  1. Hi everyone I need help and advice. We have RFE because he has been convicted with one of the crimes indicated more than twich such as his DWI. He previously submit all his police records and now they are asking for court convictions with courts sealed sign and signature so he sent a waiver of from the court with all the detailed convictions. Now we are just confused because its written in the evidence notice :

    Miscellaneous : SUBMIT A SIGNED AND DATED STATEMENT REQUESTING A WAIVER FOR YOUR CONVICTIONS AND EXPLAIN WHY THE WAIVER IS APPROPRIATE UNDER YOUR CIRCUMTANCES.

    COURT DISPOSITIONS

    .BLAH BLAH.......THE FINAL DISPOSITIONS SHOULD BE OBTAINED FROM THE COURT WHERE THE HEARING TOOK PLACE.... BLAH BLAH

    so when my fiance go to the court he got a waiver of his convictions for all the charges with sealed signed. He sent this back to uscis but now we are just confused are they asking for him to make statement also to request for waiver of his convictions????

  3. Thank you all for the advices and informations. Hence I do not have any K1 pending application. And yes they gave a copy of sworn of jurisdication and another form for voluntary withdraw my application for admission and another paper for all questions and answers the officer asked me.Im praying hard that I wont have any problem after we get married and apply for spouse visa.   4. I recently got denied entry at the Port in USA as a tourist they found out I have a american fiance and doubt I wont come back home. Although I tried my best to explain to them I will stay for a short period of time only and have no intention to get married in usa. They didn't believe it so I voluntarily withdraw my application for admission, they cancelled my tourist visa and sent back home on the same day. Now my fiance is coming in my home country next month to marry me. My question is do I still need to apply for the waiver to re enter the usa?? I found out over the internet that if I was voluntary withdraw my application I don't have to get a waiver and it will only apply for those who had been removed expedited. I really have no clear information about this. Please any advice will be appreciated..

  5. Based on my personal experienced, I travel just recently as a tourist and was denied at the port of entry due to non immigrant intending to be immigrant. They are very strict I have no idea they will dig everything they checked my personal celphone and ipad. At first I told them I will just going to visit a friend and will stay for 5 months. Unfortunately they found I have a boyfriend who is willing to marry although I told them we have no intention to marry under B2 visa and I will come back home but they still didnt let me enter so I withdraw voluntarily my application and they booked me a ticket going back home on same day. Be very careful on travelling on tourist visa.

  6. Thanks to everyone for all the advice. But Im losing hope about the fiance visa and applying for waiver because I felt it will takes a lot of time waiting and least chance. But we have another option I will apply again for J1 type of visa, they said I'm still qualified for the career training program, the last time I did the internship. So we will see from there and hope for the best.

  7. I met my fiancé 4 yrs. ago when I was in USA on J1 visa under internship program. I went back home in the Philippines when the program ended despite the distance we continue our relationship. Everyday we keep in touch and stay strong to support each other. Long distance relationship is never easy, due to loneliness and being depressed. one horrible night happened when my fiancé has been charged for dui on 4th offense. He served 4 years in prison he regret it so badly but he is grateful that he never brought harm to anyone except to his self and that he has learned from his mistakes. Despite of being in jail the court allow him continue to stay working in his company offshore and go back to jail when he take off from work so we still have communication. It is very hard and painful for both of us for all the years wasted but we never give up. Now he is a free man trying to have a better life and get himself all together. He is still under the parole and the court gave him order that he can only travel out of USA till year 2020. So I tried my best to get a tourist visa to visit him and I got approved.

    But it gets even harder when I travel just recently and I got denied at the port of entry as a tourist because they doubt I wont come back and the customs found out I have fiancé who is willing to marry me. Although we told them we don't have intention to marry and just file for fiancé before I come back home. But still they didn't allow me to enter so I voluntarily withdraw my application and come back home on the same day of travel. They said I can reapply anytime either immigrant or non immigrant visa.

    I am so stress and depressed with all this waiting and trying to be with him same thing he is showing me. So our last option will be the fiancé visa but we met 4 years ago? Is there anyway we will get approved for K1 or we still have to apply for this waiver to prove the extreme hardship?? Please any advice will be highly appreciated.



  8. You need to apply and be approved on your own recognizance, i.e. you need ties with the country where you reside, a substantial bank account and you need to satisfy all the IO that you are not present an immigration risk.

    There is no invitation letter from a family member or individual that can help you. You must disclose any relatives and/or friends you are coming to the US to visit, but they can't help you get approved.

    Thank you so much for your response. If there is no invitation letter needed, what would I tell them where to stay and with whom?

  9. Hello, I need advice for getting B2 visa. I want to come back to states for just a trip. I've been to America two times already, first was on 2004 for 4 months to participate the work and travel program offer in our university with J1 type. I came back in the Philippines and finished my degree. Then I worked in my home country for 2 years and I applied again on 2006 for J1 type visa for the Internship for 12 months, visa was approved again. I came back in the Philippines then decided to work in Dubai since the J1 visa has 2 years rule bond. Now the 2 years was over I would like to apply for the tourist visa, I'm 29 years and been working in Dubai for over 3 yrs now still single lady. What is the possibility for me to get the B2 visa? What is the best invitation is it from my relatives or guy friend??? Please advice.
