  1. hi. im the Us citizen petitioner and my wife is scheduled for an interview at Islamabad embassay next month. i would like to onow if i should attend the interview. what kind of questions will they ask my wife. because after the marriage ive never been to pakistan in about 8months

    any advice will be highly appreciated

  2. Please bear with me, as I'm writing on behalf of a family member.

    1 year ago yesterday, she got married. She was a couple of months pregnant at the time, and they now have a little baby girl. It has been an extremely hard year for her, as he has been cheating, has been mentally and verbally abusive, and has begun to become physical as well.

    She has not filed for AOS because he refuses to sign. He has thrown her paperwork in the trash, has said he will never sponsor her, and wants her to be deported so he could keep their daughter.

    Is there any way to still file for AOS without his signature? Or somehow get a kick start on things?

    yes it is possible. there is something called vawa. look up i-360. it only applies if u had abusive relationship. if you go this route you dont need any sponsorship or i864 affidavit of support. all you need is a marriage certificate. some evidence of abusive relationship and you can get your green card in 6-8 months

    Yes i am sure. I have to wait. I dont want to give up on my marriage yet although the abuse is getting worse every day. Hope my husband will change. Thanks.

    As per my understanding of the law and the recent update to uscis policy manual you are eligible for Naturalziation under 3 year rule if you separate from your spouse after filing N400. you can take a look at comprehensive citizenship and Naturalziation Guidance. I'm in a similar situation like yours and i did extensive research and will be going to interview with an Attorney. This change was made last year and not too many people know about it. I would take an attorney with me to the interview. Below is the highly from that manual.

    Part G: Spouses of U.S. Citizens
     Consolidates and provides up-to-date guidance on the naturalization provisions for spouses of U.S. citizens residing in the United States and abroad, to include conditional resident spouses who may naturalize prior to filing the petition to remove the conditions on residence.
     Clarifies that while spouses are required to live in marital union with the citizen spouse preceding the filing of the naturalization application, only a valid marriage is required from the date of filing until the time of naturalization.
    Clarifies that USCIS calculates the early 90-day filing period for spouses in the United States by counting back 90 days from the day before the applicant reaches three years as an LPR.

    B. Living in Marital Union for Spouses Residing in the United States

    The spouse of a U.S. citizen residing in the United States must have been living in marital union with his or her citizen spouse for at least three years immediately preceding the time of filing the naturalization application. This provision requires that the spouse live in marital union with the citizen spouse during the entire period of three years before filing.

    However, the statute does not require living in marital union for the period between the date of filing the application and the date of naturalization (date applicant takes the Oath of Allegiance). The corresponding regulation conflicts with the statute in stating that the spouse must have been married with his or her citizen spouse for at least three years at the time of the examination on the application, and not at the time of filing.

    USCIS follows the language of the statute in requiring marital union only up until the time of filing.[4] Accordingly, only the existence of a legally valid marriage is required from the date of filing the application until the time of the applicant’s naturalization.[5]

    A person who was a spouse subjected to battering or extreme cruelty by their citizen spouse is exempt from the marital union requirement.[6]

     Clarifies that USCIS calculates the period of qualifying employment regularly stationed abroad for citizen spouses from the time the applicant spouse properly files for naturalization.
     Clarifies that the period of good moral character for spouses of U.S. citizens employed abroad is at least three years prior to filing the application until the time of naturalization.

  4. Hello N-400 filers.

    Fellow October 2013 filer waiting on interview date (in-line for interview).

    I have a simple question and would be thankful for any response(s).

    If I relocate within the same state I filed my N-400 (while my application is in-process), is this OK? I understand relocating to a different state can cause problems.

    To be more specific, I started a new job several weeks ago but my commute is quite long. Thus I'm thinking of relocating and residing closer to my work.

    My current N-400 address, place of employment, and desired relocation address are all within the same state.

    Could this relocation (if it were to happen), disrupt my application?

    @mtor_signaling, changing address might delay your interview date, but I was you instead of changing the address I would do mail forwarding which only cost $1.00 and all of you mail will be transferred to your new address. You can notify the USCIS about change of address during the interview and change it there to void any possible delay.

  5. So, I have a question. I filled for my 10 year Green card and back in July of 2012 didn't hear anything from the immigration till may of 2013 when I got RFE. I send all the paperwork within 45 days. Then called in September...nothing. Went to the local field office to get one year extension stamp in my passport, everything went good. Week after that i mailed my N-400 since I was eligible(3 years married to US citizen). Now I'm just waiting on what is going to happen next. Is there any way for me to check on my status? Im a little worried, since I never received 10 year GC, never hear from vermont back. Is anybody in the same boat?

    @ KseniiaSeaton, don't worry about it. I also applied for N400 during the first week of October and haven't heard anything back. I called the 800 number and was informed that my file was recently transferred to Local Office and i will be scheduled for interview soon. By law, Uscis have to schedule you for interview within 6 months otherwise you can file a lawsuit. I would advice you to call the 800 number and request to be transferred to Level two Officer. They should be able to provide more information regarding you case.

  6. Adding myself to the list. I received yellow letter on 11/26 to bring 3 years Tax return. My Online Status still says "Initial Review".
