  1. Hello I am going to file my I-751 by the end of march and I would love to hear from you guys ... I went to an immigration attorney to file Petition to Remove the Conditions of Residence, he said its going to be around 2.000 till 3500 $ so I found this website and decided to do it with my wife together since we got all the information needed thanks to people like you ...

My question is: I want you to give me your opinion about the evidence we have:

*Copies of the passports and green cards of Husband

    * Three sworn affidavits by U.S. citizen friends, attesting to our relationship and marriage.

*Copy of the tax statement for 2011, 2012 and 2013, which we received for our checking account at Partners Federal Credit Union Bank.

    *Copies of car insurance notices.

*Copy of the 24-month residential lease for our apartment, covering the period: 09/01/12 to 08/31/14.

*Copy of husband's drivers' license and copy of wife's state ID card, issued 00/00/00, showing joint occupancy at our apartment.

*Copy of joint checking account statements showing Direct deposite from both jobs mine and my husband.

*Copies of Utilities bills (Electricity & Bright house Network)

*Copies of Shared phone line contracts.

*Copies of credit card having my wife as an authorized user Amex.

*Copies of dental insurance my wife and daughter as beneficials.

    * Copies of health insurance ( I had it but it has been canceled because my wife quit disney ...now I cant have one since my job provide me with one but sadly im.gonna have it till.the end of April and its gonna be late by that time.

    * Pictures.

    * Child school records showing both parents involvement.

    * Tv and forniture bills.

    *Cards.

    * Walgreens medicines card.

*My disney pass has her name as a beneficiary.

*Her universal studios Pass shows me as beneficiary.

Anything I can add or remove thank you guys ....

What about Federal Income Tax Returns? Tax statement from your bank isn't enough.

  2. sounds like something got lost in the mail. The extension letter should be the first communication you received from USCIS. It basically confirms that they received your packet and payment and allows you to relax knowing however long it takes them to process, transfer, request info etc.. on your case your residence is still legally extended. They would have sent that within a week of mailing your packet and before transfering your case.

    Infopass is the right move.

  3. Nah, don't think so. Your GC will expire ten years from now with same day/month as the initial issue of the conditional GC.

which is why it doesn't really matter for ROC when you get approved, be it 9 days, 9 weeks or 9 months etc, You will still be able to file N-400 90 days before 3rd anniversary of being a PR (i.e initial conditional GC issue date +3 years - 90 days)

    The card will read:

    Card Expires: 2/20/2024

Resident Since : (date of initial card issue)

That's how ours just arrived. We can still apply for citizenship 90 days before the 3rd anniversary of initial entry to the US. But the actual green card will be valid for 10 years after the date that the new card is ordered for production.

  4. It took 5 months and 20 days from the day we mailed out our I-751 packet to the day we received both cards in the mail.

08/30/2013 Mailed I-751 paclet to VSC (wife and son joint)

    09/05/2013 NOA1 extension letter received

    10/07/2013 Transferred to CSC

11/12/2013 Called and requested Status Inquiry as to why no biometrics appt had been sent yet

11/21/2013 Received response to Status Inquiry with wife's biometrics appointment for 12/13/2013

12/10/2013 Walk-in Biometric completed (wife only)

12/23/2013 Received NOA of Approval for both my wife and son!

1/23/2014 Post-approval Biometrics appointment for my son

2/10/2014 Called and requested a Status Inquiry as to why production of our green cards have not been ordered

2/12/2014 Received notice that production of both cards have been ordered

2/18/2014 Received notice that the cards were mailed plus tracking numbers

    2/20/2014 Received cards

I was surprised to find that the cards don't expire until Feb 12, 2024 (10 years from the day the new card production was ordered). I thought they would expire 10 years after our initial entry.... nice surprise. So the silver lining at least for those who have had to wait a little longer is that the card will be valid fot that much longer.

  5. Finally got notice today that my wife and son's green cards have been ordered for production and should arrive within 30 days. We were approved on December 23rd but things seemed to stall after we received a post-approval biometrics appointment for my 8 year old son. I called and asked to speak to a tier 2 immigration agent 2 days ago. She was amazing and very sweet. 2 days later, bam, cards ordered for production.

For anyone who feels that their case is stalling or nothing is happening, I can't recommend strongly enough that you call the USCIS information line and politely ask to speak with a tier 2 agent (after politely allowing the tier 1 operator to give you the same information you can see on line). Even if the wait is longer than 2 hours, just leave your callback number and they will usually call you back sooner than the estimated wait time. Twice in our process things seemed to just stop dead, but after speaking to a Tier 2 immigration agent and having inquiry requests made the results were almost instantaneous.

12/10/2013 Walk-in Biometric completed (wife only)
12/23/2013 Received NOA of Approval for both my wife and son!
1/23/2014 Received a post-approval Biometrics appointment for my son... uggh
2/10/2014 Called and requested a Status Inquiry as to why production of our green cards have not been ordered.
2/12/2014 Received notice that production of both cards have been ordered and should arrive within 30 days.

  6. Even though we received our approval on December 23rd, we just recieved a biometrics appointment notice for my 8 year old son. We all went together for my wife's biometrics in December and were told he did not need it because he is a minor. Well now I guess he does before they'll produce the new greencard. Another vacation day burned, another schoolday missed and another 2 hour roadtrip in western NY during blizzard season.... Ugh

  7. jross, what did you write on the cover letter, if I may ask? Did you use your wife's new name or the old name? I'm inclined to use the new one (as I should, since it is now legally my name), but almost all my evidence shows my old name, including my passport and of course my conditional GC. Should I just use my new name, and mention that the evidence shows the old name?

    Thanks again for your help!

    Eve

    Here's what I had sent:

    Dear Madam or Sir,

I am jointly submitting Form I-751 with my wife Haydee (A# xxxxxxxxx, SS# xxx-xx-xxxx) and son Cesar (A# xxxxxxxxx, SS# xxx-xx-xxxx). In conjunction with the Removal of Conditions on Residence we would like to take this opportunity to request that both Haydee’s and Cesar’s surnames be changed to XXXXXXX on their new Permanent Resident Cards (through our marriage and through Cesar’s recent adoption). I have included copies of our marriage certificate and Cesar’s adoption certificate with this petition.

We recently attempted to change Haydee’s surname to XXXXXXXX at the local Social Security office earlier this year with our marriage certificate. We were told that we must first have her Permanent Resident Card updated with the new surname before they could change the Social Security Card surname. I called the USCIS information line to receive instructions on how to do this and was instructed to simply use the new surname XXXXXXXX in the subsequent I-751 filing and to write her original surname “XXXXXXXX” in the “Other Names Used (including maiden name)” section. I was told to include a request in writing for the name change (this letter is that request). Haydee’s new full name will be HAYDEE XXXXXX XXXXXXX.

On August xxth the full adoption of my son Cesar was completed at XXXXX County Surrogate Court here in XXXXXX, NY. Through the adoption Cesar’s surname has been changed to XXXXXXX and is now being processed by vital records in New York State. A new birth certificate will be arriving soon. We’ve written his current surname in Form I-751 as XXXXXXXX and would like this to be the surname printed on the new Permanent Resident Card. Please note that the surname on his original Permanent Resident Card is “XXXXXXXXXX”. Cesar’s new full name will be CESAR XXXXXX XXXXXX.

    Respectfully,

  8. We did the name change via our I-751 as well and it worked out fine. We also did not change her name on the marriage cert so it's ok. It sounds like SS and DMV vary from state to state because we were not permitted to change the name on SS until they had some documentation from USCIS that the name had been changed in their system first. They did finally agree to change both once we brought in the first NOA and biometrics appt forms which showed the new married name.

We did attach a cover letter requesting the name change as well. Not sure if it's necessary, but it's what we did and it all worked out well.

  9. just an FYI - Don't worry if your case status online still says 'initial review' or if you didn't receive any email updates recently. Just keep checking the mailbox. My online status STILL says 'initial review' even though the NOA of approval we received in the mail today says that the decision was made on the 23rd. Still no emails either.

The approval NOAs basically say ''Congratulations, your petition to remove the conditions on your permanent residence has been approved...... Your new card will be mailed within 60 days.''

Good luck to everyone still waiting. It looks like early september filers are well into the processing window now so it shouldn't be long for many of you now...

  10. Hello everyone. I've been following along with all of you for a few weeks now and decided to join in yesterday. My wife and son are going through this too. I'll add our dates to the list. More specifically, here' s what we've done since filing.

08/30/2013 I-751 mailed to VSC (wife and son joint)
    09/05/2013 NOA1
    10/07/2013 Transferred to CSC
11/12/2013 Called and requested Status Inquiry and also scheduled InfoPass
11/19/2013 InfoPass appointment (received referral for walk-in Biometrics)
11/21/2013 Received response to Status Inquiry along with biometrics appointment attatched for 12/13/2013 (wife only)
12/10/2013 Walk-in Biometric completed (wife only)

I'm concerned about not having my son (he's 8) get a biometrics appointment. He's on the same joint I-751 as my wife's but he did get his own NOA for the transfer to the CSC from the VSC with a different EAC#. On the original NOA after filing the I-751 he was on the same EAC# as my wife (as a dependant child). I guess we'll see if we have to go back (It's an hour and a half drive for us to the local service center).
