I don't believe that you can have an extension for the I-751. If you and your spouse are still on good terms you could file together if you are still married. Or you will be put into deportation status after your card expires. I was told that if the divorce proceedings were not clomplete but started that you could explain this to the judge and at that time they might give you an extension. Good luck
Thank you for your answer. We can't file joint because I am moving out on Sunday and I'm sure that would look very suspicious to the USCIS. We will have filed by the time I have to appear before a judge so I will have the proof. I can't believe there is no other way that is unbelievable. I don't know what I am going to do if I get kicked out my whole life is here now I even signed a 1 year lease. Thanks again.

Hey Everyone,
I just recently found out that I can only file my I-751 after my divorce is final and I have the decree. Me and my husband didn't work out and are getting divorced we are still on good terms, just not right for eachother. My card expires on 06/17/2008 and if we start the paperwork for divorce right now it will take 5 to 9 months to get the decree(thanks alot Massachusetts) because this state is slow with these. What I need to know is if I can get an extension so that I can file when I do in fact have the divorce decree. I heard about a I-551 would that work in my situation? Any help would be much appreciated I'm pretty stuck here and my immigration lawyer is no help I will be firing him because I seem to know more then he does.

Unfortunately, you can't file for a waiver based I-751 until a divorce is finalized. If there's any chance you and your husband can work things out then the two of you could file the I-751 jointly.
If you're 100 percent sure you're getting divorced, then get one as soon as possible. The longer you wait the greater the risk you could wind up in removal proceedings for failing to file the I-751 in a timely manner.
OMG what can I do? Can I ask them for an extension? until I have the divorce decree?

I'm in a bit of a pickle. I have to submit my I-751 to remove conditions me and my husband are getting divorced and here is the issue I don't have a divorce decree and wont have one before my card expires because I am moving out right now and hes busy with stuff too so we are not getting divorced for a while yet. I hired an immigration lawyer and he is turning out to be useless I know more about this stuff the he does it seems. I need to know what I need to do and what I need to submit. I need to start this very soon I know I need a waver and I have proof I married in good faith we have an 11 month old child together and proof we lived together. I just really need help with this I think you guys can help me out more then this lawyer who is draining my money but not helping in the least. Also I have a home business will I have to include proof that I can support myself? Thank you in advance for any information you can provide me with.

Well, its as simple as the description of this topic, My interview is June15th Finally and i have all the required documents except the OF-169, on top of that i have no idea what it is and it says in my package that i must bring it with me.... Does anyone know what it is? and where i can get a copy? Thank you for your help

My case for Cr1 also got approved on March 7. I have yet to speak to a NVC officer and will try to talk on Monday or tuesday to find out. I wish that I get the interview for May end or early June lastest. It would be perfect for me.
Let me know if you get any news on 22 March and I will also let you know.

I called on Monday and I don't have an interview in April The guy at NVC told me to call back on April 15th, so now I wait. Kovil, let me know what you find out. By the way, which consulate would you be going to??

Looks like Montreal is doing interviews approx. 2.5 months after case completion. So you can HOPEFULLY expect an interview around the end of May.
OMG, that would be great if it was that early. I hope i dont have to wait as long as you chicken little thanks for your reply's.

Hello, My case was approved at the NVC on March 07th 2006, and i called on that date, and was told to call back on March 22nd for my interview date. Im just wondering when aprox can i expect my interview date will be? also i have a car, that i bought and do not owe anyone for except the bank which i will continue paying from the USA. What will i need to do to get my car down there? thanks in advance for your help

They do it at the interview.

Brunette, we got married July 2005 and started the paperwork in August 2005. We started it at the Vermont Service Centre. The NVC is now processing it. Sure hope it goes as fast for us as it did for you. Less that two days to approve it. How great is that!!

Well, I called NVC today, and the RFE was for the DS-230 part 2. My instructions make no mention of sending the part 2 and I did mention this to the guy that I spoke with. Supposedly, they send me the wrong forms. The forms they sent me were only for sending part 1 So to all doing the CR-1 through Montreal, send both forms

I called NVC yesterday to see where my application is at, and guess what? Supposedly, I have something missing in what I sent A letter was mailed out to me on Feb 15th, but I haven't received it yet. I can't imagine it being the DS230 part 2 when they instructed me to DS230 part one and the documents they asked for. StephieJoyce, maybe you should send both parts regardless of what they tell you to do. Will keep you posted!!

They sure know how to confuse people!!! I am applying in Canada and on my barcode instruction sheet, it says only the send DS230 part one and the documents asked for. Part one is the only one I sent. Sure hope I don't get a RFE for sending what they asked for. I'll just have to wait and see.

I called NVC a couple of weeks ago about another matter, and did also ask about the originals. The lady I spoke with did mention that I did need the originals. It also did mention to send the originals on the letter I got with the 230 form, so I did send the originals. I didn't want to take a chance.

You are right, MarilynP. NVC doesn't have a toll-free number. And as for the birth certificate, when i called NVC on the two different occasions, both people that answered my questions said that it was only me to send my birth certificate, and not my husband (USC).

I am doing a CR1 so I don't need to call the Montreal Consulate. I have to send my documents to the NVC. As I understand it, the NVC gives me the interview date. I was told to send the originals but I know that with the K1 visa you send copies. My mom is doing the K1 and has her interview on the 21st. Good Luck to you

Ok, I have more questions. I know that I have to complete both part 1 and 2 of the DS-230. Do I have to send both parts with my documents or do I just send part 1 and the supporting documents like it says on my barcode sheet and bring part 2 with me to the interview? Also, I got my police certificate in Montreal and it has a box on it that says "applicant signature" Do I also have to sign this now or just wait until the interview to sign it? I never saw it posted the you had to sign your police certificate. Thank you!!

I call NVC on Friday, and the lady told me I had to send my original documents and that I would get them back at the interview.

I called on Friday for the birth certificate and the lady mentioned that I only send my birth certificate and not my husbands. This is the second call I make about it and they both mentioned I only send mine.

Thanks for the info. Though I will call the NVC about sending the photocopies because in my instructions it says I have to send the originals and then they would give them back to me at the interview.

Thanks everyone. Another question... I know that you have to put your case number on all documents that you send, does that include your original documents? (birth certificate etc.)

I just found out I can't do that because my intent is to get divorced. What are my chances of getting deported if I wait until they make me see a judge if I have more then enough proof I married in good faith and the ONLY reason the I-751 was not filed is because i don't have the divorce decree yet?
