    I guess most people would be looking to go home.

    EAD usually takes 3 months, you could use it until the AoS interview, I understand you would be then denied as you have no Sponsor and then would be out of status and deportable.

    If your friend is suggesting you find somebody else to marry to stay here, that would not work, you have to adjust through the petitioner (your ex husband) when entering on a K1.

    No, she can file for AOS on her own since her husband died.

    Actually I believe that boiler may be correct. As I understand it, the original I-485 is no longer valid as the USC has died. A new application would have to be filed along with an I-360 for widowers. But I believe one of the requirements of the I-360 is that the marriage is at least 2 years old.

    I hope Diadromous Mermaid will stop by to provide some more insight.

    I am confused:

    1) One time my late husband mentioned that I am the petitioner of myself and not him anymore, do I need Sponsor for petitioning myself?

    2) I already have filed AOS, EAD and AP, and they sent me an appointment letter for Biometrics and I already did it, do I still have to file a new I-360?

    3) Now that my husband died, can't I use his brother as co-sponsor if they needed co-sponsor?

  2. Hi Everyone,

    Please forgive me if I am at the right place to post this or not, I have been trying to find out also how to make a post. I really did not know how to do this because it used to be my husband who dos things and make posts here. Now this is a try if I can make it or not.

    We got married on December 2006. We submitted the AOS, EAD and AP first week of March, 2007. I received NOA for the 3 cases and I also already did my Biometrics on the 3rd week of March. My husband died 3 days after my Biometrics. Our marriage only lasted over 2 months. I really don't about my status, what to do, what comes next because it is my husband who does things for me. The lady in the Biometrics office told me I still have to have my Interview, I don't know when, I am going to panic. If EAD and AOS take about a year before being granted, I worry I cannot be able to support myself while waiting, I can't work. I have heard also of the Removal of Conditional Status but I have no idea about all of them. I am just 3 months here and I am very much stranger to a strange place. What will I do next? One friend said find another guy, which is very tough. I don't know. I really don't know. Please help me.

  3. Mae and I are in the states now and are trying to get on the right time zone.

    Here are a few notes for the POE which was San Francisco - Mae was asked the same types of questions that were asked at the embassy. The agent flipped through the papers in the sealed package asking questions. There were no problems at all, took a little longer than me going through the US resident line. Note, was no need to hand carry the x-ray and medical info from St. Lukes - they were not asked for.

    CFO - Mae had already gone through the CFO course prior to her interview. We went to the CFO to get her passport stamped. First we found out that not all the taxis knew where the CFO was - took us 2 taxis. I thought it would be a quick in and out of the place - it took over an hour to get her passport stamped due to long lines and people having trouble filling out the forms. She also needed a copy of her passport and appointment letter.n Also bring somehing to write with.

    Another update - visa ready for pickup at embassy. Dec 20/2 days

    Now the flights we booked are ok. I was worried for awhile that i was going to have to start rescheduling our flights. So now we will spend christmas in the states. I would have loved to spend a christmas here in the philippines but i have to be back in the states as soon as possible.

  5. mae_jim, congratulations! I am curious why you say apparently all visas are sent back to US for final approval? Do you mean electronically? Also as our interview approaches quickly would love to know more about your interview experience and the kinds of questions they are asking. Finally, was there any resistance to your request to pick up the visa at the embassy?

    The reason I said apparently is that on vj I see visas in one day and another member mentioning the same as i was told. But i think also having 6:30am appointment might have a head start, ours was at 7:30am. Do not know what is sent back to the states, but i would guess it is electronically. It is very hard to get information from the peronnel working there, everyone gives the same stock answer. I requested to pickup the visa, CO had no problem giving us authorization to pick up visa.

    Some questions for pre-interview - the person asked for the paper work

    How/where did you meet?

    When did he first visit you?

    How many times did he visit?

    When did you become boyfriend and girlfriend?

    Mae had problems remembering dates - she was told she better remember the dates.

    For the CO interview

    How/where did you meet?

    How many times i visited?

    Asked when we first met and if we got engaged then - we did not become engaged until later visit.

    Asked both about how many times divorced and children.

    Questioned Mae about her husband's presumption of death - how long you did not see your husband before filing? Any reason for him leaving?

    Both were asked about type of work we did.

    The questions were simple overall. Hope this helps.

    Mae was approved for her visa. I asked to pickup visa, still waiting for their call to pick up the visa. Apparently, all visas are sent back to US for final clearence/approval. CO said we would be able to pick up today, but it was not ready. The staff there are trained to tell you "wait until we call you and don't make any travel arrangements."

    We were both were sworn in during the interview and I was surprised at the number of questions I was asked. CO was friendly and there was a lot of small talk.

    Will post more about the interview later. This forum has been a great help...

  7. I have also seen it suggested, for anyone flying over close to interview time and carrying important documents for the interview, to additionally mail a copy of the documents to your beneficiary, just in case your unable to get there for some reason.

    I did mail most of the documents weeks before. I was bring additional supporting documents which could mke a difference.

    Tomorrow is our interview and i flew out last week to be with Mae during the interview and hopefully bring her to the states on the 22nd. Well the trip to the philippines had murphy law written all over it. My trip over here has been a disaster. My flight form san diego to sf was canceled due to mechanical problems. The next flight to SF, I could not make the connecting flight to hong kong. So they put me on a flight to japan, then hong kong. Well, then I missed the flight to manila so I ended up spending the night in the hong kong airport which was not fun. So finally I get to manila. But no baggage. Everything are in the suitcases for the interview plus others things i needed now. Well, I found them in SF. They never left the states. So right know I don’t know when I will get them. We leave sunday to manila for the interview. Keeping my fingers crossed. Also no clothes... Supposely my bags are in manila and we will pick them up today - hopefully. I should have crried on all the important things vice leaving everything in checked baggage. Will update the results of the interview tomorrow.

  9. However, the chance of being put in AR "may" be minimized if documents arein order (e.g. they are current, they are NSO-issued, annulment decrees are certified true copies with embossed seal and not just photocopies, etc. etc.).

    Fiancee has an annotated marriage certificate containing a presumption of death statement concerning her former husband. This document is over an year old. All her court papers are embossed with seals and stamps, etc. Should we obtain a current copy of the annotated marriage certificate??

  10. My fiancee interview is on dec 18th. I plan on being there for it. Last month i bought a round trip ticket for myself and a one-way for her. The departure date is dec 22nd. I went through my company travel agent and they took care of everything. I knew if i waited the price would have gone up plus less seats available.

    I know we are taking a chance, but it is christmas time - I hope for an early christmas present from the CO at the interview.

    Airlines are normally helpful getting you on the same flights and sitting next to each other.

  11. CONGRATULATIONS, you can now see the light at the end of the tunnel. I feel that the process is uncalled for, especially the waiting time and by the time you are there for the interview you are hoping you did not forget anything. Knowing that you have gone over everything a 1000 times. The disappointment of unfortunate individuals who recieve an AR must unthinkable. I wish them the best in solving the problem, but with the govt it makes it even harder.

    With our interview coming up interview next month there are always last minute questions. What is the lastest information concerning the DS-156 (new bar code) and the BPI process? Has there been any problems with DS-156 in the interviews?

  12. We are planning to be together on or before New Year. The thing is my interview will be on December 21... is it ok to buy ticket for Dec 27 or 28???Im gonna ask the consul for a visa pick up if we have found favor...if not then Quezon City will be the address....anybody who has this same dilemma??? Is it better to buy ticket now and just have it rebook just in case, or buy tickets days before the flight??

    I bought a round ticket.s to be in the philippines for mae's interview. I also bought a ticket for mae and will ask to pick up the visa at the embassy. If you dont get a ticket now it will be hard to get one at the last minute, holiday season. It is a gamble, but one I think is worth while.

    I am debating if we should put the flight on the DS-156.

  13. The posts concerning papers necessary for proof of annnulment have us a little worried.

    Our situation concerns - Death Presumption, which may required different papers. We have

    1) Court Decision - photocopy with dry seal & documentary stamp

    2) Certificate of Finality - original but no seal and no documentary stamp

    3) Original annotated marriage contract issued by NSO - certified to be a true copy

    Will these papers do?

  14. Have a few questions concerning Manila's handling the scheduling of interviews:

    1. What happens when you dont have a visa prior to the time on the Approvalm Notice from DHS?

    2. Since it seems like we dd not make the current round of interviews, will manila mke sure that date is met?

    3. Has any one tried using the early appointment request?
