Question about household size:
My wife has a child (16y) from her first marriage who is living with his father in US (from 2013). So in house hold size...do we put 2 or 3?! It is kind of important for us, because we will use assets for I-864.
-
Oh great...I've overlooked this under the rules....
-
-
Hmm if we use assets, for how long the money have to be on USA account? We are planing to buy a house after moving to the US.
-
Questions about the evidences (beside marriage cert.):
- For example at our place, utilitiy bills are always on the one name (cant add)
- owner of the flat where we are living is my mom, so we doesn't pay rent.(cant add)
- For calling each other we use viber (there is no call log possible - cant add)
- Chat logs are in croatian language (we are both speaking that language)...there is to much for translating to english ?!?
- Ok, we do have the same living address and we live together in cro . Legal certificate that I am living at address in croatia, because I am slovenian (just 40km away from cro). Is this certificat and copy of her document with that address enaugh to prove that we are living together?!?
- we have joint account (credit card) in Slovenia because I work there and my incomes are higher...?!?
- car insurance policy is on both names?!?
- hotel bills...
- plane tickets...
- pictures,....
?!?

Answer from IRS about this topic:
If your fiancee was single or is single and the maximum salary she has had over the past few year never exceeded $ 6500, then she she does NOT have to file a tax return because the minimum level requiring a tax return in her situation is $9750 for the year 2012 and a little bit less each preceeding year.
For general information, I am attached a copy ( i.e. portable document file ) to this email of IRS Publication 54, Tax Guide for US Citizens. It should be read carefully.
2nd answer from IRS when I've asked about tax transcript for i-864:
If you are NOT required to file a tax return under IRS rules, you are NOT required to file anyway because of an immigrant visa request in process or in progress. ALL that is needed is for her to tell the agent she did not file IRS returns because she not supposed to file due to her low income level and the fact she is below the official IRS filing requirement. Also, she should print the following pages from the IRS Form 1040 Instruction Booklet and provide them as proof. I am pasting them in below after the closing. Thank-you.
The amounts above which one was required to file ( and if below do nothing ) are: as pictured below:
2012 $ 9750
2011 $ 9500
2010 $ 9350

@NLR: thx for replay...
thumbs up for you guys cause answering, maybe on the one and the same questions all the time:)

Just info about IRS and tax file if you are single and your incomes are less than $9.750.

@NLR....I have to find forum about that topic at my place:)
Who is processing extra proofs about marriage (joint bank acc,etc....)...USCIS with I-130 or at the final interview?
-
hmmm interesting....my wifes parents also haven't been at our weding, because they don't speak for years (...not fill for visa yet)
-
As I understand you don't need official translate proofs like bank account, etc
Birth certificate and marriage certificate has to be translated by an official translator...Am I right?
-
-
-
Have some more questions. I know that marriage certificat, birth cert have to be translated to English.
For evidence we also have:
- joint bank account here in my country
- both names are on the car insurance policiy
- etc,....
Are these paper have to be transleted to English for I-130 too, or is it enaugh just to append copys.
-
Huh....more paper work:/
Grrrrr...what she was thinking....

Hi every1
Now I was talking with my wife about taxes. She has US and Croatian citizenship. As she work in Croatia for last 10 years she is paying taxes here as all croatian do.
At the embassy they never told her that she must file tax report. Now she is confused.
What to do now with I-864?
I know there is still some time to get to this point, but anyway...

Hmmmm not so good news. I was planning to call US embassy in Slovenia for DCF.
My wife's son (from first marriage) is going to school in the US (high school first year) and we planning to start new life somewhere till end of 2014.
-
Oh, ok....I understand it....hope so:) if I will have further questions i will post them here:)
Thx for now.
-
Ok, but some said that foreign income doesn't count?!?
-
Thx for all the tips:)
-
Oh ok, we have family in the USA, np.
About I-130, address of petitioner (my wife). This is US address or address where is she/we living now?
About I-864, as user @mimolicious said before, we will need "joint sponsor" because my wife has no income in the USA. I looked the I-864 and now I don't know if my wife has to fill something or just "joint sponsor" (someone from family) fill it?
-
thx NLR
Maybe I have one more question. Because we live and working in EU we have to send form I-130 by the post. How about paying the fee? Where to pay? I assumed that with i-130 we have to sand the confirmation that we pay the fee....hmmmm
I am apologize if these questions have already been answered somewhere:)
-
Thx.
It seems that we will have to ask her relatives to sponsor me, because we are living and working in Europe together. She is here for almost 11 years now.
Btw, should the US embassy here help us if we have some questions about filling the formulars?
