  1. So we have been waiting 6 months since submitting the adjustment of status package (we got married through a K1 visa).
    We did not submit the Application for Employment Authorization (I-765) with the Adjustment of Status package, because we honestly didn't know it was going to take this long to even get the interview.

    But can we still submit the Application for Employment Authorization (I-765) now by itself?

  2. That's what I was wondering? I didn't have a years worth of bank statements so I went to the bank and got a paper that showed my total withdrawals and deposits for the year as well as an overall balance, how long I've had an account etc etc. But I still don't understand where the $9444 is coming from. Unless that is the number I need after my income. But when I do the math that number doesn't add up, as it's supposed to be $10,272 in assets.

    It looks like they are looking for proof of your assets such as bank statement for the past 12 months, copies of proof of ownership of stocks/bonds, property appraisals, etc. What did you send to support your claim of assets?

So I felt like my case has been going so good so far until about a month ago when I got a request to send tax forms, ok it was my fault i apparently sent the wrong form, sent the new one back all was well. Now today I got another notice that requests additional evidence and that additional assests were needed.

    My income for the year was $16,239 and the 125% guideline requirement for 2 people is $19,663. At the time of submission I had a little over $26K in my checking account. With the additional money of my wife, which was a little over $17K. Being as I was $3,424 short for the 125% I needed 5 times the assets which would have meant I needed an additional $17,120. I just learned that now that we are married it is only 3 times the amount needed in assets which is $10,272. Over the last several months my checking account has gone down a bit with all of our expenses but even still we are now $11K over what is required, plus the money that is still in her foreign bank account. The notice we recieved says we need $9444.00 in assests in order to meet the 125% or aquire a joint sponsor. I am utterly baffled as to where this is coming from.

    Has anyone else had this problem? I've been reading a few other cases and some people seem to think that the money that is in a foreign bank account may not be being counted. I dont know what to do :( any help would be greatly appreciated.

  4. Consulates usually ask to see 125% income for the I-134 as well. You can make up the shortfall in assets (so, if you are short $1000, you need 3-5x the amount in assets, i.e. $3000-$5000), which it appears you have. Personally, I think it would be best to keep your job so you can get through the K1 interview and AOS without a co-sponsor.

    Recent timelines show AOS is taking anywhere between 6 months to a year.

    Ok but to file the I-134 I qualify as a family unit of just 1 as I am not married yet correct? So even at 125% I still make the poverty line. But getting married makes my family unit 2, which then makes the poverty line move up, which is where I don't qualify. So then cash can be considered as an asset?

Now that i've looked into the I-864 I'm seeing that it then becomes 125% of the poverty line and I dont think I will make the cut on that as I am just under that number, so at that point I would need a joint sponsor. So under a joint sponsor I would then be able to leave my job? We're close to 50k saved up at this point so really we wouldn't need anyones help money wise, just from a legal stand point.

    And about how long does it take for the I-864 to be processed/approved? I can't really find a timeline on AOS processes other than what needs to be completed for the packet.

  6. I was wondering, assuming we pass our interview, if someone would be able to tell me how long the petitioner needs to stay at their current job? Would I be able to leave my job as soon as my fiancé is approved? Or after we get married? After her green card is issued?

    I was hoping to leave my job in August and maybe take an extra month or two off, we have quite a bit of money saved up so it wouldn't be an issue money wise, but I don't want to just quit my job and it becomes an issue for her being here.

    Yeah that's what I have. So I assume that it is not normal for it to not be in the system by this point? It's been 5 days now since they mailed her the 3rd package. I guess i'll call the NVC back and confirm the ID # for a 3rd time. Maybe have her email the embassy to see what's up.

    I was under non-immigrant visa, but even under immigrant visa it just says "your search did not return any data" :/ I wasn't sure if it was supposed to be immigrant or non-immigrant, so I googled it and it said a K-1 visa was non-immigrant so that's where I've been going. But I've been trying both daily.

  9. So I called the NVC and got my case number and it wasn't working on the CEAC site. Called back, the woman told me that's because the embassy had not recieved our case yet. It has been 2 weeks since it had left the NVC and finally I had my fiancee email the embassy to see if they recieved it as i've been putting our case number in on the CEAC site daily to see if they had recieved it, and when she got the reply it said that it had been recieved and package 3 had been sent out on Monday. Is this normal? She lives in Portugal but their embassy doesn't process visas anymore so the case is in Paris. The non immigrant visa section has the location option but I dont know if i should be clicking France, Paris or Portugal, Lisbon. I assume its France as that's where our case is but no matter what I click it gives me an invalid application ID or case number. I got this case number from 2 seperate people so I don't think its the wrong case number. Should I just wait for it to show up in the system or should it already be in the system as they've sent the package already.

Hi I was wondering if someone could help me out with this my fiance is a portuguese citizen and we will be going to the Paris embassy for her interview as they are no longer doing those in the Portugal embassy. Anyway according to the Paris embassy website "Each applicant is required to provide a Chronopost envelope (2 kg) 25x36cm for the delivery of his or her visa by mail. Those resident in Portugal must purchase a Chrono Express European Union (2kg). Envelopes can be purchased at La Poste in France."

    I don't speak French and my fiancee's is limited but she said the only envelope that seems to fit this request, is not really an envelope but a box (http://timbres.laposte.fr/af/bv/core/content/content.do?channelId=-33621&contentTypeId=0&return=true&contentId=118032&displayChannelDesc=&numPage=2&critAffinPersist=&nbItems=)

    Can anyone that has been through this process confirm if this is the correct 'envelope' and if we can buy it online through the laposte.fr website or if it is only possible to do so in an actual physical post office in Paris?
