  1. There is no RFE no change in our application status 120 days after they have received it.. should I follow up, getting frustrated and hopeless everyday now... any advice is greatly appreciated..

    If you are in Chicago the average days to interview is 136 days I think, but you can check on immigration timelines stats for your office. You can always call and ask for your status or explain your situation, they might give you some info, but I think there are still people in here that have not received an interview day either, so don't worry too much.

    So after my info pass appointment on Friday, regarding my EAD (its100 days since I filed tomorrow ) I was told the following.

    1. They are experiencing so many EAD apps that it's taking upto 6 months to process them now.

    2. They cannot do anything for me at the field office as far as processing my EAD there.

    3. I will probably get my permanent residency before my EAD as my interview is in 2 weeks.

    As far as the experience goes, the information obviously was not what I wanted to hear but 2 weeks till the interview I just have to thi positive. The guy was quite sympathetic too and we chatted for about 15 minutes about my case and he showed me the interview room. ( I was the only one in the office) but the basic message is keep in waiting.

    I think if there are sports that involve being patient at the Olympics, then people filing at uscis would win gold every time.

    Not long to go November filers keep on waiting

    I would suggest calling your congresman and opening a case with Obudsman as it has already been suggested but I guess I am not as patient as you are.

    We have our interview tomorrow. Fingers crossed all goes well!

  3. Congrats!!! Can you tell us about your interview experience?

    It was faster than I expected. He asked for our pictures IDs, my husband showed his driver's license and I gave him my passport. He then asked for my old passport which had my visa and I-94 and also asked to see my I-20. After that, he asked me some of the questions from the I-485 form, the only question I could not answer was my social security number because I don't know it, but since it was in the application he said it did not matter.

    He asked us how we meet, when and where and who introduced us. Also, when and where did we meet again after our first meeting and when was my last entrance to the US. He asked me if I had graduated from college and what was my major. He then asked if I have ever lie about being a US citizen and I said no, so he asked me if I had any pictures. I told him I had the ones I had included with my application and some extra ones.

    While he was looking at the wedding picture he asked if both mine and my spouse's family members had come to the wedding. Then he asked questions (not related to the interview) about pictures from trip we had taken together. He kept all the pictures I had not included with my application, and told us he was going to run a background check in the afternoon, and if everything was ok then he will approve us. I received the card production text and email around 3:30. I had prepared documents to show that our marriage is real and paystubs and W2 but he did not asked for anything except the pictures.

    So it's been 94 days since I applied for EAD. I have put in a service request last week, and made an info pass for tomorrow. Will they be able to do anything there and then at the field office ( in Boston) or just tell me to wait longer ?

    Any info greatly appreciated as I'm now stating to go a bit mad not being able to work. And the wife's jokes about being a sugar mamma are now old lol

    I found this document a while ago, it explains in page 3 first paragraph that after 90 days you can call and request expedited process, and that they will either adjudicate the application or issue you an iterim card withing 10 days. The second paragraph explains how RFE affects processing times. Maybe try calling again now that the 90 days have passed.

  5. My EAD has been mailed to us today as per email notification. My question is this: we have not received any RFE but when we submitted the i130 and i485 we have not included the i864 and the i693 because we don't know then. Our application is in MI. Should we send the additional forms to MI or should we wait for RFE. It's been 3 months since we submitted our application

    Prepare the documents and wait for the RFE if you don't receive one, take them to the interview.

  6. Thank you for the input. You're 100% right, as long as I got EAD, then at least I could work while waiting for the interview sched. One more question, can I apply for Driver's license with the SS and EAD card? My tourist visa has expired last Nov. We really don't have any idea on where or when to make a follow up call. I'm glad I found this site!

    Yes, you can apply for a driver license using your EAD card.

    Sorry to go on about this but, it's now day 85 and no EAD. Suggestions would be welcomed. I mean my interview is 4 weeks today is it worth waiting 4 more weeks ? I've waited this long already. I have the patience of a saint but this is starting to wear a bit thin.

    Have you called and ask to speak to a tier 2 representative? You can also make an infopass appointment at your local office. Some people are not approve at the interview and have to wait longer for their approval, so maybe you should try to get your EAD just in case.

  8. If I were you, I would send all the evidence you use for your K1 interview. Airplane tickets, letters, photos etc. also include affiliate from family members friends and neighbors. Copy of letters from friends/family addressed to both of you (maybe for the holidays/wedding?). Bank statements, car/home insurance, photos from trips you took together, and any paper that has both of your names, the more you send the better. If you only send a few document they might still have doubts, but if you provide documents that tell your story before coming to the US and after you stand a better chance. I have a friend that also received and RFE after the interview.

  9. We submitted I-485, I-130 and I-765 last nov 18, 2013. I had my biometrics done on Dec. 18 but since then I have not receive any update snail mail or e-mail. I am wondering if there is more forms we should have submitted together withtheabove mentioned forms and requirements. Our papers were forwarded to National Benefits Center. I am getting anxious as my B2 visa expired on Nov. 19.

    If you want to received text and email notification you have to go to uscis website and create and account and then add your cases using the case numbers
