    My husband and I sent off our I-751 package on Monday 22nd. My green card expires on June 23rd. I am wondering - if I do not receive an NoA in time, can I make an appointment with InfoPass for an I551 stamp WITHOUT the NoA? I need to be able to drive myself into work and will need the stamp to renew my driver's license. :(

    It's about time for me to file my I-751, and I've been looking over my list of evidence. My husband bought our house prior to our marriage and my moving to the US and as such, I don't believe I'm able to be put on the mortgage. We live together and I am on the bills, we have a joint bank account, file our taxes jointly but have no leases, mortgage or cars that have both our names on them, as he had all of this before I moved. I am covered by his insurance, and I am also insured to drive the car. What should I do? What kind of evidence should I submit?

  4. Nothing really happens other than you have no proof of your legal status - however you will have legal status. At that point you can renew your GC using I-90 if I am not mistaken or you can - at any point after 3 years - apply for citizenship and forget about green cards.

    Citizenship is completely optional step. You can be a resident forever if you choose so, just have to remember about requirements to maintain residence. Some people do it. Only "disadvantage" of becoming a US citizen is a requirements to file tax returns with IRS - wherever you live. So if you move back to Australia in 10 years from now being USC, you will still have to send tax returns in to IRS. Overall, I think it's no brainer to become a USC.

  5. To be exact - you _have_ to apply for RoC within 90 days of your 2-year GC expiration date. If you do not do that, you will be out of status. Once you have 10 year card, your status does not expire with the GC expiration and you will be able to (but not have to) apply for citizenship at 90 days from being resident for 3 years assuming at that point you are married for 3 years to USC (which sounds like you will be).

    What happens when the 10yr GC expires? Is citizenship then not necessary to stay living and working in the US?

  6. If your green card expires in 2017 than you likely have to remove conditions on it and get 10 year green card first and not worry about citizenship for a while. Head over to RoC subforum...

    You have to married to USC for 3 years _and_ resident for 3 years to be eligible for citizenship.

    It's been a while since I've had to deal with anything regarding my immigration status, and I have been living pretty blissfully ignorant of it all with my GC (so happy to be done with the visa part of everything).

    Of course, now, I've started worrying about naturalisation and where to go from here, and would really appreciate any help from the readers here at VJ. I moved to the US from Australia May 31st 2014, was married August 9th 2014 and received my green card around June 2015. It expires June 23rd, 2017. When do I need to start applying for citizenship, and what is generally required to do so?

  8. You are in a legalized period of authorized stay with a pending adjustment of status application (or something like that). Purgatory sounds about right.

    Congratulations on the wedding! And I'm glad you filed for the EAD/AP. Green cards can take a year (+) right now, but as long as you have your EAD/AP, it doesn't really matter!

    You applied for AP in November? You should have your EAD/AP card within 90 days of filing. If you've passed that window, you need to make an InfoPass appointment at your local USCIS office to get that sorted out (and maybe a temporary stamp in your passport).

    I applied (and received) my EAD already, but I did not file for AP in November, as I was under the impression that I would need a travel date set to apply. Now I am in need of AP and are applying. I have not been told about InfoPass at all. (In fact, I don't know what that is?)

  9. You truthfully do not need work auth to apply for SSN. I went with my passport, marriage certificate, license....no problem I had a print out that day, card came about 10 days later. Just a question how long did you wait for your work auth to be approved??

    Well thankfully the work auth is coming soon anyway, as long as I can apply with it I'm happy about that. :) I got my I-765 receipt on November 19th and received the notification of the card being ordered on January 29th. :)

    Your timeline is incomplete but it sounds like you've already started the AOS process. You were eligible to apply for SSN after you completed POE. Apply for you SSN when your EAD comes in the mail. :)

    Today (Jan 30th) I received an email saying my temporary employment card (Form I-765) is coming in the mail (YAY!!!). Approximately how long will it take to arrive, if anyone knows?

    Also, am I eligible to apply for a SSN with it or do I need to wait for my green card? I am looking into filing a form W7 for joint taxes but if I can get a SSN with the work employment card that would be much better.

  11. Hi everyone,

    My husband and I filed our K1 related AOS forms a few days ago and checking the mail tracking number, I can see that it was received on November 18th. When he wrote out the cheque, he wrote it out to "USCIS" for the filing fee and the biometrics in one. Did we file this correctly? I become such a ball of anxiety every time we file something, scared we messed up.

    Also, in the event that it is incorrect, what happens then? Do they send us our money back? Do we send a new check? Resend all the paperwork?

    Thank you both a lot. My husband had said someone from his workplace had said the same thing, but it's nice to hear it from people here in VJ. Sometimes I get funny ideas in my head and freak out that I'm going to be sent back to Australia for us delaying this.. Hah.

    "If you already have filed your I-485, please carry with your NOA-1, passport, and marriage certificate."

    Are you saying here once I have filed the AoS that I should always carry these items with me regardless? Just clarifying.

    Today I finally received my Packet 4 Instructions (YAY!!) and was given an interview date set in Sydney, Australia. They ask for payment "K1, K2, K3 & K4 Applicants

    K visa applicants pay an application fee like any other nonimmigrant visa applicant. The current application fee for the K visa is USD $240.00. (The AUD equivalent is $264.00).

    This fee is currently only payable in person at Australia Post via cash or EFTPOS. Please refer to http://www.ustraveldocs.com/au/au-niv-paymentinfo.asp#inperson for further information on payment options. Bring the receipt for this payment to your interview." but when I follow that link, it tells me to log into the website and then to set an interview date AFTER I've paid. But I already have my interview date? How do I pay the fee?

    My fiance and I are on the final leg of our visa application, almost. But I am confused about the forms I need to fill out, and when to send what.

    Firstly,

    1) Do I send form DS-230I BEFORE I send the rest of my package?

    2) Do I schedule my medical before I know the date of my interview, or afterwards?

    3) Where does for DS-160 come into play?

    Please help, I'm so confused!

  15. Personally, I would cut the trip short. Otherwise you're probably going to need to call/email/write to the consulate in Sydney and request an extension.. I'm not too sure how that would look, but I do know they give them out under reasonable circumstances (for example, my interview was Sept 24th, and my petition was set to expire 6 days later on Sept 30th - they said I'd be fine but in the end they had to extend it by 2 days). Remember when you send pkt 3 you are signing off that you are ready to be interviewed. Don't send it all through if you're still in the states and thus can't attend. It just wastes theirs and your time.

    Well, in addition, I'm currently unsure as to what information I need to gather prior to my interview. I am aware that I need a medical check beforehand, but how much needs to be done beforehand? Would it be reasonable to try schedule my interview for late Feb (even if I don't come home early)?

  16. My fiance received our NOA2 in the mail yesterday, with validity dates from Oct 2013 - February 28th 2014. The problem for us is that I'm leaving to go over to the U.S. with him for three months (November 22 2013 - February 20 2014) and I'm not sure I will be home to receive my interview instructions/what else I need to do. Does anyone know of a way I can handle these things from over in the States, ready for when I come back to Australia?

  17. I think you are talking about NOA-2 (I-797). Embassy will extend the petition automatically by showing them that you're pursuing your K-1 visa. How to show your intend? fill out some forms like DS-160, schedule your interview date, medical, and etc. Can you do all these things in US?

    Sorry, yes, he's only sent me a small photo so far to show me that we got it and to show me the validity dates. I'll need to look up the DS-160 form, I've not seen that one yet. I can try and schedule the interview and medical date providing they give me more than the 5 days (as I'll land back in Australia around the 22nd due to timezone differences). I may be able to do these things in the U.S. I don't leave for another two weeks...

    Thankyou for your help, I'm very new to all of this and we're pretty stressed out about it right now.
