  1. Hi

I have an urgent question. please help me!

My husband filled I130 application for me without his green card included. since he has lost the green card and he had open I90 case on that. we only put the I90 NOA1 which includes his case number. recently he finally got his green card.

my case is still under process in Vermont and i had only received NOA1 . Do anybody know if they will reject our case due to lack of this document.

should we send a copy of green card to VSC now before decision is taken ? or will they know that my husband has a complete case for green card ( by accessing and checking his case number )? .... So complicated!

Thanks in advance for helping me .

    Salam Maliheh,

This is just a guess but if I was in your situation, I would immediately submit a copy of Green Card with a letter explaining the details. Don't wait for them. They don't do anything other than what they were told. If for any reason they reject your case for the first time, you would need to wait another 6-7 month to get the decision.

SO DO IT NOW otherwise you will regret that later on.

    Good luck.

  2. I think technically he was in AP for one day (the day following his interview), but he left the embassy knowing that he would have a visa. He told me several other Iranians were immediately approved that day too (though the others were all women), so I don't know how strict those guidelines are.

Thanks for your responses. I'm Iranian too but I was given my passport back. He has probably dodged the AP since I haven't seen APs less than 3 weeks. They told me to wait 1 to 3 months. No Idea why. My profession is not sensitive to their guideline and I submitted two police certificates for Sweden and Germany as well.

The visa officer said everything was OK but they had to do AP.

  3. My fiance's interview was in January, but no AP. Kept his passport and visa issued 5 days later. What's a "T" country?

Lucky him. T counties refers to Terrorist countries on this website if I'm not mistaken. But it's a misnomer since not all of them are considered "Sponsor of Terrorism" by United States.

Applicants who are citizens of, born in, or have some strong connection to one of the following countries (often referred to as “the list of 26”) are also subject to an SAO:

Afghanistan, Algeria, Bangladesh, Bahrain, Dijbouti, Egypt, Eritrea, Indonesia, Iran, Iraq, Jordan, Kuwait, Lebanon, Libya, Malaysia, Morocco, Oman, Pakistan, Qatar, Saudi Arabia, Somalia, Sudan, Tunisia, Turkey, United Arab Emirates, and Yemen.

Among those, Cuba, Iran, Sudan and Syria are currently on the DOS State Sponsors of Terrorism list and AP is necessary.

  4. Official info about 221g pending cases, the wait time is listed as 60 days for this

    Refused Pending Administrative Processing

Some visa applications require further administrative processing, which takes additional time after the visa applicant’s interview by a consular officer. Applicants are advised of this requirement when they apply. Most administrative processing is resolved within 60 days of the visa interview. When administrative processing is required, the timing will vary based on individual circumstances of each case. Visa applicants are reminded to apply early for their visa, well in advance of the anticipated travel date.

When your case is pending administrative processing, you can check the status of your case online.

Use your CEAC barcode or case number and the location where your interview occurred to check the status of your case. Click on “Check My Visa Application Status.” If you received a 221g letter or were told your case requires further “Administrative Processing” this system will let you know if your case has been approved, requires more information, or is still being processed.

Thanks. I knew this way before they put me on AP and I'm checking my status every 5 minutes :P.

  5. They ask for travel/work abroad history because they want to determine if you need to get a police clearance/certificate from that country.

If you lived/worked outside your home country for 12 months or longer, you need to get PC from that foreign country.

Thanks, but I have already submitted two Police Certificates for where I have lived more than 6 months. Actually they asked me to do so at NVC stage. This is asked by consulate which I think what @Gegel said is more relevant here.

  6. Do you have previous passports? Your passports would have the immigration or visa stamp of the countries you have visited. Take those passports and a copy of those pages with the immigration/visa stamp with you to the interview.

I have all of my passports showing the travels I had. I also have all the documents for the trips that have not been marked in my passport such as Boarding Pass, Tickets, Hotel reservations etc. I will have them with me for interview. Hope it goes smoothly and thanks for your reply.

  7. How are you not still Iranian?

Never said I'm not. I am still.

It does not mean you will be placed in AP necessarily. Depending on your profession, previous/dual nationality and other factors they may wish to now where you have been etc... As you pointed out you are/were an Iranian national you may be subject to further scrutiny.

    Good luck!

Thanks for your contribution. Appreciate it.

  8. I didn't do them myself anyways...I have an attorney who's supposed to make things faster but I'm just unlucky sad.png

I have talked to many guys who had attorney for their cases. But I must say, attorney is absolutely GARBAGE and just WASTE OF TIME. They do nothing that you as a direct beneficiary cannot do. I'm assuming that's why you have waited this long for your case. Thanks to VisaJourney and everybody who contribute here, you can find all the necessary information to move your case forward.

  9. Yes, I know, but for example, you have PD 28september2012 and you have had you case complete on 30december2013. In my case i have a PD 13february2012 (in advance of you) and wait yet for CC, from my PD I have had to wait 21months for get approval..

CC has nothing to do with Priority date. You got stuck in USCIS for so long. That might have been due to USCIS backlog at the time you applied or lack of documents in your initial I-130 form. The NVC process is quite equal for everybody in same visa category. Even if you have PD of 2000, you still need to wait at least three weeks. Some people have PD in 2013 and now they are in US.

  10. Sorry i meant to say approval notice.... N yah i am hoping for that. ... I know someone else who filed 3 monthes after me he got his wife here n i asked him how long it took u to get IL after CC.. He said about 3 weeks..

It really depends on the time of your CC. In your case, everyone who got the CC email from January ~20 up to Feb ~16 (with few days margin) will get their IL next week. So you have waited almost 5 weeks but, for instance, the guy who got the CC on Feb 10 has waited 3 weeks. There is almost 6 weeks window here and it depends where you fall into.

  11. My case should have been completed by now n my husband should have been here bt it was uscis who messed up cuz my case was approved in jun2013 n got interview letter saying that they will forward my case to nvc in 3-4 weeks n they did not .... They kept my case so i am already delay .. ???

That must have been just a "notice of action" and not an interview letter. For me it took over 4 weeks to get into NVC. What is your priority date?

  12. Hi all

Just an FYI, my case was complete on January 23rd 2014 (according to NVC) Case Complete (CC) email arrived January 30th 2014. I have just spoken to NVC today (February 20th 2014, 15:10 EST) and they informed me I have not yet got an interview scheduled, when asking them if they generally get scheduled towards the end of the month, they stated there is no general time frame and is dependant on availability at the Embassy at the time. They also recommended that I await the Interview Letter (IL) before booking the medical exam.

Not sure what this may mean to anyone else but if it helps at all, then great.

    Either way, I still wait

I called them many times and they said the same thing but the reality is that they do schedule the interviews end of each month. Normally the last three days. Most likely you'll get your IL end of next week. I even called them on the day that I got my IL and they said no interview yet but later that night, I received the email.
