Hey Folks,
I am just wondering if anyone has experience traveling from Colombia with expired GC and with I-797?
I know now my wife will be legally accepted here with card and letter but just want to make sure Colombian Airlines recognize her ability to return to US with that letter.
Thanks!

1. Yes you'll receive a card valid for 10 years upon approval of I-751.
2. No you can't it's too early to file and will be rejected. The earliest you can file to remove conditions is 90 days prior to the expiration date on your 2 year resident card, but must do so before the card expires.
3. No it doesn't void your status. You'll be issued an extension letter upon receipt of your I-751 application, which extends your status for 1 year authorizing travel and employment while being processed. This letter together with your expired card is suffficient proof.
4. Unfortunately it's not from the days of living in the U.S. It's actually from the day she became a Lawful Permanent Resident as written on her resident card. Your wife will be eligible for citizenship earliest 90 prior to her 3rd anniversary of being a permanent resident. That should be sometime in April 2018.
Thank you!! I really appreciate your help. That's good news about the travel.

Hello Fellow Vjers,
As the time comes for my wife to renew her Green Card (it expires in August) I have several questions concerning the I-751 form that I believe is the one we need to fill out. My wife came on the K-1 visa and we were married within 90 days and then it took about a year to finally receive her green card. My questions are the following?
1.) If approved for removal of conditions, would we then receive a green card that last 10 years?
2.) Can we start the application process now even though it's 6 months from the expiration date?
3.) If the current green card expires and the other has not been approved yet, does that prevent us from being able to leave the country?
4.) Lastly, if we were married in June 2014 and my spouse at the time lived in the US but did not receive her green card until July 2015, must we wait to apply for Citizenship until after 3 years of having the green card or can it be after 3 years of her continually living in the US? (its pretty frustrating that it took over a year for her to receive her GC :/
Thank you in advance for your help!!

Hey Folks,
My wife's sister and brother in law who live in Colombia are wanting to come visit this summer. They are both School teachers in Colombia and so they have very good proof of ties to their home country. I have heard rumors that it's important to have a somewhat substantial amount of money in the bank when you go for the Consulate interview. Is this truly a factor, and if so how much is a substantial amount?
As for everything else, they have no criminal background and no other experiences requesting visas.
Thanks you for any help and advice you can give!
In the journey together,

Hello Vjer's,
I am wondering if my wife and I should be worried that we still have not received her Green Card.
My wife came with a K-1 visa and we got married June 2014. We filed for AOS in August and everything was received on August 13th. In November she received her EAD and then on Dec 11th we got a notice saying that it would take longer than normal to process the AOS application and that if we didn't get a response by June 11th that we should call. So we did call a couple of times and they told us just to wait. Then on July 4th we received an RFE (though they sent it to the wrong address even though I updated our address on the USCIS site in May!!!) saying that we did not sign my wife's G-325A. I have not sent that back and it was received on Thursday.
How long should we have to wait now? Should we file a service request to speed up the process? Has anyone else been waiting an entire year?
Also, we got the letter from Norfolk, VA and we live and have lived in Louisville ever since we applied. Why would our petition not be at the Louisville office?
We are planning on traveling back to Colombia in November but now we are getting worried that we may still not have the GC!!
Any and all help is greatly appreciated!!
Thank you in advance,
Mitchell

On what form ? Did you forgot to sign the EAD form too or just the g325a you were RFE'ed for ?
An RFE will not 'deny' the EAD, only a denial of the I-485 will invalidate the EAD also.
No we just forgot to have her sign the G325-a. We got her EAD like 8 months ago and I guess it took this long just to find out we forgot a signature. I'm hoping once they get it they will be ready to approve but I am slightly concerned that our case appears to be in Virginia and not Louisville.
-
Also shouldn't my wife's EAD been denied if we did not have a signature on the form?
And any idea why we got the letter from Virginia if we live in Louisville and have since we applied? Would our case be processed there or have they just not forwarded it yet?

Thank you all very much for your help!

Hello Fellow Journeyers,
After waiting more than 11 months to hear a response for my wife's green card we received a Request For Evidence letter. I have a few questions about it and would be extremely grateful for any help! We were requested to send in the G-325A the biographical information because we had forgotten to sign it!
1. Do we just need to sign the original and send it in or do we need to update the form with new employment and address etc. and send it in that way?
2. Do we need to put a cover letter or just send the form in as is?
3. Anyone have an idea how long after it may take to get a decision?
Thank you for all your help! Visajourney is a thousand times better than the incompetent workers at the USCIS customer service helpline.

Hello Vjers,
I have a question concerning the affidavit of support that we signed so that my now wife could come to the US with a K-2 visa. From what I understand, by signing an affidavit of support my wife is not eligible (for the time being) to receive food stamps medicaid.
But what about subsidized insurance? Since our combined incomes are not very high and we qualify for an insurance subsidy, could this negatively affect her green card application?
I would absolutely hate to do something wrong and prevent my wife from being able to get her Resident card. As always, all the help is greatly appreciated!
Thanks,
Mitchell

Hello fellow journeymen,
So we will soon be sending in piles of paperwork in order to apply for AOS (oh and of course the miniscule fee of $1,000). Hopefully all this will go through with no problem.
I had a couple of questions about my wife´s current immigrant status. What is her immigrant status now until the AOS is completed? Does she have temporary residency for 2 years?
We are looking into her taking college classes here at a community college in Louisville, KY. Is it 100% necessary for her to be a resident to do so? Does anyone else have experience in this? I feel like maybe many institutions are not used to dealing with immigrants who come with a K-1 visa. Any tips or information would be greatly appreciated!
Thanks,

Hello everyone,
I have another probably rather simple question to be answered but I always feel more comfortable hearing responses from fellow VJers.
Apart from filing for AOS with the I-485, is it necessary to notify USCIS that the marriage has officially taken place within 90 days?
Or if we chose to wait to file for the AOS then could we just notify them somehow that we have been officially married? Thank you very much for your help!

Thank you all very much for your help!
Just one more question. I had to have my mon be a co-sponsor for the previous affidavit of support. If I do not reach the guidelines will I need her to be a co-sponsor again?
-
Hello everyone,
My wife has now made it to the US and we have officially married.
Now that we are going to apply for AOS is it necessary to fill out another I-894 Affidavit of Support? Or can we use the same ones we used for the I-129f?
Also is a certified marriage certificate copy necessary?
Thank you all very much for your help!
Blessings,
Mitchell

Hello everyone,
So after a long time of waiting my Fiancee was finally ready to travel back to me to the US after getting her K-1 visa. As we were in the airport today they told us that she cannot travel unless she has the sealed manilla envelope THAT THEY SHOULD HAVE GIVEN HER at the embassy the day of the interview
They only gave her a few medical documents including a lost of the vaccinations and lung X-Rays. The day of the interview my fiancee took the manilla folder that they told her not to open and she gave it to the person working at the consul. They DID NOT return to her the envelope.
Has this happened to anyone else?? What can we do? Is it absolutely necessary to have that envelope when entering?
We are currently in Bogota since we missed all our flights today. Please let me know what we should do! Thanks!

Thank you all very much for your help. I will definitely look more into Obamacare and maybe just call some insurance companies to say what possiblities there are.
Again, thanks for taking the time to respond and help!

Hello everyone,
I was hoping to find out information about medical insurance for my Fianceé that is coming in May. Although my work will offer her medical insurance, it is at a rediculous price!
What would be the options for my fiancee to get insurance? What about Obamacare? Must we be married before she can apply?
Thank you so much for your help!

Hello fellow journeymen,
My fianceé has now finally received her K-1 visa from Colombia and we are thrilled. We have tickets purchased for her to come through Miami in May. I will be with her as well.
Is there anything she should know when going through customs? What kind of questions may they ask her? Should there be any problems whatsoever?
I'm sure some of you have probably gone through this already so any help or advice would help.
Thanks!

Hello everyone,
I was wondering when my fianceé arrives to the US, will she be able to immediately be put under my insurance that I have through work or will she have to wait till after AOS? What rights will she have when she gets here before having her green card?
Thank you so much for you help!
-
Is it possible to start the process of requesting a work permit even before my fiancee has arrived to the US? This would obviously be seperate from requesting the green card.
Thanks!

Why are tax transcripts necessary when on the i-134 instructions it does not mention anything about tax transcripts nor w-2??
