if you are not using income of your spouse to qualify then separate your income and enter it. In part 10 enter your income only, which you entered in part 5 if it is sufficient to qualify. if you include income of other family member, in that case family member also has to fill form i 864a unnecessarily.

pay AOS fee now. once the status shows as paid after which iv fee invoice will be available for payment.

after 2 months of i-864 submission received following checklist from NVC
In Part 6. Sponsor's Income and Employment, please correct the following...
[x] Item 10. The current annual household income must equal the sum of items 5, 6.c., 7.c., 8.c., and 9.c..
As per instructions household income is only required to be entered if individual income does not fulfill the requirement but in my case sponsor's individual income is much higher than required (as per poverty guidelines) so he is not including any other household member's income and did not enter any amount in item # 10. what should I do in response?
Any advice please!!

NVC has now removed the condition of original documents recently. you can therefore send only photocopies and take the originals with you at the time of interview. make two separate sets of documents for each of your parent and put them in separate envelops . write case number and name on the envelopes and mail both the envelops together by putting them in one big envelop.

NVC usually takes around 6 weeks to respond after receipt of case from USCIS. 7 months is a very long time. Didnt you receive any mail from them so far? you should call them at the given number or email them to check out.

After getting immigration your father has to stay minimum 6 months in US each year to maintain his residence. He can however get permission to live out of US up to two years by applying for reentry permit

I was on the same boat. my mom had been visiting US and had been issued multiple B1/2 visa twice. But ever since I moved to USA, she has been denied tourist visa thrice without any reason. same happened with my father. both my parents have very good jobs there. they have a lot of property and well established back in their country and do not want to get settled in US but after these refusals we all were quite upset. It meant they would never be able to visit and stay with me in US and this thought was quite frustrating. after discussing this issue with friends and family I decided to petition them for green card. at least they will be able to visit me once after which they can apply for reentry permit for two years. that way they would be able to maintain their green card for 4 years after which they may change their mind for settlement in US and if not they could return their GC. I think after returning GC, tourist visa for them shouldn't be a problem as the interviewing CO would be satisfied that they are not interested to settle in US and they would come back to their country after a short visit. you may try this if suits you. There is no other way.

It usually takes around 6 to 8 weeks by NVC to register the case and get back to you. in case of my mother NVC took 6 weeks to contact us after receipt of case from USCIS and in my father's case it took 5 weeks. you may wait for another week. Hopefully you will be contacted in a week or so.

Last month when I submit photocopies of all documents, NVC response is attached.

The above requirement is for original document. Either it should be original or certified copy which ever you possess. Means original or certified copy of an original issued by the relevant authority are same. For photocopy it can be the photocopy of original or certified copy. Hope its clear.

You have to send the photocopies of all documents but be sure that all the photocopies are attested by issuing authority. At the time of interview your wife has the present the original documents.
There is no such requirement to get the photocopies attested by issuing authority. Instructions are just to send photocopies and not the original documents.

Family reunification doesn't mean that petitioner and beneficiary should remain together all the time. I don't think there is such requirement that petitioner should be present in US when beneficiary reaches there. Other members having information may chime in, In my opinion presence of petitioner is irrelevant as long as the petitioner doesn't abandon his /her status as LPR or USC.

To my knowledge ticket in traffic violation does not come in citation. Stopping at airport and letting you go is not detention either. I dont think your answer should be yes. To be secure you should check with your lawyer, who is taking care of your traffic violation, whether it is citation or not.

Most of the members in this forum have shared that the AOS fee paid by them for one parent was good for both the parents and after payment of fee in one case the fee status in the case of other parent showed as PAID. I petitioned both of my parents in November 2013. my mothers case was approved and forwarded to NVC in May 2014 whereas the case of my father was sent to NVC in September 2014. I paid AOS fee($88) for my mom in July. Now NVC has raised invoice of AOS fee($ 120) in my fathers case showing it as NOT PAID. I checked NVC site under FAQ and it says that each case needs to be paid AOS fee except concurrent processing at nvc in the cases of USC petitioning spouse/child. I am confused and trying to call NVC for last three days but could not get through. There is always a busy tone at their end. I have contacted NVC through email but don't expect their response soon. I need advice of VJ members in this regard. What should I do?

my sponsor files tax returns jointly with his wife. does his wife needs to fill in form i 864a or only i864 would serve the purpose. if i 864 is sufficient then is it to be signed by both of them ie sponsor and his wife. i'll be grateful for early reply.

signed and also got it signed by 6 other people. there are only 35 signatures so far. it needs to be spread fast even to get 150 signs. the link has been posted on this forum quite late. all are requested to please sign it as it is a very serious issue. small children are separated from their parents. very unfortunate.

One AOS fee paid is good for both of them. you need to fill i 864 for each of them. each i 864 should have supporting documents. guide is available here http://www.visajourney.com/wiki/index.php/NVC_Process
