  1. According to your timeline, you entered US on 08/21/2014.

So today is 68 days since your first US entry on K1.

You are running out of time for K1 reissuance.

Have you contact the US consulate in your home country yet?

Take note that you have to redo medical exam, all the forms again to get the interview scheduled in very short period of time.

    9 FAM 41.81 N6.3 Reissuance of K-1 Visa

    (TL:VISA-2; 08-30-1987)

If a K-1 visa, valid for a single entry and a 6-month period, has already been

used for admission into the United States and the alien fiancé(e) has

returned abroad prior to the marriage, the consular officer may issue a new

K visa, provided that the period of validity does not exceed the 90th day

after the date of initial admission of the alien on the original K visa and

provided also that the petitioner and beneficiary still intend and are free to

marry. The alien’s return to the United States and marriage to the petitioner

must take place within 90 days from the date of the original admission into

the United States in K status.

hi, so you 're saying that if i contact again the consulate i'll be able to be rescheduled?

  2. hi,

I do need some info from an expert or someone who masters the K1 subject. here is my Q :

My fiancé and I went through a K1 process and succeeded.

i moved. but i had to be back to France before we got married.

is it possible for us to redo a K1 process, the same, with same petitoner (my fiancé), same applicant,(me ) everything would be the same. we do love each other and would like to redo it as i had to cut it.

we were approved (visas in hands) in 2 months and a half

clearly is it possible for same couple to do again a K1 procedure when the first had to be interrupted?

thank you for your true and wise answer, we need help.

    thanks

  3. hi all,

i'm requiring here advices from wise experience people and i know there are a lot !

i entered into the US under a K1 visa.

how can i work? i had contacts for some jobs when i was still in France and i know i will be hired if i can provide papers.

we 're not married yet my fiancé and I so my first Q would be : can i apply for a EAD or some any kind of working authorization so i can work while waiting for the wedding?

do i need to be married to get a working authorization and then apply to positions?

thank you for your advices !!

i need to be active and if i can bring some money to my fiancé so we get a better wedding it's all fine !! lOL

  4. There's been a lot of info regarding the crash, it only effects visa applicants. I-129f's are petitions, not visa's. This only affects those at NVC-consulate stage who have their K1 visa being processed.

I Had my interview on July 29th, we were approved. at the end they told my in Paris about that problem.

since then i have my visa status on ceac.state.gov, changed twice : ready and now administrative processing. all sound normal regarding the prob.

they set a new system for payment fees and other stuff, i guess all work well

we have a tracking number so we'll check on it everyday, i stay confident. they told me it started 10 days ago already they won't make it harder, they have to fix it lol

  5. Wow! Phoenix has moved up in the world since I used to live there -- it was hard to get non-stop flights even to major US cities, let alone London! Thanks for the info (even though I can never afford to fly British Air -- their flights always seem to be among the most expensive).

yeah ! LOL Phoenix, in now obvioulsy open to the world ! lol there are flights form Paris, direct but so far expensive !

then i agree with the British airways analysis, they are quite a bit of the top most expensive companies !

we will check out with some fare compare sites and see for the best

    thank you

  6. The big drawback of the POE not being your destination is that you have to claim your bags, go through customs inspection and recheck them. If your stop is non-POE they can check your bags right through. Much more convenient.

I live in New York and can tell you there is no problem using JFK as your POE. The line can get a bit long sometimes, but they know what they are doing and will get you through with little or no pain.

    thank you for that tip!

  7. As the others have stated, the POE is the first city you land in the US at. There are a few pre-screenings locations that are not in the US, but they do count as your POE. I personally will pay a fee dollars more for a flight that goes from Europe directly to Denver just so I do not have to worry about immigration (passport control) and customers (goods declaration). On my last trip from Frankfurt to Denver, it took almost an hour to get my luggage and exit the secure area. If I had a connection I would have to re-check my luggage, go thru security, and get to my gate. All I have to worry about is finding a shuttle or taxi to get me home. So I would vote for either a direct flight from PAR to PHX or from PAR to LHR to PHX. Just remember that each stop adds about 1.5 to 2 hours to the travel time and when you are talking about a 9-10 hour flight I would rather spend my time in the air rather than waiting at a gate for a connecting flight, YMMV.

Other than trying to make a connecting flight, the POE is up to you, your route, your wallet, and your schedule. I would recommend you give yourself about 3 hours to be on the safe side.

    Good luck,

    Dave

    thank you Dave,

i flew over phoenix with a stop in Dallas and 3 hours stop over a trip lasting already 14h was enough !! lol so i agree !

we will try to make our best to match all criteria : price, stop, time during stop, and departure/arrival flight ! lol that's not the worse when we have been through all the process.

first, my interview next 29th of July (no prob obviously)

    thank you again

    sandrine

  8. The POE is the first place you touch down on US soil. There is no pre-clearance in London, so it will/can not be your POE. I also doubt that there is a direct, non-stop London to Phoenix flight. It goes from London to some major city in the US (New York, Atlanta, Dallas, Houston, Chicago, etc) -- wherever it stops first, that's your POE. That's where you need to be sure you have sufficient time to clear immigration and customs, reclaim your luggage and get it to the place to get put on your last leg of the trip to Phoenix. In most airports, that's at least 2 to 3 hours. Good luck!

thank you it confims that the first foot in the US is the POE wherever it is

there is some direct flights even from France ! LOL

and one flights Paris - phoenix with one stop in london. all is possible, i think i will just check the cheapest and with a long stop to be sure

    regards

  9. My husband and I chose PoE based on the flights we booked on the website. My PoE was Detroit and my last stop was Key West. Choose any PoE that you think can get cheaper price of ticket planes. And yes, your PoE is the first stop you make in the US. Also, there are several Port of Entries outside of the US.

thank you !! you're kind and clear in your answer

that what i thought and wanted to do regarding flights fares lol

    regards

  10. hi all

i've been going through many posts, trying to get updated each day and i wonder about one thing :

does the choice of the POE location is important?

i want to avoid NY cause i guess the stop won't be long enough to go through check points so i was thinking making a stop in London (from paris) so it's stil Europe and then, direct to Phoenix, so i will have POE in the town, i will live.

what do you all mean , the POE is important to be chosen? difficulties, length, denied?

    thanks for your wise answers

  11. My Fiance has her interview coming up and we are struggling with the evidence portion of the paperwork. We have hundreds of pages of Whatsapp, Facebook, and Skype conversations, along with pictures, visa stamps, etc. our problem is that the only way that we have found to print off facebook, skype, and whatsapp conversations is through copying and pasting them to word documents. Is this acceptable for the interview, and if not, what can we do?

    hello

    you can import whatsapp conversations

when you are in your conversation windows, clic on menu and you have "more" , you can block, delete conv, or send conv to email ! this is what i did for myself

for other tools, just print screen , the same you have past, once to show your good intention

    good luck

if you could call, bring your detailed bill (like i'm doing)

  12. first, let me thank you all for your information and advices ! we do appreciate it !

then i guess i understand what was said, we can go in Mexico, i am the french one ! lol so i should arrive in mexico, get some religious ceremony and only after get into the US or get into the US , get married and then ask for allowance to travel..

well we will do our plan B, which is getting married in the US, both civilian and Christian wedding, and then if needed to visit his sister in Mexico just ask for the authorization from the USCIS !

we applied in May 1st and i'm already notified for my interview so, i will arrive in the US mid August , i won't take the risk to spoil our fast process !

i think i can wait for 6 other month or more to get the green card and then be allowed to travel !!

    thank you all !

    good luck in your process!

  13. hi all !

my fiancé and I have been very quickly approved , first I129f received on May 1st, letter from embassy with interview instruction on June 14 ! i'm just waiting for my interview now as my readiness form has been sent back to the embassy

anyway, we are planning our wedding, but we 'd like to go to Mexico (3 hour drive only from AZ) in order to get married at his sister's place. the pastor is american but am i able to go abroad for Two days, time for us to get married even if the administration part will take place at the clerk house in Phoenix !

can we separate both process the legal one and the spiritual religious one so i can visit abroad?

    thank you

    regards

  14. We receive our noa1 june2 we applied may 30 service Texas? Who has same case and waiting for NOA2? Haw longue take to received?

    hello,

i know it's important to have an idea about the timeline and to know how long it will take cause we are all impatient to join our fiancé(e) BUT it's a case by case problem !

for me, as a french, it took 14 days !

    I129f sent on april 30

    NOA1 received on May 5

    NOA2 on May 14

french embassy contacted by NVC on June 6, same day my boyfriend received a letter saying i should fill on line form DS160 and that i'll be contacted for an interview when these forms are filled so...

    now waiting for availabilities !

i'm telling that to you just to show you that there is no rules !! time line here are based on past experience and obviously it depends on cases

just follow the process, pay attention to all details they asking, even more (we gave all papers that sounded logical to provide and we saved time) and all will be perfect.

it's just a waiting game, be courageous !

  15. Ebunoluwa posted your consulate's instructions that cell phone are not allowed. Where did you see that they were?

You were the one that said you would just bring your phone. If you are bringing other paper-type evidence documents, then good. Those are the type you will need.

When yo\u file an I-129F petition, you are not applying for a visa. You apply for the K-1 visa at the consulate, after the I-129F petition is approved, which makes you eligible to apply for the visa.

Nothing in the instructions is an implication. There are requirements and the instructions tell you exactly what you need to include with the I-129F form. What the instructions state is required, is exactly what is needed for the approval of the I-129F petition. The main requirements of the petition are: 1) you are both free to marry at the time of filing, 2) you have met each other face-to-face at least one time within the two years prior to filing, and 3) you both have the intent to marry within 90 days of the foreign fiance(e) entering the US via the K-1 visa.

When you apply for the K-1 visa, which you have not even done yet, that is when you must prove your relationship is valid and not for the sole purpose of immigration. If you added in relationship evidence with the I-129F petition, it was not needed for the petition approval, but it will be seen by the consular officer that will conduct your K-1 visa interview. That is the purpose of the relationship evidence being sent with the I-129F petition, not to get the petition approved. It is more of a thought/plan for the future and upcoming K-1 interview, That is why it is known as 'front-loading'.

You can ask in the regional forum for Europe about the timelines for scheduling an interview in France. You can find more info about applying for the K-1 visa and interview here > http://www.visajourney.com/consulates/index.php?ctry=France&cty=Paris

    And here > http://france.usembassy.gov/immigrant_visas.html

i won't argue cause there is different cases in practice different from theory, one of my relatives just came with a cell phone and was accepted as an evidence he could bring it without sim card to be precise here. so i intend to bring it as part of my evidences but of course if i'm asked to not use it , i won't and obey ! i have many others i did not list cause they have no interest here

i know that the i129f form is just the begining of the process and do not provide the visa which is only an embassy authority. but i'm saying that providing many pieces from the begining can just help as they won't ask these pieces later.

as it is sent to the CO, it is just a way to save time and any wondering they may have such as certificate of birth, copies of all papers that can be related to the relation, status biography and so on.. from that we did not have any Further request asked by USCIS and the NVC.

i was said it may take two months from the I129F sending and the NOA2 and it took only two weeks, so each case are different and papers to bring different too. i know regarding my background i will have easy access to check and questions from the CO. and that i will have to bring papers that are not listed. i guess they dig deeper when the situation requires it and depending on the CO too ! the person i refered to above met someone very easy.

no case can be like another as stories are all different. we have main lines but details not

    best wishes

  16. That is not entirely what you said. You said you will show the CO your relationship evidence with your phone.

I provided you information that it is not allowed. For accuracy and clarification please provide a link that

made you believe so. I don't think you will find one.

Of course you have to show relationship evidence when applying for the K1 but it was pointed out to you that

the topic of the thread is about USCIS service center processing times.

Nobody said not to frontload your I-129F petition with evidence for the K1 application.

Not sure what you mean by you are 'wondering what to do'. I assume you want to make sure you are there for the iterview

with your fiance. It says on your timeline you were approved in 5 days at CSC.

If that is the case then you have a good chance to be able to be there during the interview if your travel plans were made June-August.

it takes about 4 weeks at NVC.

    Best wishes.

yes i intend to show my cell phone to the CO, but if being there i'm asked to keep it down i won't.

someone did it already and it worked well the cell phone was allowed at the french embassy when he got there for his interview so i based my speech on what i knew. if it is not allowed well i ll be notified and won't of course.

i 'm speaking about my intentions as it can be only intentions as we know nothing yet

when i say i wonder what to do, is that it takes from two up to 4 weeks to the NVC to send file to the embassy (said on the NOA2) so in adding time for mailing me, it will be end of June, when i'm gone to the us to visit my fiance. so we wonder whether it worth cancelling all the vacation and wait for an hypothetical mail, we wouldn't like to miss any dates either, that's not easy

regading the speed we are going through i'm confident i can be brought into an interview pretty fast, but just hope to have enough info in the NVC letter

do you know if they give the interview date or if i have to wait for the embassy to contact me?

    thank you

    regards

    regards

  17. It is not picky, it is factual. You told me it was required and in the I-129F instructions. How much relationship evidence you provide with the I-129F petition has no affect on the processing time of the petition because it is not even a requirement to be approved for the I-129F.

It is not implied that they want you to have been together more than once for the I-129F petition to be approved. You meet the requirement of the I-129F petition if you have been together only once within the 2 years prior filing. Whether that is enough to get approved for the K-1 visa at the consulate is another matter. Some get approved with a short time of knowing each other with just one in person meeting, and some do not. It mostly depends on the consulate and whether or not the CO believes the relationship is valid. As you said, each case is different.

Those processing the I-129F petitions do not decide if the relationship is valid or if a visa should be issued or not. Any relationship evidence added to the I-129F petition is solely for the CO at the consulate to look at for the K-1 visa interview. For some consulates, it is important that evidence be in there for the CO to see. It is not needed to get the I-129F approved though. These are two different stages of the K-1 visa immigration process.

Getting a really quick I-129F petition approval is mainly just plain luck, if it was not due to an expedite.

You should take evidence of relationship with you to the K-1 visa interview. That is where they decide if your application for a fiance(e) visa is valid, or for immigration purposes only. The Dept. of State approves/denies/issues the visas, not the USCIS. If you front-loaded your petition, then your relationship evidence will already be there in your file for the CO to see as well.

Most consulates do not allow cell phones inside. <-- You have said yours does, so that won't apply to you personally, but might to others. Not sure the CO would be willing to look at the evidence contained in your phone, but I suppose you can always ask. EDIT: nope, not going to happen, period

i said cell phones are allowed in my embassy, i will bring it and if i'm asked to let him switched off or somewhere, i will of course ! it's common sense

i won't be satisfied myself with few evidences,i will bring more than that of course and all information they are requesting, even more like my own background due to my specific activity

i just said it was implied that somehow the relation has to be valid and currently going when applying for the K1 if not why applying !! LOL

going on the Department of States, it appears the NVC Transfers the file and approval to the embassy where lives the fiancé(e) then it took between two and 4 weeks to be sent to the embassy and then the longest might be to have a schedule

in my situation i'm supposed to visit my love in June and we may not have the letter from the NVC and waste time though till my return in august ! so we wonder what to do as not knowing is not fun

    regards

  18. Phones are not allowed inside for the interview.

    depending on the embassy rules

to mine, tablets or computers are not allowed but phones are. ;-)

each embassy is different that's why each case is just different.

for other evidences it will be printed

    regards

  19. Show me where in the I-129F instructions it asks for relationship evidence. I have read those instructions many times, and there is nowhere it asks for proof of a bona fide relationship. So, where in the instructions did you find that part?

do you think it s wise to just meet your fiancé(e) in the past two years, prove it and then apply for a K1 for someone you're not in touch anymore? then meaning the relation is not continuing? i think you are picky on the terms ! it is implied that they want the couple to be real and obvioulsy the relation to be true and continued and not only meet once in Two years ! there's a fair well balance way to be.

so yes ! you're right they do not ask for relationship evidences they just ask for us to tell we met, obviously giving more than they 're asking helped us so i will never advice anyone to do the less when they can do the best.

inproving them the relation was continuing and give evidence of our relationship in addition that we met, make the process good for us so we didn't lose time in providing further evidences.

i'll bring just my phone to the interview to prove that nothing has changed since we applied.

i would advice people on that site to take and leave what they're reading cause each cases is different.

it took only 14 days from the i129f sending to the NAO2 notification whereas it takes weeks or months to others..; nothing is set in stone in this process. having a good background and being blessed or lucky helps more than anything else.

now we're waiting for NVC letter of instructions

    regards

  20. Relationship evidence is not even required for the I-129F petition.

it is as it's required in the I129F instruction to follow when you fill the form.

we followed the instructions steps after steps, providing a full package of everything, copy of ID card, translate former divorce decree, Pics and tickets proving i was in the US + notes explaining pictures + cover letter and even a letter from his mom speaking about our relationship then they recieved in Dallas the package on May 1st (tracking number) and we had the NOA2 on May 14th from california !

    now, waiting for NVC

  21. All petitions are mailed to the Dallas lockbox intake facility. That is not a service center. It is NOT the Texas Service Center. From the Dallas lockbox facility, all cases are sent to either the Texas or California Service Centers for processing. Those are the only two service centers currently processing I-129F petitions.

Your case was not transferred. Being sorted out and sent to the appropriate service center for processing from the Dallas intake facility is not a transfer.

    okay !

    i messed up the terms

the most important in that case i replied to was to tell that the money had to be cashed and then sending any package with a tracking number is the best way to follow and be sure it's in hands of USCIS

now in my case we are waiting for the NVC to be notified and my embassy to bring me into an interview, and to make all that done well, up to us to send papers as requested and to follow instructions recieved

    thk you

  22. Hello there everyone,

This is Maria. I am kind a new here in VJ. I read and learned alot in this website. Here is my situation.

My Fiance lives in Arnold Maryland, USA. We've met 2 years ago in US and got engaged December of last year (2013). He filed the first part of K-1 Visa which is the I-129F last March 20, 2014. He sent it to Dallas,TX Office. We waited for few weeks and he did't received any notification or something up until this day May 16, 2014. He called USCIS several times, and they kept saying that the can see the name of my fiance in there system. I understand that as long as they received the I-129F they will notify/inform us, right? He (my fiance) constantly check his email and mail box everyday but seems like up to this day he didnt received anything.

I finally got the urged to send this because We really badly need your assistance. I am worried now. Next week it will be 2 months already that we havent heard anything yet. I know that most of you knows the process better.

We would really appreciate your assistance. I hope to hear from you soon guys.

    Thank you and God Bless.

    hi,

have you sent your package with a certified mail, meaning you may get a tracking number so you know where it is and when it is delivered. If not, the only way to know if they recieved it is the money : did they take the money from your fiancé's account?

when all above is checked, just know that TX is the only place to apply for the K1 , so it happens they transfer files to other service centers such as Los angeles or in Vermont !

texas is known to be very slow.

for ex : we sent package on April 29th, recieved May 1st, transfered and proceeded by CA on May 5, NOA recieved on 9th in my fiancé's mail box, and decision approved (NOA2) May 14th !

    so only 14 days!

keep hope and courage, check what 's above and if the money is not taken consider you might apply again

    blessings from here

  23. Just want to add that my visa journey's estimated approval is true for my case.. it says that I may get approval from 5 May to 16 May and I got approved on 12 May!!
