  1. So I just found out that she supposedly got a lawyer and that they got her greencard sent to her address. Supposedly they updated her info to be in her name. That's what she said. She's not filing for divorce. Her plan was to divorce after the 2 years. I wasn't expecting her to receive her greencard the end of last month because we called before several times and they said we were looking around March/April due to processing times. We got married in March and filed AOS in July.

  2. So my wife came in on k1 visa. Things didn't work out. She screwed me over. She cheated on me. On December 28th she got notified that they are sending her greencard in the mail to her address (she has her own apartment now). Is there a way for me to still get her card revoked or something? I plan on getting a divorce obviously but I don't want her here anymore. I know she would voluntarily leave if her card got denied or revoked somehow.

  3. If I withdraw the petition, she can still stay? To be honest I don't even want her here. She screwed me over and the last thing I want is to see or hear about her. She said she was going to get an immigration lawyer for her rights and future. She doesn't even have her greencard. I have proof that she cheated on me while married. She brought her car over from her home country. Her best friend (has suspended license and is on parole) drives it everyday. He's the one that takes her places and to work. The apartment she has is under both our names. I know I can't physically force her out but if I withdraw the petition won't she get deported?

  4. My wife and I got married in March. She came in on a k1 visa. In July we mailed out forms i485 and the work one. She already got her employment card. She has been working for about a month and a half. Turns out that we aren't together anymore. She screwed me over. Now She has her own apartment. I want to get a divorce. What's the best way for me to make sure she doesn't get her greencard and also gets sent back to her home country?

  5. Hey guys. So recently our Case Status got updated from Administrative Processing to Ready. It said to schedule an interview, etc. She had her interview last year March. A week later (now today), our case got updated twice still as Ready. Originally our case creation date was December 19, 2013. But today when it got updated again, the case creation date changed to todays date. It also says "Your case is open and ready for your interview, fingerprints, and required documents. If you have already had your interview, please check your status after two business days." I just wanted everyones opinion as to why the case creation date got updated and why the status is a different "Ready".

  6. It is possible they would want another interview. However, they had you send in the passport instead of waiting to bring it to an interview, so I am guessing the Ready status is just they received everything required and it is Ready for processing. You would need to hear from the consulate to be sure though.

    From what they told us when my lawyer got involved, they asked for the passport so that if the visa got approved then they can send her passport with it. We've been emailing them everyday for an answer.

It means that they are finish with your case, they are done reviewing and making a decision and the visa is ready to be issue , if they have her passport they will send it with the visa ( that's if you guys already paid for the delivery) or they might send her instruction on how to pick up the package .

    Thanks, Hopefully thats what that means. We're hoping she gets a letter in the mail this week to verify this.

    I already did that. We mailed the necessary documents and they confirmed receipt of it on 12/19/2014. The status of our case was "Administrative Processing" during that time. It just recently updated to "Ready" so I wanted to know what that meant.

  9. Confused. Is this your original file or did you refile? It's hard for me to believe an interview could've been March 2014 & the same K-1 still be in play.

    It's original file. She had her interview March 2014. Originally we used my mother as joint sponsor because I wasnt working at the time. Unfornately they told her my mothers income wasnt enough and gave her the 221g form. They told her to find another joint sponsor and that she has up to a year to do so. We got another sponsor (best friend) and mailed it out roughly in May. This time they refused us for the same reason which was word because he made roughly $10k over the poverty guidelines. We got a lawyer involved and in November 2014, the Consulate told us that my friends income was enough. So they asked for her to send her passport, new medical and letter of intent which we did in December 2014. Since then, we have been waiting.

  10. Hey guys. My fiancee was given the 221(g) form and asked to provide a new affidavit of support for joint sponsor. We did but got refused the K1 visa last year in the summer because my joint sponsors income wasn't enough (even though it was). I ended up getting a lawyer involved and all of a sudden they said our joint sponsors income is enough and that my fiancee needs to send her passport, a new medical and letter of intent. She did all that the 2nd week of December and the Consulate confirmed receipt of the documents on 12/19/2014. The case status has been Administrative Processing since then but recently on 01/22/2015, it updated to Ready. I just wanted to know if anyone knew what that meant? It says the case is ready to schedule an interview even though she already had one last year March.

  11. Hey guys. So last month my fiancee had her interview and she got denied and was told to provide 2 documents in order to continue. First one was a letter from IRS stating I didn't file for taxes, and form I 864 for joint sponsor. I used my mother as joint sponsor and we provided the forms they asked for. So today, she receives a letter from the Consulate saying

    Thank you for your communication regarding the below-referenced immigrant visa case. In order to continue processing the case, please send to the U.S. Consulate General in Montreal the following items: your joint sponsor does meet the poverty guideline, your case requires another joint sponsor. Please have the I 864 and 2012 or 2013 completed and sent to our office for review.

    I wanted to know what do you guys suggest we do? Like this makes no sense. It clearly says joint sponsor meets the poverty guideline -__- .. Thanks!

  12. So my fiancee recently got denied the visa and was told she had to mail in my 2013 taxes and I-864 for Joint sponsor. I had my mother co-sponsor since I am unemployed. We provided 2 I-134 with supporting documents but that wasnt enough. I was told that my mother needs to fill out form I-864 but its a bit confusing so I wanted to know if I can get help filling it out. Also, do I need to fill out form I-864 too or only my mother? Is form I-864a required. When she got denied, she was given a letter saying

    To complete your application, you will need to submit original copies of the following document(s) through our courier:

    2013 taxes for petitioner

    I-864 for Joint Sponsor

    I already got a verification letter for non filing from the IRS. I just want to know if only my mother needs to fill out form I-864 or do I have to also? And if form I-864a is required as well. I'm not sure what to check for part 1 and also, for part 2 do I put my fiancee's info? What do we check for part 3, yes or no? For part 4, is it my info or my mothers? Please and Thanks!

  13. You can get a "Verification of Non-filing" online actually, comes in very handy: http://www.irs.gov/Individuals/Verification-of-Nonfiling-Letter

    A lot of the forms are generic as well since you could be doing an AOS for a parent or someone else depending on what process you're on which is why they don't say "spouse". Heck yours wouldn't even say spouse since you guys aren't married yet smile.png.

    If your mother didn't submit an I-864 with 1d checked and everything else indicated that seems likely to be what they're referencing. Others may be able to provide more information.
