: H-1b is something that employer does, from A to Z, and paying fees is inseparable part of his or her (employers') responsibility. Having employees pay for it is illegal.

    #2. What you can do is file a complaint with DOL. They are the ones who are in charge of enforcing the labor laws and regulations in connection with issuance of H1b visas. They may or may not elect to pursue the case, but if they do you might be entitled to some compensation.

    #3. You may also contact FBI or USCIS, if you believe the school had engaged in what is a Federal Crime or conspiracy to defraud USCIS.

    For more information consult an attorney , immigration or labor, in the area where you live.

  6. Very good point aaron2020. Let me tell the entire story to show you that, no one was aware of that. Even me, I just realized it now after research and questioning people.

    When I and many of us were F1 in this school we apply for on campus work in the school and we happily got hired as F1 doing on campus job and still going to school.

    Then I and many of us decided to change the status from F1 to h1b. Obviously I/we talked to the School Director about that. The answer was as follow: "OK, go and see the school's lawyer" For someone who does not know anything about H1B that sounds ok so far. right? I went to the lawyer in 2010. The lawyer NEVER mentioned that it is ILLEGAL for us to pay out of our pocket. He just ask us to bring the money orders, sign the agreement to retain him as a lawyer, and start the process. So far, I could never realize that. Because the lawyer would have told/advised us not to pay the fees personally. Then I got approved for only 2 years.

    After the 2 years, I asked for extension to my Employer and he said: "Go see Mr **** (the lawyer)" I went there again and apply for the extension. Till here I couldn't see any sign of violation going on. And for the extension I paid the USCIS fees along with the attorney's fees (1st and 2nd part only) with my personal check. Then the fish came out when USCIS approved my petition for only 1 year. I was mad with the lawyer and the School Director. And I told the lawyer I am not going to pay the rest of the attorney's fees I owed (the 3rd and last part). I was getting ready to fight in debt collection and defend myself if he sends me there. But Until now the attorney never ever asked me that money. Then I started looking online, asking people, if the financial responsibility of the filling was mine or not. Because the lawyer couldn't do any action against me for the remaining money based on something that is illegal. Right? That's why until now he never asked for that money.

    And, one of the people here explained me that the Director himself told her that she is the one who is supposed to pay all the fees.

    To tell you again, the H1b we have here benefits ONLY to the Director and his school. Because our job has NO BENEFITS. You got it right, 0 Benefits. The only benefits is the sick leave, and because that is a current and advertised law in NYC and the city is not playing with that. NO vacation at all. Since I am working here I have never taken any vacation and I never received any compensation for not-taken vacation. NO overtime payment. I work 43 an 3/4 hours per week and get paid same has regular hours. Before the sick leave law got into effect, when you got sick and can't come, you don't get paid at all. No mercy at all.

    I started here in early 2010 with a wage of $13/h. Today my wage is $13.3/h. So when you do the math you see? 30cent increase in 5 YEARS going to 6 now. And the position requires a Bachelor's Degree at least or its equivalent. This situation is not only for me. It is for all those H1b worker who are here. I believe we are 3 or 5 only. The other ones get their green cards in other ways, not through the company.

    So this is the story of the so called not-for profit school in NYC making millions over students and its employers.

  7. THANK you very much guys for your inputs. I researched after your confirmation and found it on the page of the Department of Labor that it is ILLEGAL for a U.S Employer to ask an H1B applicant to pay all the fees and cost related to the H1B application or extension. These costs and fees are supported by the Employer and enter in the category of the "business expenses".

    THANK you again.

    Now I want to fight back to get my money back.

    - Should I contact the Department of Labor first with all the proof and receipts in my hands, and wait for them to conduct an investigation of the School, and if found guilty I ask my Employer to reimburse me?

    - Or should I just hire a lawyer to fight back on my behalf?

    Another information that can shock you is in this School where I am employed, we are (other people were) almost all in H1B status and every single person here pays out of his/her pocket for the h1b costs. After talking to some of the workers here, they are scared to take any action and denounce the School. Anyway I am ready to board the boat by myself and go for the fight to get my money back.

    I am back to this forum with a quick question regarding the H1b fees and attorney's legal fees.



    I saw in this forum and in some online researches that most people have their employer pay for the H1b process related fees.


    I 'd like to know WHO, ACCORDING TO THE LAW, is required to pay for the H1B (Change of Status in the USA, and Extension)



    My personal and sad story is I am employed by a Not-for-profit company (an English School in NYC). I was under F1 there and then I changed my status from F1 to H1B. I paid out of my pocket all the related fees (USCIS fees, Attorney's legal fees, Fraud prevention fees).


    After approval the time came to extend it. I paid again out of my pocket all the extension fees. I got a very short extension (1 year) and even asked for some help regarding the short duration in this forum.


    My H1B will expire very soon again, now I want to know if it is my financial responsibility to pay out of my pocket for the extension.


    - Am I allowed by law to pay out of my pocket?


    - Is my employer exempt from the law requiring him to support the fees?


    - Is there any way to get my money back?



    PS: I never received any compensation in any form for all the money I have paid for my H1B application and extension.



    I am free to share any information you might need for my help.

  9. hi Ben thanks you????yes we send the Medicaid Letler from NYC and the Medicaid benefit card I think that enough last years we removed the condition whit fee waiver and evething was approved no interview and fee waiver approved thank god we had Medicaid cuz I can't afford the 680 of the application good luck to you as well god bless you all so excited to get my red or email confirmation??????????????

    Thank you for the info. Please keep us update about the outcome of the fee waiver. It's worth the try especially in New York City.
