Or do you mean NOID, Notice of Intent to Deny?
Per my understanding of the process, if the petition (I-130) was approved by USCIS and the embassy decides for some reason or another the petition should not have been approved, the embassy kicks it back to NVC who then passes it back to USCIS, who then reviews the reason why the visa was denied. Once USCIS is done with their review, they then send the NOIR or they re affirm the case, then apparently the beneficiary will have to attend another interview.

In my situation, USCIS had originally approved our I-130, my husband attended his interview at the embassy, but the embassy denied the visa, and sent it back to NVC, now it's at USCIS who are reviewing our case and they will be sending the NOIR. Right now, I'm in the process of preparing my rebuttal and getting my documents together.

Yes I visited Pakistan, only stayed for a few months. We met on FB through a mutual friend. It wasn't a big wedding, but I did meet family members and friends in Pakistan as well as family members here in the US. Age difference isn't so huge, I'm 4 years older than him.

Yup. I know that's a red flag, but before meeting in person, he had known each other for 4 years.

Do you know the reason for NOIR? Everyone almost knows why NOIR is issued? Well, NOIR letter will have exact points referring to issues raised by CO however applicant generally have a very good idea about what was the issue. Knowing the issue and working on resolving the issue with a lot of documentation is the only way. And the crucial thing is time while responding to NOIR.
Don't waste your time with a lawyer. prepare solid evidence for rebuttal and present it with a letter stating same.
P.S.: I am surprised how NOIR is expedited
I don't know the reason for the NOIR, but just to give you some background on my husband and I. We come from different backgrounds, he's Pakistani and I'm African American. He's Muslim and I'm Christian. So I know those are red flags for the CO's at the embassy and I bet those reasons will be outlined in the NOIR. The only documentation we have are our chats, also we sent money to each other and receipts for gifts. I haven't been able to visit because of work and such.
As far as the NOIR being expedited, yeah I know it's surprising. I called USCIS in late May inquiring as to when I'll get it, the rep told me, it hasn't been 6 months yet and they don't bother looking into delays or getting petitions expedited until that 6 month mark has been reached. She informed to call USCIS once 6 months had passed.

Hello all,
Today I spoke to a representative at USCIS (she seemed new, because she asked me when I filed my petition twice during the call and also didn't seem to know my petition was sent back to USCIS). Anyways she was able to get my NOIR expedited because according to her, my petition was processed outside of the normal timeline. She stated I'll get the NOIR in 30 days. Just seeking advice from petitioners who are in the process of responding (or have responded) to the NOIR. What are some good tips? Is seeking a lawyer a good idea?

My husband and I are currently awaiting for the NOIR to arrive. According to the CEAC website our case was returned to the NVC on Nov. 1st after spending months in AP at the Islamabad Embassy. My husband and I hurt and he's is frustrated at the entire process and is ready to just throw in the towel. Honestly, I'm not surprised this happened (being Pakistan and all) but that doesn't make it hurt less. Being part of VJ helped me mentally prepare that this could happen.
How long does it typically take for the NOIR to arrive? (seems like the timings are varied :S)
Anyone who experienced receiving a NOIR (I know the USCIS gives the petitioner about 30 days to respond) is it a letter? A packet?
I keep hearing that at this point, it's best to consult an immigration lawyer.
Any advice is much appreciated.

When I sent an inquiry to I got a similar reply, but didn't have the word refused in it.

My case is kind of like yours. Although I met my husband nearly 6 years ago. I didn't get to meet him until 2015. Namely due to money issues and my job. When I did visit my husband, we did marry after our first meeting. I met his family and a few friends, we took pictures and had a nice little reception with a lot of food.
My husband had his interview back in March and it's been in AP since. He took wedding pictures, pictures of the reception, chat logs we had on Whats App. Receipts of gifts he bought me at Doleman mall. I don't know how your husband's interview will go, but for my husband they did accuse of him fraud (I think the CO's were trying to rattle him) but at the end they kept his passport and supporting documents. Not saying this will happen to your husband, but you never know.
Our red flags:
Different religions: I was raised Christian and he's Muslim
Different cultures: of course he was born in Pakistan I was born in the US.
Different ethnicities: I'm Afro American, he's Pakistani. (yes I know, not very common)
I'm thinking of going back to visit, but I don't know for how long. I was thinking of using my PTO but I don't how much my job will approve.So that's up in the air right now.

But also want to add the interview could become an interrogation, especially of the CO or COs feel the marriage isn't real. My advice to your husband is that if this happens, he needs to keep his cool and don't let them rattle him and he should be fine.

My husband had his interview in March and is currently under AP since then. The last update was on May 5th, but that's because I had inquired about the status of it. The embassy hasn't asked for anything. I'm kind of nervous because I heard some cases remain in AP for years and I'm afraid ours may be one of those cases. *sighs*

I didn't. Since I learned how my husband was treated I probably should have, especially since I had plenty of PTO. But the interview letter stated it wasn't necessary for me to attend. So who knows, it may have been.

I started this thread because I wanted to know if anyone else had this type of interview experience.
My husband had his interview back in March and after the interview he called me and told me it lasted for about an hour, not only that he told me they took him to an interview room with 3 CO's, 2 of which were Pakistani. In the beginning they asked him the typical questions, where did you meet, how did you meet, what we did when we met, etc. Then the interview took a turn and they accused my husband of being in a fake marriage.
After the interview, they kept his passport and gave him the white slip and didn't ask for any other documents. Now our case is currently under AP. Has anyone else had this experience or know someone who has?

I've been so bitter for the past few months it's hard to crack a smile and enjoy this... Let's hope for more CCs today, especially for those waiting the longest...
