  1. Yikes. This is a HUGE issue.

    Im not trying to be mean here- just laying out some hard facts. The way you are writing this...well, you are downplaying it. You say 'the easiest and cheapest way to adopt her was just to file a late registration of birth being my parents as the mother and father.' Im not 100% sure of the laws in your country but I am pretty sure thats illegal. Sure it may have been cheap or easy but its still illegal. ' She is my real sister, may be not by blood, but everything about her, paper works and all!' Her fake paperwork you mean? A fake document is not valid- so its really not real.

    Anyway- heres how it is. If your mother is approved she will then theoretically be able to petition for your sister. Your sister is not really eligible because the BC is fake. This falls into the category of alien smuggling believe it or not.

    Please read the following taken from an attny website:

    The Embassy takes a very strict position when it comes to alien smuggling. They believe that people who are entitled to visas, should get visas. But, people who are not entitled to visas, should not get visas. When the Embassy finds out that somebody is attempting to sneak a relative or other person into the U.S., the Embassy denies a visa not only to the person being smuggled, but also to the person who was under petition. In one case, a mother had been petitioned by her U.S. citizen daughter. The mother tried to list her nephew as a biological child in her biographic data. The Embassy found out and considered this to be alien smuggling and denied a visa to the citizen?s mother, on the grounds that she attempted to smuggle an alien. So, by attempting to list her nephew, the woman lost her own visa. Alien smuggling could even result in a lifetime ban from entering the U.S.

    The bottom line is that the law allows only certain family members to be petitioned. If you try to sneak in friends or relatives who are not eligible for a visa, you could be guilty of alien smuggling. And, the stakes are very high. Not only will the person you are trying to smuggle be denied a visa, but your own eligibility for a visa could be at risk. (Under limited circumstances, waivers are available, but it is better not to take the risk.)

    If you have already submitted paperwork to the USCIS or Embassy improperly listing or including ineligible persons (i.e. nephew, grandchild, given child who was never legally adopted, etc.), I would strongly recommend that you seek the advice of a reputable attorney who could analyze your situation and, hopefully, straighten things out, before it's too late. The stakes are very high. Don't have the attitude that, "I'll just give it a try. If the Embassy catches me, the worst that can happen is that the person I?m helping won't get the visa, but I?ll still get my visa." That is not the case. If you are caught, you could also lose your own eligibility for a visa!

    Good point but this does not apply to the OP as the little sister was "adopted" or "faked" the papers 16 years ago (adopted at 3, now 19 years old) obviously no intention of bringing the little to US as it was 16 years ago but still needs to straighten things up legally before petitioning her that is why OP needs to co sider consulting a lawyer.

  3. Hello my dear fellow VJ members.

    As some of here might be familiar with my case. I am in the process of IR-5 and everything is on NVC now and scanned. I know, eventually during the interview, beneficiary needs to bring a set of copy of signed I864 (in my case, with I 864A since my spouse makes money in the household)

    My problem is, .. Recently i found out husband is "back" on illegal drugs (i was the last one to find out) yes, BACK. They call it relapse and i dinot even know his past, that he was an addict for 20+ years, but he was cleaned for 10 years until he got back 4weeks ago.

    I wont detail here the financial, emotional and mental torture im going through right now along with our 2 minor kids, im just wondering what are my options if i won't be able to get his signature for my mom's i864A since husband is gone now, he's been moving from a hotel to a hotel spending significant amount of money he worked hard for.

    The more i want mother to come here asap so i can leave kids in safe hands and go get me a job that will support myself and kids.

    Greenbaum, Correct me if I'm wrong, my mother's first name on her Birth Certificate was VINA but she was known since birth up to this date (and all legal and other documents) as DINA so it was corrected at the Phil. Statistics Authority (formerly NSO) even before this NVC stage, that would mean, SHE HAS TO RETURN TO NBI and lt them put that VINA also because it was on her BC?

    That's exactly the same with my mother's NBI that i just submitted to NVC a week ago along with aos and civil docs. I also didnot see any "AKA" so i'm kinda wondering too what is that AKA that delays the visa issuance. Hope those who are done with this may shed us some light.

Hello VJ people, i am in the process of petitioning my mother, i already paid AOS and it said PAID, NVC already mailed me the cover sheet with barcode to be submitted with the financial docs and aos form but how about the barcoded cover sheet for IV/civil documents? I cannot even open the DS260 application form or cannot even pay for it. It's like locked. So im waiting here since Sept 22. The ds 260 form and payment is locked and i dont know if i have to submit the documents i have (Aos and civil docs) or how long should i wait for the ds260 form and fee payment to be available for me. help me please. Thank you very much.

  8. I just got my case # and IIN an hour ago (IR-5 priority date July 6, Nebraska Center. USCIS approved petition on Aug 25, then sent my papers to NVC on Sept 2, NVC received it Sept 9) i asked the operator if i can give him my and the beneficiary's email address but he said there's no instructrion from NVC that i have to give them any email add.

    Almost all the instructions here say that petitioner and beneficiary should give email add to nvc. Should i call them again? And what is the next step after getting case # and IIN?

  9. Hi VJers! Just wanted to share with you guys my experience in SLEC. Here goes:

    DAY 1

    1. Didn't line up in the morning because I think that I am just making it harder for myself to line up super early especially coming from a trip. It was a Wednesday and traffic was mild. Was there 9:00 AM. Presented documents to the guard. List as follows:

    • Passport and Passport Bio Page Copy (should be in portrait not landscape,2 copies)
    • Appointment Confirmation Email (2 copies)
    • USEM Appointment Letter (1 copy)
    • 2x2 ID Pictures with name at the back (4 pieces)

    2. Registration at the USA Registration Counter (Ground Floor)

    3. Pay fees at the cashier

    4. Laboratory - blood only

    5. XRay

    6. Vital Signs then Eye, Height and Weight checking

    7. Physical Exam

    8. Immunization Interview

    TOTAL APPROXIMATE TIME CONSUMED: 7 hours

    DAY 2

    1. Present receipt to the guard. In my case, I didn't submit my xerox copy of my immunization record the first day, so had to give it back.

    2. Immunization Room

    3. Counter A again, just have to give them my passport.

    4. Releasing

    TOTAL APPROXIMATE TIME CONSUMED: 10 hours

    Tips:

    • Talk to people. Makes the waiting easier and you could pull up lots of information from them.
    • Be kind to the people who are selling stuff outside. They know a lot about the processes inside.
    • Found out from the guard that they finish EVERYONE on the same day (except for the immunization part, that's really day 2). So, don't panic if you're still not being called. Be patient.
    • Releasing is the most time consuming part.

  10. Hi All!!! I guess there are a few of us who are lucky enough to get approved at USCIS quick. I have petitioned both my parents, PD is 2/24/15 and 2/26/15 Nebraska service cntr. Both petitions got approved 3/30/15, I was really surprised!!! I already conditioned my mind that the approval would take about 4-5 months. When I petitioned my hubby to co.e here in the US, it took 4 months before aproval at USCIS. I have even seen IR1/CR1 get approved in only 16 days!!! So, don't lose hope!!! Your approvals will come soon. :)

    I am stuck at NVC right now, still awaiting case completion for both petitions. The system was done for months so I had to wait. My case has been with NVC since April. Was able to get case number by the end of April and was able to pay the AOS fee. The IV bill took awhile. I had to pay by mail for it.

  11. Wow! Just wow for your post OP. Thank God, my fellow Pinay friend already quit the same group and i hope they will read this post. My friend met them here on VJ when she was still on K1. she always invites me to go with her when they have get together parties but i never say yes because i never liked parties eversince and i dont understand their dialect too ? (P.I. has 70 plus dialects ? )

    Been here for 9 years and i only have 4 pinay friends the other 3 are on their 60s, 30 years my senior ?

    I still have a looong way to go as i've just sent my petition but i still wanna ask, does ST. Lukes allow somebody besides the person taking the physical exam inside the exam venue? My mom walks with a cane and will have a hard time bringing a lot of immig docs without anybody to asssist her. Same question goes to USEM.

    I filled out I130 and sent it June 30 for my mom. (USCIS Received it JULY6 and said they forwarded it to Nebraska Center)

    On part C - info about petitioner's relative - list spouse and all children >> i did not put my father's name and mine.

    I dont know what will happen? Are they gonna return it?

    Or, you can get an annulment in 'Pinas.

    If you file for divorce in the U.S., you will need to get an annulment in 'Pinas if you ever want to get married in 'Pinas.

    If your husband files for divorce, you will need to have a Filipino court recognize your divorce if you ever want to get married in 'Pinas.

    Recognition of a foreign divorce is quicker and less expensive than an annulment.

  15. OP, have you tried submitting form DS 5525? I read somewhere here on VJ with similar case like yours.

    And i quote,

    " The Form DS-5525: Statement of Exigent/Special Family Circumstances is a form that is used if one of the parents or guardians is not available to give consent.

    You can submit Form DS-5525: Statement of Exigent/Special Family Circumstances if you are the applying parent and you want to explain why the non-applying parent/guardians consent could not be obtained. The statement will explain in detail the circumstances as to why the non-applying parent or guardian is unavailable.

    The Form DS-5525: Statement of Exigent/Special Family Circumstances will also need to state the efforts made to contact the non-applying parent or guardian. Evidence should be given, which may include custody orders, incarceration orders, or a restraining order. These documents will help for the Form DS-5525: Statement of Exigent/Special Family Circumstances to be approved

So this lady i met from the cburch is asking me, she came in here as a tourist, went home and come back in the US 3 times, overstayed her visa for 2 yrs, met a USC, got married, had 2yrs then 10yrs GC now filing citizenship under 3yrs rule. she told me she overheard processing on GC is different from citizenship and paranoid that she wont be granted citizenship due to past overstay. I really dont nknow what to tell her. Anyone here can help me explain?

  17. Hello there. Sorry I haven't updated mine. Been working out of town for weeks and just got back yesterday in time for my biometrics today. Bio Notice received Jan 291 2014 and biometrics was today Feb 13, 10am Jacksonville Florida. This is my 3rd bio on that place and as always, staff are very fast and helpful.

    They gave me a packet with a CD inside and that's the content of the civics test.

    I will just wait when my interview's gonna be. I am actually coming back there on that local office this month to drive a friend for her civics test (biometrics was November and based on 5yr rule) so I guess, based on her case, 3 months (Nov-Feb) I might be schedule for interview on May but I don't expect too much. I know they are loaded with a lot of applicants.

  18. Hello guys. I just want to know if somebody here has the same situation or at who can enlighten me about this?

    I sent my N400 a week ago and they emailed me saying wait for the NOA, and since I have the replica of my n400, I looked at it again and found out (don't know why I did not see it before maybe too much excitement and nervous) that I checked the married box for question "were your parents married before your 18th bday?" When in fact they are not married. How can I correct it?

    P.S. no plan of petitioning father in the future because he was out of the picture ever since.
