  1. So I am about half way through the Cr-1 Process. NVC just has to go over our sent in information before we can get routed to the embassy.

    A month ago my husband entered the United states to see me. He only intended to stay for 2 weeks and that is what he told the officer. He had round trip plane tickets and a letter from his employer whom expected him back in two weeks for work as well.

    Well two weeks went by fast and his passport is clearly stamped with the date "Feb 8th, 2015" which is exactly 6 months from his entry, As a Canadian citizen he is allowed 6 months in a year to be in the US unless told otherwise by an officer. So we changed his leaving flight to a day later, and then a week later, and then finally another week later and then yesterday he just didn't show up to the flight at all.

    This is our thinking: he could stay here until after Christmas, which would be a little less than 5 months, and then we could both return to Canada together to await his interview. Then if his visa is granted, we can both drive back over the border to the US.

    Here's our worries: He told the officer when he would be back and that his employer would be expecting him(which was true) but obviously if he stays he wont be able to keep his job. We are not worried about money, I make enough here to support him until we leave and he has a good amount in his bank account at home in Canada to support us until we go back to the US.

    Is there any problem with this plan? Advice and opinions are much appreciated. Thank you so much.

  2. For starters, He didn't speak with the Border Patrol, he spoke with an officer from Customs and Border Protection (CBP).

    Once he was done with the entry procedures, how long did the CBP officer authorize his stay? He may have told the officer 2 weeks but the officer may have granted him more time than that (perhaps up to 6 months).

    Staying on past the intended time is not a problem as long as he departs before his authorized stay ends.

    Alright, sorry. The officer didn't specify. He was in a hurry because my husbands plane was leaving. His stamp on his passport says Feb 7th, 2015(which is 6 months from the day he entered) but it's in the spot where usually it states the date he was admitted. I am wondering if it was just a mistake.   3. My husband is a Canadian citizen and is currently visiting me in the US. He told border patrol he was only going to be staying with me for 2 weeks, but now that he has gotten here we are thinking maybe he should stay for a few months. By then I would have my passport and I could fly back to Canada with him and await his interview date from Cr-1 process. Is it okay to stay longer than you told border patrol you would be? Is it okay to stay for months at a time when you are undergoing Cr-1 Visa process? He has a plane ticket to leave to go back to Canada for 6:23 this morning. We would like to cancel it but we are scared there are consequences. Please help.

  4. My husband and I got married 5 months ago. He got in on a limited stay of two weeks the last time he was here to visit, and we got married at the courthouse. Since then, we started the Cr-1 Application and we are to the point where we are putting together the Affidavit Of Support package to send out to NVC. My husband got a another two week vacation from work on the 8th of August and so he left that day on the plane. He was scheduled to leave on the 23rd of August but because of delays he decided to push back his departure to that following Monday. When Monday came around he again pushed back his departure to Thursday (tomorrow). My husband is Canadian, so unless otherwise stated by a border patrol officer he can legally stay in the US for 6 months in a year. On his last trip when we got married the patrol officer put in his passport that he could only stay for 2 weeks. This time the patrol officer didn't put anything in his return date section but the stamp says Feb 7, 2015 which is 6 months from his arrival here. Because my husband was told he could only legally be here for 2 weeks his last vacation we didn't even think about the possibility of applying for adjustment of status. My question is, do you think it would be a good idea for my husband to just stay here now and apply for adjustment of status rather than finishing the Cr-1 application? Could he stay with me during the process of adjustment of status? Also, if he told the border patrol officer he'd be back in 2 weeks and he stays longer than that will they consider that lying when and if he passes back through? It's just so hard having to say goodbye over and over again and being separated for months at a time but only being able to see each other for a couple weeks at a time. What should I do?

  5. Alright so, I am wanting to bring my husband into the states to live with me. I was going to apply for cr-1, but there is one thing I am worried about. I am 18 years old and I am just finishing my senior year in HighSchool so I have no Job and I don't plan on having one until after graduation. I understand there is a financial requirement involved to be eligible for cr-1. My father makes well over enough to meet this standard and has agreed to be a joint sponsor with me. I live at home with him and my mother and 2 of my other siblings. My question is even though my father is taking that role for me, does it still matter that I do not have a job for the time being? My father is more than willing to take care of us until we get on our feet.
