  1. Hey ever so helpful folks of Visajourney,

Have any of you guys filed the I-130 petition end of July or first week of August at London?

It's been two months since my USC husband sent the petition. We got a email few days after but have not heard anything since. On the email they say it should take about 30-45 days but now well beyond the mark.

Any help or advice are welcomed.

According to the embassy website, as of last Friday, they're processing petitions filed on August 03, 2015 (http://london.usembassy.gov/dhs/uscis/i130filing.html look at PROCESSING TIMES box on top right-hand corner of the page). They'll be updating that timeline again on Friday, so you can go back and double check. But it seems like you should be hearing back from them with your NOA2 very soon! Good luck!

  2. My husband (the US citizen on a Tier 4 visa) and I are in a similar situation to yours, xDiamond. It seems like they won't be too worried about your domicile status, especially if your course was only for a year, which should be reflected on your Tier 4 visa.

Everyone else has given really good suggestions; the only thing I have to add is to email the consulate in London (USCIS.London@uscis.dhs.gov)! We've sent them a couple of emails so far and they've been quick to respond, usually within a couple of days. If you're still in any doubt, it might be best to ask them directly. All the best! :)

  3. So I am a third year PhD student in the UK and an American citizen. My wife is Singaporean and we were married last year, after which she got a UK dependent visa to join me here. After my PhD is done, we plan on moving back to America permanently.

I have seen some conflicting information online about DCF, some saying that those on student visas cannot apply via DCF and some saying that say this is possible. Can a couple in the UK for more than 6 months on Tier 4 visas file via DCF or not? If not, can someone point me in the right direction for filing from abroad apart from DCF? Thank you and excuse my rank ignorance!

  4. My fiancee and I are about to submit the K1, but our situation is a bit unique. I'm an American citizen, but I'm doing my PhD in the UK at the moment, which has made things a bit odd in applying. In any case, we plan on getting married in the US, but then leaving within a few days to attend a reception for her family and friends in Singapore and then back to the UK for the last year of my PhD. So my question is this: do we just not apply for adjustment of status after we get married and head out? Are you allowed to not apply for AOS? Or is direct consular filing a better option if we'll be living in the UK for a year or so after the wedding? I appreciate any help.
