  1. So hello folks!! My journey is almost over! THANK GOD!! Had out interview may 23! Exactly one month after recieving the combo card. Haven't even used it. Lmao. Anyway. It was quite short. I feel like she wanted to get us out of here. We didn't want to leave. I was so prepared. I wanted all This funny questions. After 10 mins she said bye to us. Most of that time she was flicking through pics and our file. Lol. I kept my tush on that chair then she decided to ask me the have you ever been arrested and do you have intentions of being bad kinda questions. We were done in 15-20 mins. She said she would make a decision in 30-90 days. She took my i94. She wrote some gibberish in my passport about a pending 485 something something NYC. 3 hours later checked my case, it was in card production. 5 hours later i130 was approved and on notice mailed. 18 hours later 485 in decision. :) so I am here now waiting for the mailman. Hope fully next 2 weeks or so. My entire process took about 5 months. And I am in NYC!! So good luck and lots of prayer to all of you. And congrats to all who got approved. Hugss!

  2. thanks, that's what I was thinking too but the poster above (from NY) got their testing and interview update a few days ago...and we applied almost at the same time. So I assume its just a gamble at this point?

    Ive been out of country for a while, perhaps we do have a letter waiting at home...maybe they just didn't update the online status/email me.

    I am in NY too. I am not adjusting from K1. Just the reg marriage GC sponsor thing
  3. Yesterday my case finally changed to texting and interview. I checked a few hours later and saw that my EAD was approved and they had ordered a card. . 2 hours later AP was approved, it's now in post decision activity. They said the nailed a notice yesterday for ap saying it was approved and with instructions. My priority date is jan 7th. I did have a RFE, i took about 2 months to respond. My bio. apt was on apr. 2nd. No text or emails yet about the EAD and ap approval or the 485. I feel like they are really trying their best to get stuff done. At least mine is moving.

    hi there everyone! just to update, well, after we were done receiving all our EADs last apr 9, exactly a week after that, we got an email notice that our I-485 app is due for interview on May 20 and that we should wait for our instructions in the mail. wow, we havent even found a job yet...but i am still happy.

    my only question is, i wonder where our interview would be held? oh well, gotta patiently wait for the letter for that i guess....

  4. Update; applied jan 7. Received RFE jan 27. Received biometric appt literally 2 weeks ago. It's for April 2nd. Like after 80 plus days. Really!!? Anyways, I only recently replied to RFE this week. So my case is now back on track. CONGRATS to all who got the GC!!!!! And ead &ap too!! :) keep us in your prayers please. Lol. I'm am playing in makeup all day and "drankin" wine. I am so not stressing or getting obcessed with USCIS website anymore. I have decided when they are ready for me they will let me know. Lol

    I received word yesterday that my EAD card is in production and the AP was approved - 71 days total wait time. I received notification via email/text as soon as the update came through.

    I would have let you know yesterday but I was out in Jefferson fishing at the time....lol

  5. I guess I am the only one that didn't get a biometric appointment. :( I filed on the 7th of jan. Rfe was sent out on the 23. Still no bio. I guess NYC is busy... Or just my luck. Arghhh

    Hi Royo1. It is NOT illegal to photocopy the naturalization certificate regarding proof of US citizenship. In the form instructions, USCIS recommends either using that or a US passport if the citizenship was obtained using naturalization. I know there's a notation on the naturalization certificate against illegal reproduction but that's to safeguard it against fraud. It's perfectly legal to use it for official documents

    that's exactly what I thought. I know it's always wise to copy all of your documents incase the original gets lost or damaged.

    What was interesting was that the RFE was for the AOS but it made specific reference to the EAD and said once the information was received (and was in order) they would proceed with processing the EAD. That kind of surprised me, just as much as receiving texts in the middle of the night....lol

    Great that you joined a gym, it is good to 'get amongst it' as we say in Australia.. :)

    Thanks Nurseling! I will keep my fingers crossed for you that you have no RFE either. Hopefully you will see changes on the USCIS website sooner than later :) I laugh at our comments about our next stages like stalking the mail man and selling organs...it is so funny. I have no doubt that our sense of humour is what will get us all through...

    Hi Royo1. Yes they only asked for the proof of citizenship, thank fully. Darn on you having to wait. It sounds like your sponsor is cagey with her information, I can understand that but it puts so much extra stress on you and I am sorry for that. Hugs.

    Passports shouldn't take that long to renew, so hopefully the wait isn't too long for you. To be sure, once you have everything they need, everything will move more quickly for you. It helps to keep really busy, so I am learning :)

    haha cagey is putting it nicely. But I am trying to remain positive. Question y are the folks over at uscis so useless!? Please don't call them because they will only read to you what you already read online. Lol. I am also thinking they may want her returns for 2013 since 2012 she made vey little. I am really learning to excerse patience. Because for one min I would go crazy if I had to dwell on the negative.
  7. Hi Royo1. If your joint sponsor was a US citizen by birth, then instead of waiting to get the passport renewed, you can ask them to go to the Department of human Services in their county to get a certificate of live birth record. In my county, just like marriage certificates, they issue them same day. If they were naturalized, they can use their naturalization certificates too. Talk to them about these options so you can get your case moving once again. All the best!

    she is a citizen by naturalization. I think she mentioned its illegal to photocopy her naturalization certificate. -_-
  8. Update on my RFE: The mail arrived and with it came my RFE..yay. It was for not providing proof of citizenship (birth certificate) for my husband who is my only sponsor oops8rh.gif and nothing else.

    I whizzed down to USPS and sent the copy as requested to the PO box in MO. They won't get it until Thursday but at least they will have it by the time I get my bio done, so hopefully I won't be delayed too much.

    hi cjc. Did they only ask for one thing? They only thing I forgot to include from my joint sponsor was her proof of status. They sent an rfe for tax returns and w2 (I sent transcripts)and proof of status. My problem is that my joint sponsor passport is expired so I have to wait :( I guess I won't be getting biometrics till after I send in the requested doc. I'm trying not to dwell on the negative
  9. All you should need to provide for an I-864 is:

    - Past year's transcripts downloaded and printed from the IRS - http://www.irs.gov/Individuals/Get-Transcript (everyone can do this and it is quick & easy)

    - Proof of current employment - Your last few pay slips should be sufficient and/or you can also include a letter from your employer confirming your employment and how much you earn

    - Proof of citizenship

    The reasons people are getting RFE's include:

    - Forgetting proof of citizenship

    - Providing copies of their tax returns but not also the W2's (note: W2's are required when providing the tax returns but not with the transcripts)

    - Claiming an amount on their I-864 that doesn't match their supporting IRS paper work

    The RFE they issue for this is a boilerplate letter that is generic and doesn't mention the specific problem, however when replying to an RFE you should always provide everything they could possibly want.

  10. Oh yes, the citizenship info could be it. If you did send the transcripts and now they are asking for the returns, a W2 would be required (going by your previous post). You are right, very vague. I wish they would email us the RFE's so we could jump on what is required...great that we can get tax transcripts online now though, that saves a lot of time... smile.png

    yes. I saw that today. Saves about 2 weeks lol. I have never consumed so much coffee. Smh. Lol not that I hate it:)
  11. Yes, it most certainly states one or the other re transcripts and returns, however here on VJ people are getting rfe's to contradict that. It seems the best thing to do from the get-go. Did you get an RFE requesting the W2 specifically? I am waiting to see what my RFE is for because I only sent the return with the W2, I am only guessing they needed the transcript but it might be for something else all together....watching for the mail person to arrive...lol

    considering the fact that I failed to put proof that my joint sponsor was a citizen, it could have been that. But they asked for the returns. And I did send the transcripts. Lol I wish they would not be so vague

    Hi Royo1 :) Yes, you will need to show proof of income, which is the W2. If income and assets were used, you will need both the W2 and proof of assets. Additionally letters from employers and pay stubs also support the current income requirements of sponsors.

    My joint sponsor thinks I don't need w2 if I have transcripts. :( :(

    (1) Federal Tax Returns .

    Each sponsor must submit either a transcript or a copy of his or her most recent US. Federal individual income tax return (Form 1040, 1040A or 1040EZ), including all Schedules filed with the IRS. If the sponsor submits a copy of the tax return, he or she must also include copies of any and all IRS Forms W-2 and 1099 that reflect income used to qualify. The second note under paragraph 20.5(e)(2) provides guidance regarding what to do if a W-2 or 1099 is missing. Note, however, that it is not necessary to sub mit the Forms W-2 or 1099 if a transcript, rather than a copy, of the tax return is submitted. State or foreign income tax returns are not acceptable; if submitted, they must be returned to the intending immigrant.

    The sponsor must submit with the Form I-864 the sponsors U.S. Federal income tax return for the most recent tax year (that is, the completed tax year immediately preceding the date the sponsor signs the Form I-864). USCIS may generally expect a sponsor, after April 15 of any given year (or April 16 or 17, in a year in which April 15 is on a Saturday or Sunday), to have completed his or her tax return for the previous year. If the sponsor requested an extension, the sponsor should provide proof of filing fo r the extension. If the sponsor did not file a tax return, the sponsor must prove that he or she was not required to file. If a sponsor should have filed, the sponsor must file retroactively and provide proof of filing. Note that U.S. citizens generally have an obligation to file a tax return on non-U.S. earnings even if there was no tax liability.

Royo, I will give you a link to a USCIS manual and even though it might be a little long, it is very good you read it all since it is very intuitive, more detailed and answers a lot of the questions we usually wonder about. It includes RFEs and how they adjudicate them. It is a manual to be used by USCIS staff.

    However from what I have read in threads here and in the manual, when you get an RFE, it is best to resend everything regarding the particular RFE or form because the adjudication is now done based on the new evidence not on the old evidence. So for example, if I forgot to include proof of my total current income and I get an RFE for it and I send in only a pay stub showing the current individual annual income, that would most likely result in a denial because the adjudication will be done on the new evidence which will be ONLY the pay stub. So in responding to the RFE, they recommend sending in - the form I-864, tax transcripts, pay stub and/or employment letter and proof of citizenship of the sponsor.

    That is why the letter tends to sometimes ask for things you've already submitted. But remember when it comes to the government, it is better to send more than less. They are paid to do that so let us give them some work to do lol.

    Regarding your case, I believe you should include everything regarding the form I-864 and the new evidence they are requesting. So perhaps the RFE was for the missing proof of citizenship, but please send in - the I-864 form, tax transcripts, employment letter and/or pays tubs showing current individual annual income and proof of citizenship

  14. does anyone know if i could still receive a biometrics appointment in the mail while my RFE is pending? I am here wondering the same thing!!

    It says online that on jan 24th they mailed me an RFE letter for AOS..still nothing in the mail...

    they initally received my AOS application on Jan 10th i believe. How long after they receive it do they send the biometrics appt letter?

    also, from people's experience and research, how long do you think it takes after biometrics to actually have the green card interview or EAD card mailed?

  15. So my rfe was for my joint sponsor. Try asked for taxes and w2 and proof of citizenship of my co sponsor. :( I did send tax transcripts and copies of the W2 :( now I am confused. Do they not accept tax transcripts? I thought it was just as good as a copy of the returns. The proof of citizenship I get. Somehow that missed me and I didn't send it. I also sent photo copies of marriage and birth certificate. Only now I am hearing this is not accepted. I guess I will throw in a few originals in there too. Phew!!

  16. I got my NOA1 on Jan 6, if I'm not mistaken and had biometrics on the 17th. Our appointment for biometrics wasn't supposed to be until Jan 31 but we did an early walkin and they let us. The office is 3 hours away and we were already there so we tried. I wonder if early walkin speeds anything up....

    I have heard that it does not but it's good to get it out of the way. Now it's up to them to hurry up and send that EAD. good luck!
